Motion Type: Informational only Background: General Fund - April 2025 (see attachment) 5.a This early in the year, the timing of one of two large receipts or payments tend to skew the variances. Revenue variances (33% target) • Taxes will remain below budget targets until the 1st half settlement is received in June. • Licenses and permits are tracking ahead of budget targets and the previous year, primarily from building permits, as the City continues to see growth. • Charges for services are tracking ahead of budget targets, primarily from engineering fees and April's SandVenture sales promotion. • Miscellaneous includes interest earnings on investments, which are tracking ahead of budget targets. Expenditure variances (33% target) • Total departmental expenditures are within the normal range and similar to last year's percentage through April. • Mayor and Council expenditures are currently exceeding budget targets as a result of the timing of annual dues (paid at the beginning of the year). While this is routine action, the League specifically requires council action. The city's past practice has been not to waive the limits. Assuming the council does not waive the limit, there would be a liability limit of $500,000 for a single claimant and $1,500,000 for all claimants for a single occurrence. Recommendation: Approve Resolution R2025-057 Budget Impact: If the council chooses not to waive coverage, there is no financial impact. However, if it does waive coverage limits, there would be an additional cost for increased insurance premiums. Attachments: R2025-057 Statutory Insurance Limits.pdf Liability-Coverage-Waiver-Form.pdf 6 RESOLUTION R2025-057 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA REGARDING MAKING A SELECTION NOT TO WAIVE THE STATUATORY LIMITS FOR LIABILITY INSURANCE PURPOSES WHEREAS, Minnesota Statutes 466.04 has established tort liability for municipalities; and WHEREAS, the League of Minnesota Cities Insurance Trust has asked the City to make an election with regard to waiving or not waiving its tort liability; and WHEREAS, the choices available are as follows: to not waive the statutory municipal liability tort limit; or to waive the tort monetary limit to the limit of liability insurance coverage obtained from the LMCIT; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA AS FOLLOWS: that the City Council does hereby elect not to waive the statutory tort liability established by Minnesota Statutes 466.04. Email completed form to your city's underwriter, to pstech(&,,lmc.org, or fax to 651.281.1298. The decision to waive or not waive the statutory tort limits must be made annually by the member's governing body, in consultation with its attorney if necessary. Members who obtain liability coverage from LMCIT must decide whether to waive the statutory tort liability limits to the extent of the coverage purchased. The decision has the following effects: • If the member does not waive the statutory tort limits, an individual claimant could recover no more than $500,000 on any claim to which the statutory tort limits apply. The total all claimants could recover for a single occurrence to which the statutory tort limits apply would be limited to $1,500,000. These statutory tort limits would apply regardless of whether the member purchases the optional LMCIT excess liability coverage. • If the member waives the statutory tort limits and does not purchase excess liability coverage, a single claimant could recover up to $2,000,000 for a single occurrence (under the waive option, the tort cap liability limits are only waived to the extent of the member's liability coverage limits, and the LMCIT per occurrence limit is $2,000,000). The total all claimants could recover for a single occurrence to which the statutory tort limits apply would also be limited to $2,000,000, regardless of the number of claimants. • If the member waives the statutory tort limits and purchases excess liability coverage, a single claimant could potentially recover an amount up to the limit of the coverage purchased. The total all claimants could recover for a single occurrence to which the statutory tort limits apply would also be limited to the amount of coverage purchased, regardless of the number of claimants. Claims to which the statutory municipal tort limits do not apply are not affected by this decision. Attachments: 9 Shakopee City Council 5.d OPEE May 20, 2025 Agenda Item: Minnesota Department of Transportation Safe Routes to School Infrastructure Grant Awards Prepared by: Andrea Harrell, Grants and Special Projects Coordinator Reviewed by: Chelsea Petersen, Assistant City Administrator Action to be considered: Adopt Resolution R2025-060, accepting Minnesota Department of Transportation's (MnDoT) Safe Routes to School (SRTS) Infrastructure grant awards and authorizing the City Administrator to execute the necessary contracts and agreements applicable to accepting these awards. Motion Type: Simple Majority Background: At its January 7, 2024 meeting, Council approved the application to the MnDoT SRTS Infrastructure grant. The SRTS Infrastructure grant is providing funding to construct pedestrian infrastructure improvements, including enhanced pedestrian crossings, median refuge islands, trails, sidewalks, and geometric roadway modifications with construction to be completed in 2026. These improvements will occur on Adams St. and Fuller St., improving safety for Sweeney Elementary, Sun Path Elementary, and Shakopee High Schools. Recommendation: Adopt Resolution R2025-060. Budget Impact: A 0% match is required, however, the City must fund the engineering, right of way, inspection, and other non-SRTS eligible costs, as well as SRTS eligible items in excess of the SRTS Infrastructure grant award of $272,000. These costs are being requested in the 2026-2030 Capital Improvement Plan and will be paid for via the Capital Improvement Fund. The policy prescribes that the television inspection of sanitary sewer mains occurs every ten years. In accordance with this policy, 106,850 feet of sanitary sewer pipe has been identified to be televised in 2025 (see attached Sanitary Sewer map). In addition, as part of the city's evaluation of utilities that fall within subsequent years' pavement rehabilitation projects, 8,737 feet of storm sewer will be televised (see attached Storm Sewer map). List project and work. 2) The policy shall be a standard foini policy provided for by a carrier approved by the State of Minnesota and shall not contain any exclusions that will restrict coverage on any operations performed by this Contractor or any Subcontractor thereof. 3) The policy or policies shall afford Contractual Liability coverage to provide coverage for the Indemnification Agreement set out in Section 2.E. 4) It is a condition of the Contract that the policy or policies waive any or all governmental immunity as a defense in any action brought against the insured or any other party to the Contract, up to policy limits. City of Shakopee — Contract Stagecoach ID131 Control Panel Replacement April 2025 GC -Page 2 of 7 42 5) The policy shall further provide insurance to cover all of the Contractor's operating exposures and the operation of vehicles. 6) Approval of the insurance by the City shall not in any way relieve or decrease the liability of the Contractor hereunder, and it is expressly understood that the City or the Engineer does not in any way represent that the above specified insurance or limits of liability are sufficient or adequate to protect the Contractor's interest or liabilities. 7) In the event of cancellation of any of the policies, the company issuing the Certificate of Insurance shall provide 30 days written notice to the City. Failure to do so shall impose obligation and/or liability upon the issuing company. Certificate of Insurance forms shall be drafted or altered to reflect these conditions. B. Notice of Cancellation or Non -Renewal The City shall be given at least thirty (30) days prior written notice of any cancellation, termination or material modification of the required insurance coverages, and the insurance policies required herein shall so provide. C. Deductibles All responsibility for payment of sums resulting from any deductible provision, corridor, or self - insured retention conditions of the policy or policies shall remain with the Contractor. D. Indemnification The Contractor shall indemnify and hold harmless the City, its elected officials, commissioners either elected or appointed, officers, agents and/or employees from and against all claims, damages, losses or expenses, including attorney fees, for which they may be held liable, arising out of or resulting from the assertion against them of any claims, debts or obligations resulting from or arising out of directly or indirectly, the performance of this Agreement by the Contractor, their employees, agents or subcontractors. 3. WORK COMPLETION, SUSPENSION & RESUMPTION STIPULATIONS A. COMPLETION The Contractor will be required to begin work within ten (10) days of Notice to Proceed and is to complete the installation on or before the completion date specified in the Special Provisions or the Proposal Form for the project. B. SUSPENSION AND RESUMPTION OF WORK The Engineer shall have the authority to suspend the Contractor's operations wholly or in part, for such period or periods of time as may deem necessary because of unsuitable weather or other conditions that the Engineer considers unfavorable for the prosecution of the work, or for such time as is necessary due to the failure on the part of the Contractor to carry out orders given or perform any or all of the provisions of the contract. Such "Suspension of Work Order" shall be in writing, and shall state the reason for such suspension, the effective date and time, and the operation suspended. All work done by the Contractor contrary to such "Suspension of Work Order" shall be considered as unauthorized work and as having been done at the expense of the Contractor. MEASUREMENT OF QUANTITIES Work completed in an acceptable form as determined by the Engineer shall be measured by the units specified in the Proposal Form or otherwise described in the Special Provisions. B. PAYMENT Payment at the unit price provided in the Proposal Form shall be full compensation for all labor, materials, coordination and equipment necessary to furnish and install the item, unless otherwise specified in the Special Provisions. Final payment shall not act as a waiver of the right of the Owner to require fulfillment of all terms of the Contract. 5. CONTROL OF WORK AND MATERIALS A. HOURS OF OPERATION 1. No construction equipment shall be operated between 7:00 P.M. and 7:00 A.M. weekdays unless specifically authorized by the Engineer. 2. No work shall be done on Saturdays or Sundays unless special approval is granted by the Engineer. If authorized, working hours on weekends are 9:00 A.M. to 9:00 P.M. 3. The Contractor shall notify the Owner in advance of all times when staff are to work on the construction site. 4. Should work by the Owner or other special conditions require temporary suspension of the Contractor's activities, the Contractor shall comply and reschedule the work at no additional cost to the Owner. B. OWNER REPRESENTATIVE'S STATUS AND DECISIONS In carrying out any of the provisions of the contract, or in exercising any power or authority granted to the Contractor thereby, there shall be no personal liability upon the contracting officer or the authorized representatives, it being understood that in such matter they act as agents and representatives of the Owner. The Engineer shall have general supervision and direction of the work. The Engineer has authority to stop the work whenever such stoppage may be necessary to ensure the proper execution of the work. The Engineer shall also have the right, as the work progresses, to alter the plans or specified coordination of two or more concurrent contractors subject to the limits specified herein. C. CONTROL OF MATERIALS All materials furnished by the Contractor shall meet the requirements of these specifications. 1 INSPECTION AND ACCEPTANCE OF MATERIALS: Final inspection and acceptance of material will be made only at the site of the work. The Owner reserves the right to sample, inspect, and test materials throughout the duration of the work, and to reject any materials that are found to be unsatisfactory at the time of use. 2 DEFECTIVE MATERIAL: All materials that do not conform to the requirements of these City of Shakopee— Contract Stagecoach ID131 Control Panel Replacement April 2025 GC -Page 4 of 7 44 specifications shall be considered defective and will not be approved. All defective material must be removed from the construction area. Any portion of the work in which any defective material may have been used shall be considered as defective work. 3 DEFECTIVE WORK: All work and materials that do not conform to the requirements of the contract shall be considered as defective and will not be approved. When so ordered by the Engineer in writing, all defective work shall be remedied or repaired, or, if necessary, removed and replaced in an acceptable manner by the Contractor. If the Contractor fails or refuses to remedy or repair any defective work or materials or to remove and replace such work or materials, within the period specified in such written order, the Owner shall have the right, at its option: a) To take over and use such defective work by payment to the Contractor of an amount equal to the reasonable value of such work; or b) to cause such defective work to be remedied or repaired, or removed and replaced, and deduct the cost thereof from any monies due or that may become due the Contractor or require reimbursement therefore from the surety of the contract bond. When such defective work has been remedied or repaired, or removed and replaced by the Contractor, the Contractor will be credited with an amount equal to the value of the completed work based on the contract price or price therefore. If the Contractor continues to perform defective work, the City may declare the Contractor in default. D. PROSECUTION OF WORK NEAR PUBLIC UTILITIES PROPERTIES It shall be the Contractor's responsibility to obtain complete information of the existence and location of underground utilities that may be adjacent to the work. The Contractor shall be responsible for and shall preserve and protect all utilities that are above ground surface and below ground surface whether or not the approximate locations are shown in the plans. The Contractor shall assume full responsibility for reimbursing the owners thereof for any damage or injury to such utilities that may be caused by his/her operations. The Contractor shall at no time hinder or interfere with any person engaged in protecting or moving utility properties or in the operation of the utility. The Contractor shall give notice to the owners of all utilities at least 48 hours before starting any construction operations that will affect such properties. If, during the course of the Contractor's operations, he/she discovers utility properties, the existence of which was not known, the Contractor shall immediately notify the owner thereof and the Engineer. E. PROTECTION OF THE PUBLIC, THE WORK AND PROPERTY The Contractor shall operate in a safe and non -hazardous fashion, maintaining full compliance with OSHA standards and good work standards, complying with all the Federal, State and Municipal laws. The Contractor shall continuously maintain adequate protection of all work from damage, and take all reasonable precautions to protect the Owner's property from injury or loss arising in connection with this project. The Contractor shall make good any damage, injury or loss to his work or to the property of the Owner that results from lack of reasonable protective precautions, except such as may be caused by agents or employees of the Owner. The Contractor shall make City of Shakopee— Contract Stagecoach ID131 Control Panel Replacement April 2025 GC -Page 5 of 7 45 adequate provisions to protect adjacent private and public property. The Contractor shall assume, and shall be held liable for necessary equipment and personnel required to conform to these specifications. All cost related to protection of the public, the work and property shall be borne by the Contractor. The Contractor shall erect and maintain all signs and barricades required to conform with the Minnesota Manual on Uniform Traffic Control Devices (MMUTCD) prior to commencing any work within public streets, sidewalks, easements or right-of-way. The Contractor shall be responsible for installing adequate traffic control and safety devices to protect the public, including pedestrians and vehicular traffic. The Engineer shall have the authority to stop any work until the Contractor brings signing and barricades into conformance with MMUTCD. If the Contractor fails to act in a timely fashion to bring signing and barricades into conformance with MMUTCD or if emergency conditions require immediate action, the Engineer can install proper signing and barricades and charge the cost of such work to the Contractor. F. PROTECTION AND RESTORATION OF PROPERTY The Contractor shall not enter upon private property for any propose without obtaining permission. The Contractor shall notify, in writing, the owners of all corporate or private property that will be interfered with by the operations, advising them of the nature of the interference, and arranging with them for the protection of such property. The Contractor shall furnish the Engineer, upon request, with copies of all such notifications and final agreements. The Contractor shall protect and carefully preserve all property monuments until the Owner, or an authorized surveyor or agent, has witnessed or otherwise referenced their location or relocation. The Contractor shall be responsible for any damage occasioned by or resulting from the operations, work or materials to property of any kind outside the construction area, or within the construction area and below the ground surface if such property is shown in the plans, or its existence is indicated in the Special Provisions. The Contractor shall also be responsible for any damage, occasioned by or resulting from the operations, to property of any kind within the construction area and below ground surface, the existence of which is not shown in the Plans or indicated in the Special Provisions, provided the Contractor is notified of its existence before such damage is done. If such property is damaged or destroyed by the Contractor's operations, work, or materials, the Contractor shall, at the Contractor's own expense, restore such property to a condition equal to or better than that existing before such damage or injury was done by repairing, rebuilding, or replacing it as may be directed, or shall otherwise make good such damage or destruction in an acceptable manner. G. WARRANTY/GUARANTEE Any defective materials, workmanship or equipment shall be corrected by the Contractor, at no cost to the Owner, for a period of two years after date of acceptance of the project. If, in the opinion of the Engineer, it is not expedient to correct injured work, or work not done in accordance with the contract, the Owner may deduct the difference in value between the work involved and that called for by the contract, together with fair allowance for damages, the amount of which shall be determined by the Engineer. The Contractor shall be responsible for any and all defects that may develop in any part of the City of Shakopee— Contract Stagecoach ID131 Control Panel Replacement April 2025 GC -Page 6 of 7 46 entire installation furnished by the Contractor and upon receipt of written notice from the Engineer, shall immediately replace and make good without expense to the Owner such faulty part or parts, including damage resulting from same, during a period of two (2) years from the date of final acceptance of the installation, except when specific warranty and guarantee for work and materials for another length of time is elsewhere specified. The acceptance of the installation, or any part of it, shall not act to waive the liability on the part of the Contractor and the Contractors surety. H. REMOVAL AND DISPOSAL Items removed by the Contractor shall be disposed of outside of the City of Shakopee and in compliance with all Federal, State, and Local regulations, laws, codes and requirements. Removal items shall become the property of the Contractor unless specifically identified for salvage in the Special Provisions. I. SUBCONTRACTOR The Contractor shall be as fully responsible to the City for the acts and omissions of its subcontractors, and of persons either directly or indirectly employed by them, as Contractor is for the acts and omissions of persons it directly employs. Contractor shall cause appropriate provisions to be inserted in all subcontracts relating to this work, to bind all subcontractors to Contactor by all the terms herein set forth, insofar as applicable to the work of subcontractors and to give Contractor the same power regarding termination of any subcontract as the City may exercise over Contractor under any provisions of the contract. Nothing contained in the Contract shall create any contractual relation between the subcontractor and the city or between any subcontractors. The Contractor shall pay any subcontractor within ten (10) days of receipt of payment from the city for undisputed services provided by the subcontractor. If the Contractor fails to pay within ten (10) days, the Contractor shall pay the subcontractor interest at the rate of one and one-half percent per month or part of month to the subcontractor on any undisputed amount not paid on time to the subcontractor, in accordance with Minn. Motion Type: Simple Majority 8.a Background: Summergate Development, LLC, applicant and property owner, have proposed the Final Plat subdivision of Bluff View, located north of LaTour Avenue (adjacent to the SPU water tower in the Windermere neighborhood) and generally west of existing Zumbro Avenue. The applicant has proposed the first phase of their single-family residential subdivision of 131 lots on approximately 47 acres. The development would include lots with varying widths, consistent with the approved PUD Amendment (approved March 4, 2025). A stipulation of that approved PUD was that the applicant provide a minimum of fifteen percent open space as landscaped area or areas available for the common use of and accessible by all residents or occupants of the buildings within the planned unit development. That condition is being met with the dedication of Outlot A to the city with this phase, and portions of Outlot B with the future 2nd phase of this project. These open spaces/trails will generally be adjacent to the bluff which has been earmarked as a future lineal park and trail corridor as part of the regional trail and park system presently being implemented in this area of the community. The property is guided Suburban Residential (3-6 units/acre) and Park & Open Space. The proposed project is consistent with the existing guiding. This site was also included in the approved Western Shakopee Areawide AUAR, and this proposal is generally consistent with that AUAR. The Final Plat approval includes conditions on sewer, water, and roadway being extended from the adjacent property to the east (Palomino Trail). There has been significant discussion on the extension of services and 17th Avenue to CR 69 with the City, County, and the developers along this corridor and construction of street and utilities have been 62 defined and will be built out consistent with City and County requirements. City departments, Scott County and other outside agencies were given the opportunity to review and provide comments regarding this application. SPU staff have provided comments which include that the applicant shall work with them to connect to the existing water and electric utilities to provide comprehensive services to this property and adjacent properties. City Engineering has provided a memo and redlined markups to the plan set with comments and conditions of approval, specifically noting necessary phasing and securities tied to the extension of CSAH 16/17th Avenue and the sanitary sewer system. Recommendation: City Council has previously approved the preliminary plat of Bluff View. Nothing has changed from the preliminary plat. Approval of title by the City Attorney. B. Park dedication fees in the amount required by the City Code and adopted City fee schedule shall be paid prior to the recording of the final plat. C. Tree removal and new landscaping shall occur consistent with City Code Sections 151.112 (Landscape Requirements) and 151.113 (Tree Preservation Requirements). D. Site development shall comply with the conditions noted in the City Engineering memo dated May 6, 2025 (including compliance with red -lined comments). E. Final Plat approval is contingent upon sanitary sewer, water, and the street being extended to the property from the adjacent parcel to the east. F. Provide funds for and/or construct 17t11 Avenue (CSAH 16) and associated improvements located within this plat, consistent with the language included in City Engineering's requirements. 1 of 3 64 G. The developer shall work with the City and Scott County on the final design of the walk/trail connections at the Zumbro Avenue/17th Avenue intersection. H. Construction and development of lots shall comply with the design standards of City Code Section 151.034 (Urban Residential Zone), except as specifically approved by the amended PUD. I. Revise street names to be consistent with city staff recommendations. J. Comply with SPU standard terms and conditions, which include the following: 1. Revise construction plan set to address redline comments. 2. Connect to the existing water and electric utilities to provide comprehensive services to this property and adjacent properties. 3. The developer will be required to pay Trunk Water Charge to SPU for net developable acreage. 4. SPU will pay the developer trunk oversizing where SPU requests pipes larger than required to meet the lateral requirements per SPU Water Policy Manual. 5. Complete construction plans need to be developed with plan & profiles that meet all SPU requirements per the SPU Water Policy Manual. 6. Additional comments to be provided when complete plans are submitted. 7. SPU is in need of a future well site and will contact the developer to negotiate purchase of lot(s). 8. Additional raw watermain may be necessary depending on the potential well siting. K. Fire hydrants shall be placed in accordance with local requirements and the Minnesota State Fire Code. L. A temporary cul-de-sac is required for all street stubs that serve three (3) lots or more, which includes the north end of LaTour Drive and the west end of Street 5. Submit an agreement to remove and restore the temporary cul-de-sac's when future development occurs. Provide a detailed cost estimate for the removal and restoration of the temporary cul-de-sac along with an escrow in that amount. M. Submit standalone trail easements for trails not located on City property. See Section 10.1.G of the City Design Criteria (3 ft on each side). N. Provide funds for and/or construct a trail along the property frontage on 17th Avenue (CSAH 16), and construct additional walks and trails consistent with City and County requirements. O. The Developer's Agreement will include the following provision: The Developer shall construct CR 16 from the west plat boundary to the east plat boundary with the first phase final plat. The Developer shall submit a security for the entire roadway construction prior to recording the first phase final plat. County Road 16 may be constructed in phases but must be constructed in its entirety within the plat (extending to the west plat boundary) no later than December 31, 2026, excluding construction of the final wearing course of pavement. The final wearing course must be constructed by June 30, 2027. The Developer is eligible for reimbursement from Scott County for constructing County Road 16 above the City's standard collector roadway design. The City will provide reimbursement to the Developer for Scott County's share of the County Road 16 2 of 3 65 construction, to be determine by the County. Prior to reimbursement, the City and County must enter into a Cooperative Agreement establishing the reimbursement amounts and schedules. Bluff View is located south of TH 169, east of County Road 69 (Old Brick Yard Road) and west of County Road 15 (Marystown Road). This review should be considered preliminary, as more comments will follow with additional submittals. However, the Engineering Department offers the following comments at this time to the applicant and to the planning department: The following items need to be addressed/completed prior to release of the Final Plat for recording: 1. Plan review and plat review redlined comments are attached to this memo and must be addressed and approved by the City Engineer. 2. Refer to Shakopee Public Utilities comments for watermain. 3. Conduct a title search to confirm other interests on the property. 4. The project plans must incorporate the design and construction of a trail along the bluff that connects to the proposed trail segment associated with the Palomino Trail development, located to the northeast of the project site (refer to redlines on the provided plans). No grading shall be allowed within the bluff limits. 5. Easements will be shown on the Final Plat as approved by the City Engineer. They include, but are not limited to the following: • Verify appropriate drainage and utility easements for public sanitary sewer, storm sewer and watermain systems are provided. The minimum widths of drainage and utility easements are set forth in Section 10.1.A -D of the City of Shakopee Design Criteria. Execution of a Developer's Agreement, which needs to include provisions for a letter of credit or cash security equal to 125 percent of the estimated total cost of the improvements, plus 100 percent of the estimated costs of city inspection and administration. 8. Pay all applicable fees/charges listed below, as required by the most current City of Shakopee Fee Schedule. • Street and Utility Fee • Watermain Fee • Trunk Storm Water Charge • Trunk Sanitary Sewer Charge • Sign Installation Fee • Bituminous Sealcoat Fee • Storm Water Management Plan Review Fees 9. At a minimum, obtain conditional approval of the development's storm water management plan. 10. Prior to discharging into a storm water basin, pretreatment must be provided. 11. The maximum allowable sanitary sewer depth is thirty (30) feet. 12. Submit temporary turnaround removal and restoration agreement with a $10,000 cash escrow per temporary turnaround. 13. Submit retaining wall encroachment agreement for any private retaining wall that encroaches on City property. 14. 17th Avenue shall be designed as a collector street and to State Aid and Scott County standards. 15. Plans must be provided to Scott County for review and any conditions imposed by the county must be adhered to by the applicant. 16. Outlots A and D shall be deeded to the City of Shakopee. The 18 -inch trunk sanitary sewer must be extended to the southern end of Outlot B by September 1, 2026. Approval of the final plat does not constitute approval of the submitted construction plans. 19. Provide electronic files (AutoCAD and Portable Document Format — PDF) of the Final Plat to be recorded with datum on the Scott County coordinate system. The following items need to be addressed/completed prior to approval of a grading permit, a street and utility plan and/or a building permit: 20. Submit temporary construction easement for grading on Shakopee Public Utilities property. 21. Submit temporary construction easement for grading on Bauer II Family LLLP's property. 22. Submit temporary Drainage and Utility Easements for storm sewer located within the future phase (see redlined plans for specific location). 23. Submit a 10 -foot temporary Drainage and Utility Easements for Outlot B adjacent to Tamarack Road. 24. Submit a 10 -foot temporary Drainage and Utility Easements for Outlot E adjacent to Redtail Drive. 25. Retaining walls four feet or higher require a building permit. 26. Retaining walls crossing multiple properties shall either: • Establish a Homeowners' Association (HOA) responsible for wall maintenance and future replacement, or • Submit a recorded Declaration of Retaining Wall Easement Agreement. 27. Sand shall not be mined from infiltration basins. 28. Obtain final approval of the subdivision's storm water management plan. 29. Obtain a NPDES construction site permit prior to any land disturbing activity. A copy of the permit must be provided to the city. 30. Pay all applicable fees and submit security for grading permit as required by the most current City of Shakopee Fee Schedule. Grade the entire site, as proposed on the approved plans, in one phase within one year from the date of approval of the grading permit application. Grading is defined as bringing the site to the proposed finished grade with materials deemed acceptable by the City of Shakopee engineering department, providing topsoil per City requirements and applying seed, mulch and/or sod per City requirements and providing an as -built record grading plan per Section 2.5 of the City of Shakopee Design Criteria. 32. Submit detailed pavement design calculations. 33. Submit a small utilities joint trench design and detail (Shakopee Detail 5009). 34. The contractor must submit a Construction Management Plan to the city prior to any construction activities. 35. Record plans need to be provided per the City of Shakopee Design Criteria, Section 2.5 and Section 11.2 (A -L). The record plans need to be certified and submitted to the engineering department. Provide a letter from the engineer of record certifying that all improvements were constructed per approved plans and under the direct supervision of the engineer of record.
