Cox, City Clerk Dan Hughes, Chief of Police SUBJECT: Amending Term for Dog Licenses DATE: January 24, 2005 INTRODUCTION: Council is asked to consider adopting the attached ordinance amending the license term for a dog license. BACKGROUND: This is a housekeeping item. At the December 7, 2004 Council meeting the 2005 fee schedule was adopted by City Council. At the recommendation of the Police Department, the license fee for a dog license was increased from $10 for the life of the animal to $20 for a two-year period. This recommendation was based on a comparison to what neighboring communities charge and what the City pays for the services of the City's pound master. A more detailed report is attached. In conjunction with the new fees that have been established, it is also necessary to amend the Dog Regulations and Licensing section of the City Code - Section 10.21, Subd. 5. License Fee and Term. The attached Ordinance No. 719 changes the term of a dog license to two years versus the current term for the life of the animal. The ordinance also clarifies that the fee for a duplicate for a lost tag is adopted by resolution, versus the currently identified fee of $1.00. The 2005 Fee Schedule set this fee at $5.00. All licenses issued prior to January 1,2005 shall be valid for the life of the dog. Council could require new licenses for all dogs and gain additional revenue. Although, staff believes that if the City issued a license for the life of the animal in 2004, it should stay with that commitment. New dog tags have been purchased for "2005-2006" and the new fee was implemented the first of the year. RECOMMENDED ACTION: Offer Ordinance No. 719, Fourth Series, An Ordinance of the City of Shako pee, Minnesota, Amending City Code Chapter 10, Section 10.21, Dog, Cat and Domestic Animal Regulation and Licensing, and move its adoption. CITY OF SHAKOPEE MEMO POLICE DEPARTMENT DATE: December 16, 2004 TO: Mark McNeill, City Administrator FROM: Dan Hughes, Chief of Police SUBJECT: Fee Ordinance Thank you for allowing our staff the opportunity to provide the information that led to our recommendation to raise the licensing fee for dogs from $10 for the life of the dog, to $20 for a two year period. License and user fees are generally set to provide the service so that the general taxpayer is not unduly burdened for these services. In 2003 the City received revenue of$I,240.00 from 124 dog licenses issued. The cost to provide animal control in 2003 was $10,500. The fee was last raised from $5 to $10 in 1995. This year Police Department staff reviewed the existing fee schedule and performed a market analysis with other cities. We researched many of the fees, including dog licenses. Based upon our limited evaluation it would appear that no city that we surveyed issues dog licenses for the life of the animal. The following cities were surveyed: 1. City of Prior Lake issues a two-year dog license for a fee of $20.00. 2. City of Savage issues a one-year dog license for a fee of $10.00. 3. City ofChaska issues a one-year dog license for a fee of$18.00, or two years for $30.00. 4. City ofBumsville issues a two-year dog license for a fee of$30.00 or $20.00 for an animal that is spayed/neutered. Based upon our analysis, we recommended that the license fee be raised to $20 for every two years, consistent with the survey and market analysis that was done. A two-year license cycle will also promote current rabies inoculations and owner information. Police department staff will be working with the City Clerk's office to implement this process in early 2005. DH:pm ORDINANCE NO. 719, FOURTH SERIES AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA, AMENDING CITY CODE CHAPTER 10 SECTION 10.21, DOG, CAT AND DOMESTIC ANIMAL REGULATION AND LICENSING THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS: Section 1 - City Code Chapter 10, Public Protection, Crimes and Offenses, Section 10.21, Subdivision 5 is hereby amended to read as follows: Sec. 10.21 Dog, Cat and Domestic Animal Regulation and Licensing Subd. 5. Licensee Fee and Term. All fees for the licensing and impounding of dogs and cats shall be fixed and determined by the Council, adopted by resolution, and uniformly enforced. Such fees may from time to time be amended by the Council by resolution. A copy of the resolution setting forth currently effective fees shall be kept on file in the office of the City clerk and open to inspection during regular business hours. Such license shall continue in force for the life of the dog, provided that the O'.vner give notification of any change in address. be issued for two years beginning January 1, 2005. Any license issued prior to January 1,2005 shall be valid for the life of the dog. Section. 2 - City Code Chapter 10, Public Protection, Crimes and Offenses, Section 10.21, Subdivision 6 is hereby amended to read as follows: Subd. 6. Tag Required. All licensed dogs shall wear a collar and have a tag firmly affixed thereto evidencing such license and vaccination. A duplicate for a lost tag may be issued by the City.upon payment of the fee of$I.00 as determined by the Council, adopted by resolution, for issuance of the duplicate. Section 3 - Effective Date. This ordinance becomes effective from and after its passage and publication. Adopted in regular session of the City Council of the City of Shakopee, Minnesota, held this 1 st day of February, 2005.
