CITY OF SHAKOPEE Memorandum CASE NO.: 05-025 CONSENT TO: Mayor and City Council Mark McNeill, City Administrator FROM: Mark Noble, Planner I SUBJECT: Approval of a Registered Land Survey (RLS) - Air Products & Chemicals, Inc. DATE: March 1, 2005 INTRODUCTION Air Products & Chemicals, Inc., property owner, and Schoell & Madson, Inc., applicant, have submitted a request for an RLS for property that is located at the northeast corner of CSAH 83 and Valley Industrial Blvd. South. This property consists of Tracts C & H, Registered Land Survey #66 (Exhibit A). BACKGROUND The property in question is zoned Heavy Industry (1-2) Zone. The 1-2 Zone allows one acre (minimum) lots, with 100 foot lot widths and 85% maximum impervious surface percentage. The purpose of the request is to reconfigure the existing two (2) lots in order to allow for the sale of proposed Tract B, with proposed Tract A to continue to be utilized by Air Products & Chemicals, Inc. The proposed lots would exceed the minimum lot widths and minimum lot square footage (approximately 2 Y-t-3 acres each), and would comply with the maximum allowed lot coverage (Exhibits B & C). Any proposed structure(s) on Tract B shall comply with all applicable design and performance standards as stipulated in the City Code. As these were previously platted lots, park dedication fees are not applicable. Shakopee Public Utilities (SPU) has commented that Tract B does not have an existing water service; therefore, one which conforms with SPU requirements will have to be added. City Engineering has provided comments (Exhibit D), noting that payments of and connections to the sanitary sewer, storm sewer and water main services are required, and that access to Tract B shall comply with the City requirements. Additionally, they have stipulated that the City of Shakopee and Scott County shall retain all existing rights-of-way and existing easements, and that additional easements shall be provided along the southern property line of Tract A and along the northern property line of Tract B. ALTERNATIVES 1. Approve the requested Registered Land Survey, Resolution No. 6195, as proposed. 2. Approve the requested Registered Land Survey, Resolution No. 6195, subject to revised conditions. 3. Do not approve the Registered Land Survey. 4. Table action/on this item and request additional information from the applicant and/or staff. Any proposed structure( s) on either parcel shall comply with all applicable design and performance standards as stipulated in the City Code. 2. Water, sanitary sewer and storm sewer services shall be provided in compliance with Shakopee Public Utilities and City of Shakopee design requirements. 3. Payment of Trunk Sanitary Sewer Charges, Trunk Storm Water Charges and Trunk Storm Water Storage and Treatment Charges shall be made, as required by the most current City of Shakopee Fee Schedule. 4. Provide electronic (Auto CAD) files ofthe RLS to the City Engineering Department. 5. Tract B shall be subject to storm water discharge and treatment standards as set forth by the City of Shakopee' s Comprehensive Stormwater Management Plan. 6. Access to Tract B shall comply with spacing guidelines set forth by the City of Shakopee's Transportation Plan. 7. Scott County and the City 'of Shakopee shall retain all existing rights-of-way and existing easements. 8. Easements shall be shown on the RLS as approved by the City Engineer. They shall include, but not be limited to, the following: . Provide a minimum of ten (10) feet of drainage and utility easement adjacent to the southern property line of Tract A. . Provide a minimum of ten (10) feet of drainage and utility easement adjacent to the northern property line of Tract B. 9. Submit a revised survey prior to recording that includes the required easements and sanitary sewer/storm sewer/water service information. BE IT FURTHER RESOLVED, that the Mayor and City Clerk are hereby authorized and directed to approve and accept said Registered Land Survey. The parcels are located in the Northeast quadrant of the County Road 83 (Canterbury Road) and Valley Industrial Boulevard South intersection. After reviewing the above referenced application, we have the following comments for the applicant and the planning department: General 1.
