III "~~ '.'I'~ Memorandum J. . , \J il'.a fl CASE NO.: 05-019 TO: Mayor and City Council Mark McNeill, City Administrator FROM: Julie Klima, Planner IT SUBJECT: Comprehensive Plan Amendment to extend MUSA MEETING DATE: February 15, 2005 REVIEW PERIOD: December 23, 2004 - April 22, 2005 INTRODUCTION: Tollefson Development and Greg Powers have made application extend MUSA to a 9.5 acre property recently annexed from Jackson Township. The property is located south of Highway 169 and east and adjacent to Marystown Road. Please see Exhibit A. The proposed zoning is consistent with the ad()pted land use plan. The land use plan guides this property for single family residential development. The subject site is proposed to be included in the Countryside development currently under review by the City. ALTERNATIVES: 1. Approve Resolution No. 6188, a resolution approving the request to extend MUSA to the subject property. 2. Deny the request to extend MUSA to the subject property. 3. Table the matter and request additional information from the applicant and/or staff. PLANNING COMMISSION RECOMMENDATION: The Planning Commission reviewed this application at its February 3,2005 meeting, and by a unanimous vote recommended approval of the MUSA extension request. The Planning Commission staff report is attached for the Council's information. ACTION REQUESTED: Offer and approve motions to approve Resolution No. 6188 (Alternative No.1), and move its adoption. g:\cc\2005\02-15\musapowers050 19 .doc RESOLUTION NO. 6188 A RESOLUTION OF THE CITY OF SHAKOPEE APPROVING A REQUEST TO EXTEND MUSA WHEREAS, Tollefson Development, applicant, and Greg Powers, property owner, have requested the extension of the MUSA boundary to the property; and WHEREAS, the subject property is legally described as follows: Thatpart of the Southwest Quarter of the Northwest Quarter of Section 13, Township 115, Range 23, Scott County, Minnesota, described asfollows: Beginning at a point in the west line of said Northwest Quarter 457.32feet north of the southwest corner thereof' thence continuing North 1 degree 1 minute 25 seconds West, assumed basis for bearings, along said west line, 325.68feet; thence North 88 degrees 58 minutes 35 seconds Eastl339.26feet to the east line of said Southwest Quarter of the Northwest Quarter; thence South 0 degrees 25 minutes 53 seconds East, along said East line 325.70 feet; thence South 88 degrees 58 minutes 35 seconds west 1335.89 feet to the point ofbeginning EXCEPT that part beginning at a point in the west line of said Northwest Quarter 719.36feet north of the southwest corner thereof thence continuing North 1 degree] minutes 25 seconds West, assumed basis for bearings, along said west line, 63.64 feet; thence North 88 degrees 58 minutes 35 seconds East a distance of 350.00 feet; thence South 1 degree 1 minute 25 seconds East, parallel with the said West line a distance of 65.54 feet; thence South 89 degrees 17 minutes 12 seconds West a distance of 35 0.01 feet to the said West line; and WHEREAS, notices were duly sent and posted, and a public hearing was held before the Planning Commission on February 3,2005, at which time all persons present were given an opportunity to be heard; and WHEREAS, the City Council heard the matter at its meeting on February 15, 2005; and NOW, THEREFORE BE IT RESOLVED that the City Council ofthe City of Shakopee hereby adopts the following findings of facts relative to the above-named request: Finding No.1: The original Comprehensive Plan is not in error. The adopted Comprehensive Plan does guide this property for single family residential development. The Comprehensive Plan sets forth policy requiring zoning at urban densities to be served with urban services. Extension of MUS A to the property will allow for compliance with the stated policy. Finding No.2: Significant changes in community goals and policies have not taken place. Extension of urban services to the property would comply with existing community goals and policies. Finding No.3: Significant changes in neighborhood development patterns have occurred in that development has proceeded in the vicinity of the subj ect property. BE IT FURTHER RESOLVED, that the request to amend the Comprehensive Plan by extending MUSA to the property is hereby approved. The subject site is located south of Hwy. 169 and west of County Road 79 (see Exhibit A). The property is within the proposed Preliminary Plat of Countryside proposed by Tollefson Development. The Countryside development is currently under review by the City. The property was recently rezoned to Urban Residential (R-IB). City staff has identified areas of primary and secondary expansion of urban services based on cost effectiveness and ease of extending services to parcels. The subject site is located in the primary MUSA expansion area. FINDINGS: The Zoning Ordinance does not specify criteria for granting a Comprehensive Plan Map amendment. Though reasonable criteria would be Criteria 1 -3 for Zoning Ordinance amendments. Staffhas provided Criteria 1 - 3 for the Commission's review and discussion. 1 Criteria #1 That the original Comprehensive Plan is in error; Finding #1 The original Comprehensive Plan is not in error. Continue the public hearing and request additional information from the applicant or staff. 4. Close the public hearing, but table the matter and request additional information. STAFF RECOMMENDATION: Staff recommends Alternative No.1. The purpose of the request is to develop the property as part of the Countryside residential community. The property will allow the extension of 1 ih Ave to County RD 15. The property is 9.5 acres in size and is located off of Marystown Rd. The property has been officially annexed by the City of Shakopee from Jackson Township and has been zoned Urban Residential Zone (R':lB) by the City of Shako pee, MN. This property is a natural continuation of the growth in the area. There are adequate transportation and utility systems in place to serve this project. This MUSA allocation request meets the City of Shako pee's development criteria based on the following: 1. There is a significant change in neighborhood development patterns to the east of this property. The proposed land use for this property is a natural continuation of the neighborhood and growth pattern. 2. The property has been annexed to the City of Shakopee and rezoned to a zoning designation allowing higher density development consistent with urban services. Services are available to this property allowing development. 3. Property to the east and south are have been allocated MUSA. 4. The extension of I ih Ave through this property supports Scott County's long range transportation plan for 17th Ave. 5.
