L , CITY OF SHAKOPEE Memorandum COr~SE~JT TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Riverside Fields 3Td Addition Building Permits DATE: February 1, 2005 INTRODUCTION: Attached is a letter from Ryan Lewis of Centex Homes requesting building permits for the above referenced subdivision. Centex Homes did complete the concrete curb & gutter and street paving on this street which is a cul-de-sac. BACKGROUND: This past year the City Council did adopt a policy on when building permits can be allowed and essentially the significant change is to allow permits on bituminous paved surface versus gravel surfaced roads. In this particular case, Centex did complete the street, however, has not completed the storm sewer along the rear lot lines. In my opinion, the intent of the policy has been met and Centex is agreeing to limit the number of lots and not to receive a Certificate of Occupancy until the storm sewer is installed. I did consult with the City Attorney on this issue and we both felt that the intent of the policy was being met and permits could be issued with conditions. This item is being brought to the City Council since the policy does define "substantially complete" as all utilities being installed as well as the bituminous street paving and concrete curb & gutter. Staff has worked with the developer to limit building permits in an area that is acceptable and no Certificates of Occupancy will be granted until the storm sewer is installed and accepted. Staff does support this request and asked for Council concurrence. ALTERNATIVES: 1. Approve a motion to allow the issuance of seven building permits, Lots 4-10, Block 1, Riverside Fields 3rd Addition subject to no Certificate of Occupancy, until the rear lot line storm sewer has been installed and accepted by the City. 2. Do not allow any building permits in this subdivision. 3. Table for additional information. RECOMMENDATION: Staff would recommend Alternative No.1, as the developer has limited the num.ber of building permits and agreed to no Certificate of Occupancies until the storm sewer installation is completed in the spring. Staff believes there is ample time to complete the storm sewer prior to completing the building. ACTION REQUESTED: Approve a motion to allow the issuance of seven building permits, Lots 4-10, Block 1, Riverside Fields 3rd Addition subject to no Certificate of Occupancy, until the rear lot line storm sewer has been installed and accepted by the City. Shakopee, MN 55379 Re: Riverside Field 3rcl Addition Dear Mr. Loney: We are hereby requesting from the City of Shakopee seven building permits for Riverside Fields 3rll Addition. Centex Homes purchased Riverside Fields 3fd Addition on November 6th, 2004 and had planned on having all of the grading, streets and utilities completed prior to freeze up. However, during the grading portion of the project we encountered deeper glass cleanouts than anticipated, which required additional time in our schedule. Additionally, In reviewing the relationship of the rear yard storm sewer in block 1 lots 11-17 and the adjacent property owner, It was in the best interest of all parties to realign the storm sewer onto the commercial property. 6y the time the' new plans were designed and approved by the city the frost had set into the ground. Centex Homes has made every effort to complete the storm sewer and water main, but due to the frost being 3 to 5 feet deep we would expect to pay astronomical pricing to complete this project at this time of the year. Centex Homes plans on completing aU outstanding work in Riverside Fields 3rd Addition immediately after the frost comes out of the ground. We understand that there would not be any certificates of occupancy issued until the utilities were completed and tested in the 3rd Addition if permits were issued.
