Roll Call Present: Mayor Matt Lehman, Council Members Jay Whiting, Angelica Contreras, Jim DeLaney, Jesse Lara Staff Present: City Administrator Bill Reynolds, Assistant City Administrator Chelsea Petersen, City Attorney Jim Thomson, Finance Director Nate Reinhardt, City Engineer Alex Jordan, City Clerk Lori Hensen, Planning/Development Director Michael Kerski, Park/Recreation Director Jay Tobin 2. Pledge of Allegiance 3. Approval of Agenda Council Member Jay Whiting made a motion to approve the agenda, second by Council Member Angelica Contreras and the motion passed. 5-0 4. Consent Business - (All items listed in this section are anticipated to be routine. After a discussion by the Mayor there will be an opportunity for members of the Council to remove any items from the consent agenda for individual discussion. Those items removed will be considered following the Public hearing portion of the agenda. Items remaining on the Consent Agenda will not be discussed and will be approved in one motion.) A.2. *Minnesota Department of Public Safety's DWI/Traffic Safety Officer Grant Award Adopt Resolution R2023-075, accepting the Minnesota Department of Public Safety's DWI/Traffic Safety Officer Grant Award and authorizing the City Administrator to execute the necessary contracts and agreements applicable to accepting this award. (Motion was carried under consent agenda) *4. A.3. *U of M Center for Resuscitation Medicine's Minnesota First Responder AED Grant Award Adopt Resolution R2023-076, accepting the University of Minnesota Center for Resuscitation Medicine's Minnesota First Responder AED grant award and authorizing the police department to take possession of the AED equipment. No grant contract is required to accept this equipment. (Motion was carried under consent agenda) *4. A.4. *Approve a Temporary Liquor License for the Shakopee Lions Club Approve a Temporary Liquor License for the Shakopee Lions Club USA Men's Slow Pitch Softball Tournament being held at Joe Schleper Stadium from August 17, 2023 - August 20, 2023. (Motion was carried under consent agenda) B. Engineering *4. B.1. *Permanent Easement Purchase Adopt Resolution R2023-077, authorize purchase of permanent right-of-way easement at 930 Main Street South for the sum of $5,661.84. (Motion was carried under consent agenda) C. Parks and Recreation *4. C.1. *Monetary Donation for Aquatic Programming Council Member Angelica Contreras made a motion to approve Resolution No. R2023-078 accepting monetary donation of $1500.00 from Sue Westegaard, second by Council Member Jay Whiting and the motion passed. 5-0 D. Planning and Development *4. D.1. *Final Plat of Highview Park Adopt Resolution R2023-080, approving the Final Plat of Highview Park. (Motion was carried under consent agenda) *4. D.2. *Final Plat of J and J Minneapolis Page 2 of 5 Adopt Resolution R2023-081, approving the Final Plat of J AND J MINNEAPOLIS. (Motion was carried under consent agenda) *4. D.3. *XCEL Energy Encroachment Agreement Approve agreement with XCEL energy. (Motion was carried under consent agenda) *4. D.4. *Adoption of NFPA 70 National Electric Code 2023 Edition Approve Resolution R2023-079 adopting NFPA 70 National Electric Code 2023 Edition. (Motion was carried under consent agenda) *4. D.5. *Final Plat of Windermere East Second Addition Adopt Resolution R2023-083 for the Final Plat of Windermere East Second Addition. (Motion was carried under consent agenda) E. Police *4. E.1. *Surplus Property Declare two forfeited vehicles as surplus property and authorize disposal. (Motion was carried under consent agenda) 5. RECOGNITION OF INVOLVED RESIDENTS BY CITY COUNCIL - Provides an opportunity for the public to address the Council on items which are not on the agenda. Comments should not be more than five minutes in length. The Mayor may adjust that time limit based upon the number of persons seeking to comment. This comment period may not be used to make personal attacks, to air personality grievances, to make political endorsements or for political campaign purposes. Council Members will not enter into a dialogue with citizens, and questions from Council will be for clarification only. This period will not be used to problem solve issues or to react to the comments made, but rather for informational purposes only. 6. Business removed from consent will be discussed at this time 7. Vacation of Alley In Block 74, City of Shakopee Council Member Jay Whiting made a motion to open the public hearing, second by Council Member Angelica Contreras and the motion passed. 5-0 Council Member Jesse Lara made a motion to close the public hearing, second by Council Member Jim DuLaney and the motion passed. 5-0 Page 3 of 5 Council Member Jay Whiting made a motion to adopt Resolution R2023-070, approving the Vacation of the Alley within Block 74, second by Council Member Angelica Contreras and the motion passed. 5-0 7.B. Amending City Code relating to penalties for licensed tobacco and liquor retailers Council Member Angelica Contreras made a motion to open the public hearing, second by Council Member Jesse Lara and the motion passed. 5 - 0 Council Member Jesse Lara made a motion to close the public hearing, second by Council Member Jay Whiting and the motion passed. 5-0 Council Member Jim DuLaney made a motion to adopt amended 02023-008 repealing section 110.999 paragraph C, adding section 110.069 and amending section 114.99 of the Shakopee City Code relating to penalties for licensed tobacco and liquor retailers as discussed by council, second by Council Member Jay Whiting and the motion passed. 5-0 8. Recess for Economic Development Authority Meeting Council Member Jay Whiting made a motion to recess to the EDA, second by Council Member Jesse Lara and the motion passed. 5-0 9. Reconvene 10.
