Reynolds removed 4.A.4. from the agenda completely.
Councilmember Jay Whiting made a motion to approve the modified agenda, seconded by
Councilmember Jody Brennan and the motion passed.

4. Consent Business - (All items listed in this section are anticipated to be routine. After
a discussion by the Mayor there will be an opportunity for members of the Council to
remove any items from the consent agenda for individual discussion. Those items
removed will be considered following the Public hearing portion of the agenda. Items
remaining on the Consent Agenda will not be discussed and will be approved in one
motion.)
Reynolds removed from 4.A.5. from consent. He also amended item 4.A.1. removed Brad
Carlson from the minutes.
Councilmember Jody Brennan made a motion to approve the amended consent agenda,
seconded by Councilmember Angelica Contreras and the motion passed.

*4. A.5. *Shakopee Public Utilities Commission Salary Increase Request
Councilmember Jay Whiting made a motion to adopt Resolution R2022-057
increasing the monthly Shakopee Public Utility Commission salary from $400 to
$500, the Commission President monthly salary from $500 to $600 and the MMPA
Representative monthly salary to $100., seconded by Councilmember Angelica
Contreras and the motion passed.

Approve the 2022 Concession Agreements with the Shakopee Soccer
Association, Shakopee Indian Baseball, Shakopee Coyote Baseball and Shakopee

*4. C.1. *Rhythm on the Rails 2022
Approval of Rhythm on the Rails event application, site layout and street and parking
lot closures. (Motion was carried under consent)

Adopt Resolution No. R2022-050. (Motion was carried under consent)

Host Site Application
Adopt Resolution R2022-042, an application for the City of Shakopee to participate
in the Minnesota GreenCorps Host Site program. (Motion was carried under consent)

Adopt Resolution No. R2022-055 setting the public hearing date for vacation of
public drainage and utility easements in Summerland Place First Addition. (Motion
was carried under consent)

Adopt Resolution No. R2022-054 setting the public hearing date for vacation of
public drainage and utility easements in Powers 2nd Addition. (Motion was carried

*4. D.1. *JPA for Roadway Pavement Maintenance
Adopt Resolution R2022-051, authorizing the City of Shakopee's annual maintenance
for roadway sealcoat, crack sealing, pavement markings and fog sealing and a portion
of the 2022 Pavement Rehabilitation Project CIF-22-011 in the amount of $605,310
to be awarded as part of the 2022 South Metro Joint Powers Agreement
contract. (Motion was carried under consent)
*4. D.2. *12th Avenue Trail Project
Adopt Resolution R2022-048, accepting work on the 12th Avenue Trail Project CIF-
20-003, and authorizing final payment of $8,177.86 to Rosti Construction
Company. (Motion was carried under consent)
*4. D.3. *12th Avenue Reconstruction Project
Adopt Resolution R2022-049, accepting work on the 12th Avenue
Reconstruction Project CIF-19-004, and authorizing final payment of $203,867.34 to
S.M. Hentges & Sons. (Motion was carried under consent)
*4. D.4. *2022 Sanitary Sewer and Storm Sewer Televising
Approve a contract with Pipe Services Corp. in the amount of $31,408.08 for the
2022 Sanitary Sewer and Storm Sewer Televising Project. (Motion was carried under
consent)
*4. D.5. *2022 Trail Sealcoating
Approve a contract with Gopher State Sealcoat, Inc., in the amount of $54,804.55 for
the 2022 Trail Sealcoating. (Motion was carried under consent)
*4. D.6. *2022 Regional Solicitation Roadway Modernization Grant Application
Adopt Resolution R2022-053, authorizing the City of Shakopee to apply to the
2022 Regional Solicitation Roadway Modernization Grant. (Motion was carried under
consent)

5. RECOGNITION OF INVOLVED CITIZENS BY CITY COUNCIL - Provides an
opportunity for the public to address the Council on items which are not on the agenda.
Comments should not be more than five minutes in length. The Mayor may adjust that
time limit based upon the number of persons seeking to comment. This comment
period may not be used to make personal attacks, to air personality grievances, to
make political endorsements or for political campaign purposes. Council Members will
not enter into a dialogue with citizens, and questions from Council will be for
clarification only. This period will not be used to problem solve issues or to react to
the comments made, but rather for informational purposes only.

Councilmember Angelica Contreras made a motion to recess to EDA, seconded by
Councilmember Jay Whiting and the motion passed.

9. A.1. Flavored Tobacco and Vaping Ordinance Changes
Councilmember Jay Whiting made a motion to adopt Ordinance No. 02022-001,
Amending Sections 110.055, 110.056 and 110.059 of the Shakopee City Code
Pertaining to the Regulation of Tobacco -Related Products and Flavored Products,
seconded by Councilmember Angelica Contreras and the motion passed.

9. A.2. Adoption of 2021 Property Maintenance Code
Councilmember Jody Brennan made a motion to adopt Ordinance No. 02022-008
Amending Title XI of the City Code by Adding Chapter 82 Adopting the International
Property Maintenance Code and allowing the City to Publish a Summary of this
Ordinance, seconded by Councilmember Angelica Contreras and the motion passed.

9. A.3. Adoption of a Rental Housing Ordinance
Councilmember Jay Whiting made a motion to adopt Ordinance No. 02022-009
Amending Title XI of the City Code Repealing Section 111.18 "Residential Rental
Property Registration" and Establishing Chapter 117 "Residential Rental Licensing",
seconded by Councilmember Angelica Contreras and the motion passed.

Brennan suggested that staff look at penalties for the tobacco ordinance and petty
misdemeanor for youth caught smoking.

Councilmember Jay Whiting made a motion to adjourn to Tuesday, April 19, 2022 at
7:00 pm, seconded by Councilmember Jody Brennan and the motion passed.
