DISCUSSION
Centex Homes has submitted an application for preliminary plat approval of Park Meadows East,
proposed for the northwest comer of County State Aid Highway (CSAR) 83 and Valley View Road
(Exhibit A). The plat, as currently proposed, contemplates the construction of 92 single family homes
(Exhibit B).
PLANNING COMMISSION RECOMMENDATION
At its February 3, 2005 meeting, the Planning Commission recommended approval ofthe Preliminary Platto
the City Council by a 7-0 vote, subject to the conditions listed in the draft resolution. The Commission took
comments from an adjoining property owner and had extensive discussions on storm water issues, sanitary
sewer service connections, and street connections. A copy of the report to the Planning Commission has been
attached for the Council's reference.
Staff has received a letter from an adjoining property owner, requesting that the Council table any action on
this item to the March 15, 2005 meeting, at which time that property owner would be available to attend the
meeting and provide comments.

RESOLUTION NO. 6184
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE
PRELIMINARY PLAT OF PARK MEADOWS EAST
WHEREAS, Centex Homes, applicant and Tom Deutsch, property owner, have made
application for preliminary plat approval of Park Meadows East; and
WHEREAS, the subject properties are legally described as:
The Southeast Quarter ofthe Southwest Quarter, Section 16, Township 115 North, Range 22 West,
Scott County, Minnesota, excepting that part of the abandoned right-of-way of the Chicago,
Milwaukee, St. Paul and Pacific Railroad Company, the centerline of said right-of-way as shown on
survey of Railroad Tracks, by the Scott County Surveyor and Recorded as Document No. 178639,
AND
That part ofthe abandoned right-of-way ofthe Chicago, Milwaukee, St. Paul and Pacific Railroad
Company, the centerline of said right-of-way as shown on survey of Railroad Tracks, by the Scott
County Surveyor and Recorded as Document No. 178639, located in the Southeast Quarter of the
Southwest Quarter, Section 16, Township 115 North, Range 22 West, Scott County, Minnesota; and
WHEREAS, the Shakopee Planning Commission conducted public hearings on the
preliminary plat on January 6 and February 3,2005; and
WHEREAS, all required public notices regarding the public hearing were posted and sent;
and
WHEREAS, the Shakopee Planning Commission has recommended approval of the
requested preliminary plat; and
WHEREAS, the City Council reviewed the preliminary plat request at its meeting of
February 15, 2005.
NOW, THEREFORE, BElT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA, THAT THE PRELIMINARY PLAT FOR PARK
MEADOWS EAST IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS:
I. The following procedural actions must be completed prior to the review of the
Final Plat:
A. The City has plans for a right turn lane and bypass lane on CSAH 83 at the
intersection with Valley View Road. However, with develqpmentplans on
the east side of CSAH 83, it is recommended that a center left turn lane is
installed instead of a bypass lane.
B. The existing plans identify a connection to a trunk sanitary sewer on CSAH
83. Only those lots with flow to the existing sanitary sewer to the west can be
final platted. The lots that will have sanitary sewer service to the future trunk
sanitary sewer along CSAH 83 cannot be final platted until a contract has
been awarded for the construction ofthe trunk line, or until plans and a
maintenance agreement for a sanitary lift station have been approved by the
City.
C. The minimum right-of-way dedication for CSAH 83 shall be 60 feet from
centerline.
D. The applicant shall work with City staff to provide Right of Way for the
access to the north, consistent with the Design Criteria and Standard
Specifications of the City of Shakopee.
II. The following procedural actions must be completed prior to the recording of
the Final Plat:
A. Approval of title by the City Attorney.
B. Execution of a Developers Agreement, which shall include provisions for
security for public improvements within the Final Plat, as well as payment of
engineering review fees, and any other fees as required by the City's adopted
fee schedule.
1. Street lighting to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
2. Electrical system to be installed in accordance with the requirements
of the Shakopee Public Utilities Commission.
3. Water system to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
4. Installation of sanitary sewer and storm sewer systems, and
construction of streets in accordance with the requirements of the
Design Criteria and Standard Specifications of the City of Shakopee.
5. The developer shall be responsible for payment of Trunk Storm Water
Charges, Trunk Storm Water Storage and Treatment Charges, and
Trunk Sanitary Sewer Charges, as required by the most current City of
Shakopee Fee Schedule.
6. No public improvements shall be constructed until the City Engineer
and the Shakopee Public Utility Commission approve the Final
Construction Plans and Specifications.
7. The applicant shall obtain an NPDES permit prior to any land
disturbing activity. A copy of this permit shall be forwarded to the
City.
8. The applicant shall work with City staff to provide a future sanitary
sewer trunk extension.
9. A storm water infiltration system design providing pretreatment of
storm water runoff prior to infiltration shall be submitted to the City
for review and approval.
10. The applicant shall obtain all necessary right-of-way and/or easements
to perform work offsite.
11. The applicant shall obtain the necessary Scott County
permits/approvals (right-of-way, drainage, etc.).
12. Adequate drainage and utility easements shall be provided along the
top and the bottom of all proposed retaining walls.
13. The applicant shall work with the City and the City's consultant to
Goordinate th~ s!tnultaneous construction of Park Meadows East and
Valley View Road.
14. This development is adjacent to Valley View Road and should be
required to sign a waiver of assessment appeal for the Valley View
Road improvements.
15. That the applicant meet park dedication requirement by providing cash
in lieu of land dedication.
16. Sidewalks and trails shall be provided throughout the site as proposed.
17. The applicant shall meet park dedication requirement by providing
cash in lieu of land dedication.
18. Park dedication fees in the amount required by the City Code and
adopted City fee schedule shall be paid prior to the recording of the
final plat. If any portion of the property is being platted as outlots to
accommodate a phased development, the park dedication fees for each
future phase shall be based on the fees in effect at the time of final plat
approval for those outlots and shall be paid before the final plat for
those outlots is recorded.
19. Street names and addresses shall be provided to the Shakopee Fire
Inspector for review and approval.
C. Temporary street signs shall be provided until such time that permanent street
signs are installed.
D. Provide electronic (Auto CAD) files ofthe Final Plat to the City Engineering
Department.
E. The applicant shall modify all preliminary street profiles not in compliance
with the City's minimum design speeds.
F. Easements must be shown on the Final Plat as approved by the City Engineer.
G. Minimum drainage and utility easements for sanitary sewer and storm sewer
in non-paved areas shall be provided at a one to one ratio, depth versus width.
The easements shall be centered along the utility alignment.
H. The applicant shall provide adequate easement for the drainageswale on Lots
5 and 6, Block 3, or modify the grading plan to drain inside the easement at
the lot lines.
1. The applicant shall provide adequate easement for the drainage swale on Lots
27 and 28, Block 1, or modify the grading plan to drain inside the easement.
J. The plat shall show all easements on all lots.
K. The survey data (length and bearings) shall be shown for each lot as well as
the plat boundary and center line of streets.
L. Simultaneous to the recording of the Final Plat, a deed restriction shall be
recorded on all lots with sanitary sewer, storm sewer and/or watermain
running along a property line and/or through a lot. The Deed Restriction shall
appear as the following:
This conveyance is made conditioned upon and subject to the following
restriction. The Grantee, heirs, successors and assigns, are restricted from
erecting any fence or other structure within the utility and drainage easements
dedicated by plat over the above-described property, except with the prior
written consent of the City of Shako pee. This restriction shall run in favor of
and be enforceable by the City of Shako pee.
M. The applicant shall provide the required documentation and/or drawings that
address, to the City's satisfaction, all storm water comments noted in the
January 21, 2005 letter from Todd Hubmer, WSB & Associates, Inc.
III. Following approval and recording of the final plat, the following conditions shall
apply;
A. Building construction, sewer, water service, fire protection and access will be
reviewed for code compliance at the time of building permit application(s).
B. Noise issues along the County roadways may arise as traffic levels increase in
the area. The developer and/or their assigns shall be responsible for any
required or desired noise mitigation measures.
C. The developer and/or their assigns shall be responsible for the maintenance of
all areas held in common ownership.
D. The existing overhead electric power line along Valley View Road will be
required to be relocated.
E. The developer should implement the use of Best Management Practices for
erosion control and stormwater management during construction.
F. Provide placement of at least one overstory/shade deciduous tree in the front
yard.
G. Provide sod placement in front yard and seed or sod placed in side and rear
yards.
H. Provide placement of 6" of topsoil. The soil composition should be similar to
the MnDOT topsoil borrow requirements.
I. Provide rain sensors for any irrigation system.
J. Replace all proposed Northern Pin Oak with Hackberry and/or a suitable
replacement approved by the City.
K. The existing field access to this property off of CSAH 83 shall be completely
removed from the County right-of-way and graded to match the existing ditch.
L. No landscaping, ponding, berming, or signage shall be permitted within the
County right-of-way.
M. Any change in drainage entering the County right-of-way requires detailed
stormwater calculations to be submitted to the County Engineer for review
and approval.
N. Any work within the County right-of-way shall require a permit.

INTRODUCTION:
Centex Homes has submitted an application for preliminary plat approval of Park Meadows
East, proposed for the northwest comer of County State Aid Highway (CSAR) 83 and Valley
View Road (Exhibit A). The plat, as currently proposed, contemplates the construction of92

DISCUSSION:
Access to this site is shown from Valley View Road and from Sandhill Drive (to the west).
Staff is also recommending that public right-of-way be extended north off Sandhill Drive to
the north property line, thereby providing for a future street extension to that property to the
north. This recommendation is consistent with the City of Shako pee's Design Criteria, which
states that "street arrangements shall not be such as to cause hardship to owners of adjoining
property in platting their own land and providing convenient access to it". That parcel to the
north does not have direct access to the west, nor is it presently known what type of, if any,
access will be available from the north and east. The applicant has also commented that they
may install a sound wall/fence along the east property line. Final decision/design will be
detennined at time of Final Plat submittal/review, if this request is approved.
Scott County Public Works submitted a letter (Exhibit C), noting that if approved they
recommend their listed conditions be incorporated into the approved resolution. One of their
recommendations discusses turning movements at the intersection of CSAH 83 and Valley
View Road.
The City's Engineering Department recommends approval of the Preliminary Plat, subject to
the conditions listed in their memorandum. (Exhibit D). Those comments have been
incorporated into the draft resolution. Most notable of their comments is the one that pertains
to the trunk sanitary sewer on CSAH 83, noting that those lots that will have sanitary sewer
service to the future trunk sanitary sewer along CSAH 83 cannot be final platted until a
contract has been awarded for the construction of the trunk line. .
WSB & Associates, Inc. reviewed this application and has provided a letter that addresses
their comments (Exhibit E).
Mark Themig, Parks and Recreation Director, has provided memorandums (Exhibit F) noting
the recommendations from the Park and Recreation Advisory Board (PRAB) and the
Environmental Advisory Commission (EAC). Those comments have been incorporated into
the draft resolution. He noted that ifthe city requires a roadway connection to the north in the
Park Meadows East development, this roadway could provide a trail connection either by
having a sidewalk or trail along the roadway. lfthe city does not require a roadway, the City
should request a trail easement somewhere in the vicinity of Lot 8 arid Lot 9 on Sandhill
Drive. He also provided comments on the woodland management plan, the proposed
landscape plan and the proposed tree species, noting the required number of replacement trees
and a suggestion for replacement of a certain species with another more resilient species.
Shakopee Public Utilities provided a memorandum (Exhibit G), noting that trunk watermains
are planned for Molina Street extended out to CSAH 83 and along the CSAH 83 corridor, and
that improvements to Valley View Road will require relocation of the existing overhead
electric power line.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission recommend to the City Council the approval
of the Preliminary Plat of Park Meadows East, subject to the following conditions:

Park Meadows East, Centex Homes
INTRODUCTION
I am writing to provide you with natural resource comments for the Park Meadows East
development, and the Environmental Advisory Committee's recommendation.
DISCUSSION
Centex Homes presented the Park Meadows East development to the Environmental
Advisory Committee on December 8, 2004. The Advisory Committee discussed the
location and function of the stormwater ponding areas, as well as proximity of the homes
adjacent to CR 83 and potential noise issues. Centex Homes also outlined the issues
related to sanitary sewer service to the site. TheAdvisory Committee did not propose
any modifications to the development.
ENVIRONMENTAL ADVISORY COMMITTEE'S RECOMMENDA nON
The Environmental Advisory Committee recommended approval (5-0) of the preliminary.
plat that was presented at the. December 8 Committee meeting, with the following
conditions:
a. The developer should implement the use of Best Management Practices for erosion
control and stormwater management during construction.
b. Placement of, at least, one overstorylshade deciduous tree in the front yard.
c. Sod placement in front yard and seed or sod placed in side and rear yards.
d. Placement of 6" of topsoil. The soil composition should be similar to the MnDOT
topsoil borrow requirements.
e. Rain sensors for any irrigation system.
STAFF COMMENTS
1. Woodland Review'
The applicant has provided a woodland management plan for the proposed
development. This plan indicates removal of 45 trees of medium woodland quality.
Most of these trees are located in the southwest portion of the site. The ordinance
requires replacement of medium quality woodlands as one tree for ever two
removed. The applicant would be required to provide at least 23 trees.
The city's landscaping tree requirement counts toward the woodland management
tree replacement plan. The applicant is proposing 167 de'Ciduous trees, 39 --.-. ....,
coniferous and 237 shrubs as part of the development.
2. Landscape Plan and Tree Species
The applicant is proposing a number of different tree species. Andrea Weber, Park
and Landscape Designer, has reviewed the proposed landscaping plan and
recommended the following: '

INTRODUCTION
I am writing to provide you with park comments for the Park Meadow's East preliminary
plat review, and the Parks and Recreation Advisory Board's recommendation.
DISCUSSION
. Centex Homes presented the Park Meadows East development to the Parks and
Recreation Advisory Board on December 28,.2004. The Advisory Board discussed
whether or not park land is needed in this development. Given the proximity of larger 11-
acre Greenfield East/Park Meadows park and proposed sidewalk connections, the
Advisory Board concurred with the developers plan to provide cash in lieu of land.
The Advisory Board also commented thatthe city needs to ensure that there is a
pedestrian and bicycle trail along CR 83. The applicant noted that there may be right-of-
way along the west side of CR 83 that could serve a future trail. However, the trail would
likely be the responsibility of the county, since it is a county road.
I had a chance to discuss the future trail alignment with Craig Jensen from Scott
County's highway division. He indicated that the County is moving toward a policy of
trails along both sides of County highways. When CR 83 is reconstructed at some point
in the future, there should be adequate right-ot-way on the west side to accommodate
this trail segment. (The future design of CR 83 is not known, so requiring a trail as part of
the Park Meadow East development is not practical.)
PARKS AND RECREATION ADVISORY BOARD PARK DEDICATION
RECOMMENDATION
The Parks and Recreation Advisory Board recommended approval (6-0) of the proposed
preliminary plat at the December 28, 2004 Advisory Board meeting I with the following
conditions:
a. That the applicant meet park dedication requirement by providing cash in \[eu ot land
dedication.
b. Sidewalks and trails shall be provided throughout the site as proposed.
c. All park dedication shall be calculated at time of final plat approval.

There is a proposed trail coming from the Park Meadows development on the north side
of the stormwater pond. In looking toward the future, we should attempt to provide a trail
connection from Park Meadows East development to this trail when development to the
north of Park Meadows East occurs. If the city requires a roadway connection to the
north in the Park Meadows East development, this roadway could provide that trail
connection either by having a sidewalk or trail along the roadway. If the city does not
require a roadway, we should request a trail easement somewhere in the vicinity of lot 8
and lot 9 on Sandhill Drive.
Finally, the city should affirm the need for a future trail along CR 83, and continue to
work with. the:CountY:,~QE:tI3!.~~fail in the future.....:=.;
