Prior Lake - Spring Lake Watershed District Channel Restoration

INTRODUCTION:
Attached is a grading permit application and corrected easements from the Prior Lake -
Spring Lake Watershed District (PLSLWD) for a channel restoration project, from CSAH
16 to 1500 feet south on the Prior Lake Outlet Channel.
BACKGROUND:
The City of Shakopee and the PLSLWD have been working towards a revised Joint
Powers Agreement (JP A) on upgrading the Prior Lake Outlet Channel from Prior Lake to
Blue Lake. The PLSLWD has received a grant to restore the channel from CSAH 16 to
1500 feet south. Plans have been completed to restore the channel using various
techniques to handle the ultimate flow that has been determined with the Prior Lake
Outlet Feasibility Report.
The PLSL WD has done an EAW for channel improvements and has a negative
declaration on an EIS. Grants have been received to facilitate this project moving
forward at this time.
In order for this project to be constructed and since there will be more than 50 cubic
yards of excavation, a grading permit is required. Attached to this memo is the grading
permit application and staffs conditions to the permit. Since this is a public
improvement project, benefiting the City of Shakopee as well as the PLSL WD, staff is
recommending that the permit fee be waived and no security be required, as the
PLSL WD's contractor will have a performance bond.
This project is similar to a County Highway Project and the City and County usually
enter into a cooperative agreement. Staff is working with the PLSLWD's staff on a
revised JPA and hopefully will have a new agreement later this spring.
Also, corrected easements are needed to construct the improvements. Previously,
easements were granted to the PLSL WD and the City of Shakopee. Attached are
corrected easements, which need execution signatures by the City.

ALTERNATIVES:
1. Approve a motion approving the grading permits for the PLSL WD channel
restoration, from CSAH 16 to 1500 feet south, with the permit fee and security
requirements waived for this proj ect.
2. Authorize the appropriate City officials to execute the corrected easements for the
Prior Lake Outlet Channel Restoration.
3. Do not approve permit or corrected easements at this time.

RECOMMENDATION:
Staff recommends Alternative No. 1 and No.2, in order to stabilize the Prior Lake
Channel and prevent future erosion; The channel design is for ultimate flow of ultimate
development of the area. It should be noted that the channel restoration is for drainage
only. Future green way corridor and maintenance trail would be part of future

EASEMENT IMPROVEMENT AGREEMENT
This agreement ("Agreement") is made as of the _ day of ---.:...., --'
2005, between STEVEN D. MUHLENHARDT and KATHLEEN V.
MUHLENHARDT, husband and wife (collectively "Owners"), the PRlOR LAKE.
SPRING LAKE WATERSHED DISTRICT, a political subdivision of the State of
Minnesota ("District"), and the CITY OF SHAKOPEE, a municipal corporation under
Minnesota law ("City").
RECITALS
A. The District is presently engaged in a project, iq.entitied as the Outlet Channel
Improvement Project, Segment 4B, to repair. certain portions of the Prior Lake Channel
, ("Channel") within the City, originally constructed as part of the Prior Lake Outlet
Project No. WD 76-4.
B. The parties previously entered into a Deed of Drainage and Utility Basement,
dated November 26, 1982, recorded. March 5, 1984, as document 199712 ("Original
Easement"), in connection with improvements proposed, and easements to be acquired,
in connection with the original construction of the Prior Lake Outlet Project.
C. The Owners have now agreed to grant the District and the City (collectively
"Grantees") amended easement rights to conform the Original Easement to the present
location of the Channel on the condition that the District agree to repair and improve the
Channel as hereinafter specified.
AGREEMENT
In considerdtion of the mutual covenants herein, the parties agree as follows:

1. REelT ALS. The foregoing recitals atetrue and correct and incorpomted
herein by reference.
2. GRANT OF AMENDED EASEMENT lUGHTS. Concurrently with the
execution of this Agreement, the Owners shall execute and del iver to the Grantees an
Amended Deed of Drainage and Utility Eascmen~ conveying to the District and the City
a perpetual easement for flowage and utility purposes and a temporary construction
easement for a term of 18 months substantially in the fonn of the attached Exhibit A.
3. IMPROVEMENTS TO BE CONSTRUCTED BY DISTRlCT. InpartiaI
consideration of this Agreement., the District shall at its cost and expense make the
improvements to the Channel more particularity specified on the plans attached hereto as
Exhibit B ("Channel Improvements"). The District will indemnify and hold the owners

harmless from any liability for the cost and expense incidental to the conS1J1lction of the
Channel Improvements.
4. ENTIRE AGREEMENT. This Agreement and the Amended Deed of
Drainage and Utility Easement contain the entire understanding oflhe parties with
respect to the grant of the amended easement rights and supercedes any and all prior
agreements and understandings. No representations, warranties or promises have been
made or relied upon by either party unless expressly stated in this Agreement.
5. PERSONS BOUND. This Agreement shall bind and inure to the benefit of the
parties hereto and there respec..iive successors, heirs, representatives and assigns.
6. MISCELLANEOUS. Time is oflhe essence for this Agreement. This
Agreement is made in Minnesota and shall be governed by its law. Paragraph headings
arc for convenience only and are not intended to explain or res1rict the scope or
substance of the provisions of this Agreement. Wherever used herein, the singular shall
include the plural, the plural shall include the singular, and pronouns shall be read a..q
masculine, feminine or neuter as the context requires. The prevailing party in any
litigatioD, arbitration, or mediation relating to this Agreement shall be entitled to recover
its reasonable attorneys) fees from the other party for all matters, including but not
limited to appeals. Scott County, Minnesota, shall be the proper venue for any litigation,
arbitration or mediation relating to this Agreement.

1. This easement grant includes the right of reasonable access to the Easements and the
right to remove therefrom any structures, trees, sluubbery or other objects or obstroetion.~ which
in Grantees' opinion interferes with their improvements or facilities or the removal of which may
be reasonably necessary tor the construction or maintenance thereof. Grantees' right of access
shall be over only the unimproved portion of adjoining land owned by Graptors, and. Grantees
are obligated to restore any damage to Grantors' adjoining property caused by Grantees' use of
this right of access.
2. This easement grants to Grantees the right to eonstrud such fencing or other barriers
within or on the boundaries of the Drainage and Utility Easement a<; Grantccs may deem
necessary or d~sirable to limit access to the easement area and to protect any improvements or
facilities constructed, placed or installed thereon by Grantees.
3. This easement!,7IaIlt includes the right of Grantees to build a temporary crossing over,
across and through the J-o.:asementc:; to allow Grantors to cross the Easements from their adjoining
land with their livestock and fann equipment. This crossing will be for agricultural use and
pUIposes only. If Grantors sell or convey all or any portion of their land, Grantees, at their
discretion, may remove the crossing from the Easements. Such crossing will be constructed and
installed at Grantees' cost and expeosc. Grantees shall be responsible, at their cost and expense,
tor any repair, maintenance or replacement of the crossing, ~llbject to the provisions of Paragraph
5 below.
4. Grantors reserve the right to enter upon and use the r:.ascments for any purpose;
provided however, Grantors shall not excavate, fill, dump, drain, cultivate or graze livestock
within) modify, damage or othetWise interfere with. the use, operation, repair, maintenance or
replacement of any improvements or facilities constructed, placed or installed within the
r~cments by Grantees, or otherwise interfere with the intended use of the Easements by
Grantees.
5. If the Ea<;ements or any improvements constrocte~ placed or installed within the
Ea.,ements by Grantees are damaged or destroyed by actions of Grantors, or those of the
contractors, agents, en.1ployees or invitegs ofGnmtors, Grantors shall pay to Grantees upon due
demand therefor the reasonable cost incurred by Grantees, or either of them, to reconstroct,

6. Tbis ea<;ement grant is non-exclusive. Grantors may grant additional easements to
others, over, under, ,across and upon the Easements, but any subsequent grant shall not permit a
use or purpose prohibited by Paragraph 4.
7. This easement grant is made subject to all existing easements of record.
8. All improvements and other facilities installed 'upon the Easements by Grantees shall
remain their exclusive property and may be removed at any time and at the sole option of
Grantees.
9. Grantors further covenant to Grantees that they are the owners of the Easements and
have the right to sell and convey these Easements.
10. This Indenture shall bind and inure to the benefit of the parties hereto and their
respective heirs, representatives, successors and assigns.
11. This Amended Dccd of Drainage and Utili1y Easement is given by Grantors and
accepted by Gtantecs in complete substitution for the easement acquired by Grantees pursuant
to a Deed ofDrainage and Utility Easement, dated November 26, 1982, recorded March 5, 1984,

Prior Lake Outlet Channel Improvements/Rehabilitation
DATE: January 25,2005
The Prior Lake-Spring Lake Watershed District applied for a grading permit to correct erosion
issues along a segment of the Prior Lake Outlet Channel within the City of Shakopee. The proposed
rehabilitation project begins at County Road 16 (Eagle Creek Boulevard) and continues 1,500-feet
to the South. The total area proposed to be disturbed is approximately 1.15 acres.
Since the applicant has addressed, or would be required to address prior to grading permit issuance,
all items outlined by the City of Shakopee, a grading permit could be approved. However, if a
grading permit were approved, I suggest the following supplemental conditions be attached to the
permit:
. The applicant shall contact the City of Shakopee engineering department twenty-four (24)
hours in advance of all proposed land disturbing activity.
. The applicant shall contact all adjacent property owners twenty-four (24) hours in advance
of all proposed land disturbing activity.
. All erosion control items shall be furnished and installed by the applicant and accepted by
the City of Shakopee prior to construction. The applicant shall contact the City of Shakopee
engineering department to arrange an inspection.
. All erosion control measures shall be routinely inspected by the applicant and replaced as
necessary or as directed by the City of Shakopee.
. County Road 16 shall be kept free of any offsite sediment tracking. The installation of a
rock construction entrance shall be required.
. The applicant shall maintain dust control operations onsite for the haul/access roads
throughout the grading permit process until final completion.
. The applicant shall place six (6) inches of topsoil over all land disturbed. Exposed soil shall
be seeded and mulched in accordance with NPDES Phase II requirements.
. The applicant shall obtain all necessary Scott County permits prior to any land disturbing
activity.
. The grading permit shall be valid for one (1) year from the date of approval. Once this time
period has expired, the applicant shall be required to apply for a new permit.
. Should the applicant fail to comply with any of these conditions or any other conditions set
forth by the City Code, the City of Shakopee's General Specifications and standard Detail
Plates or the City of Shakopee's Design Criteria, it shall be cause for revocation of the
grading permit.
. The applicant shall provide a copy of the site's NPDES permit.

1. Original copies (2) of the Contractor's certificate of insurance shall be received by the City of
Shakopee prior to any grading ofthe site.
2. Applicant agrees to hold the City of Shakopee harmless for any claims arising out of the City
approving the grading permit prior to Final Plat approval, Final Plat recording and Final
Construction Plan approval.
3. The Applicant shall obtain a NPDES permit. The City of Shakopee shall receive this permit
prior to any land disturbing activity.
4. All erosion control measures shall be furnished and installed by the Applicant and accepted by
the City prior to any land disturbing activity.
5. All erosion control measures shall be routinely inspected by the Applicant and replaced as
necessary or as directed by the City of Shakopee.
6. Erosion control maintenance shall be the responsibility of the Applicant throughout the life of
the grading permit.
7. Adjacent streets shall be kept clean of any offsite sediment tracking.
8. Turf and permanent vegetation shall be established in accordance with the NPDES
requirements.
9. Six (6) inches oftopsoil will be required over disturbed areas not part of building pads. Building
pads not starting immediate construction require four (4) inches of topsoil. All areas not
involving immediate building or construction shall have turf established in accordance with
NPDES requirements. '
10. Final Plans and Reports required upon completion:
. An "as-built" grading plan shall be submitted to the City when the grading work has been
completed. A statement shall be included from the Applicant's engineer that the grading
work is in conformance to the "as-built" plan and specifications. Also, as a part of this plan,
a statement shall be included from the Applicant's surveyor that the high water elevations
around ponds and wetlands are within the existing and/or proposed drainage easements of
the plat. No building permits will be issued until the City Engineer has approved this plan.
Please refer to the City of Shakopee's Design Criteria for as-built grading plan requirements.

tests, summaries of field and laboratory test, other substantiating data and comments on any
changes made during the grading and their effects on the recommendations in the soils

DETAILED PROJECT DESCRIPTION
Background
Phase I of the Outlet and Channel Improvement Project includes about 1,500 feet of the channel
just south of County Road 16 in the City of Shakopee~\Vhicl?-__i-~jdentified as Segment 4B. This
channel segment is experiencing severe erosion due toJivestock encroachment. Cattle currently
have unrestricted access to the channel, which has resulted in significant erosion ofthe channel
banks as well as direct deposition of animal waste into the channel. There is also a need to
stabilize the banks to prevent future erosion due to flow from the Prior Lake outlet and the
watershed directly tributary to the channel.
The proposed construction involves addressing erosion issues and stabilizing the banks of the
channel using the following techniques:
. Install boulders in select locations for grade contr.ol (rock cross veins) and toe protection,
. Meander stream where possible to increase stability,
. Stabilize banks using bioengineering techniques, including root wads, planting live stakes
of willows and dogwoods, and seeding with deep-rooted native grasses, and
e Install fencing and cattle crossing on Segment 4B.
The wetland delineation completed for this segment found wetland conditions below the channel
banks and also along the edge of the channel and County Road 16 on the north edge of the
segment. The District is not planning to complete any work within the wetland at the nOlih edge
of the site, other than to stabilize the site where the road drainage flows into the outlet channel.
Details on the proposed construction activities for Segment 4B are provided in the paragraphs
below.
Construction Details
The construction plans for this segment involve the strategic placement of boulders for toe
protection and grade control along the channel and stabilization of the chamlel banks using
bioengineering techniques. Some earthwork will be required to restore the channel at the south
end of the project area, which has exhibited significant sediment accumulation over the last 20
years, and to re-slope point bars to a slope of 4: 1. Some minimal grading will also be necessary
to install the rock veins, riffles and boulder toe protection identified on the project plans.
Where needed, the restoration will use soil bioengineering techniques to stabilize severely
eroded banks. Soil bioengineering uses dormant live cut branch material and live potted plants
and seeds to establish a deep root mass to stabilize streambanks. All of the potted plants, seed
and plant material will be native to Minnesota. The total quantities of stream bank restoration,
rock and boulder placement, cattle crossing and excavation are as follows:

*Seeding of deep-rooted native species will also occur along entire length of
this stretch of the channel and is not included in the linear feet of shoreline
stabilization above.
An important component of the construction plans for this segment is the construction of a fence
along both sides of the channel to exclude livestock. The landowner has agreed to the fencing
provided that a dry crossing is constructed to allow him to move livestock and farm equipment
from one side of the channel to another. The addition of the livestock exclusion fencing will
improve both the bank stability and the water quality of the channel by preventing bank erosion
caused by the livestock and by preventing the deposition of animal waste into the channel. In
addition, the re-establishment of vegetation along the channel banks will provide a buffer to filter
runoff from the adjacent pasture before it reaches the chamlel, thereby further protecting the
quality of the channel and of downstream resources.
Woodland Management/Tree Removal and Replacement
There are three woodland areas on the proposed project site, as follows:
1. A row of box elder trees growing along the channel banks on the southern third of the
project site (see Plan Sheet 1).
2. A clump of box elder along the channel where it turns to flow north (see Plan Sheet 2)
3. A stand of elm, buckthorn and ash on the northwest corner of the project site (see Plan
Sheet 4).
Some shade reduction/tree removal will be necessary to ensure that there is sufficient light
penetration to allow the soil bioengineering techniques to thrive. Trees will be cut and removed
or used as root wads or brush grid. The PLSL WD plans to remove the stand of box elders
growing along the channel banks on the southern third of the site (Woodland Area 1), and the
trees along the channel identified on Plan Sheet 2 (Woodland Area 2). This tree removal is
necessary to help ensure the success of the bioengineering techniques. A total of35 trees of
diameter six to 10 inches and five trees of diameter greater than 11 inches are proposed to be
removed and re-used as either brush grid or root wads for the bank stabilization/restoration
activities.
The removed trees will be replaced with 1,900 native plant plugs along the edges of the coir fiber
block, 860 native plant plugs in or next to the riffles, and seeding of a sun-tolerant native seed
mix to the edge of the easement area, which is 35 feet centered on the channel. The following
tables provide a species list for the planting and native seeding; this information was excerpted
