Pledge of Allegiance 3. Approval of Agenda Councilmember Jay Whiting made a motion to approve the agenda, seconded by Councilmember Jody Brennan and the motion passed. 5-0 4. Consent Business - (All items listed in this section are anticipated to be routine. After a discussion by the Mayor there will be an opportunity for members of the Council to remove any items from the consent agenda for individual discussion. Those items removed will be considered following the Public hearing portion of the agenda. Items remaining on the Consent Agenda will not be discussed and will be approved in one motion.) Planning and Development *4. B.1. *LCDA-TOD Grant Application for Core Crossing Improvements Councilmember Jay Whiting made a motion to approve Resolution No. R2020-080, for the city of Shakopee to apply for the Livable Communities Demonstration Account Transit Oriented Development Grant on behalf of Sand Companies Development for Core Crossing Apartments, seconded by Councilmember Jody Brennan and the motion passed. 4-1 Nays: Lehman *4. B.2. *Stagecoach Park Concept Plan Review Approve the proposal from Confluence in the amount of $29,450 for design services for Quarry Lake Park. (Motion was carried under consent agenda.) *4. B.3. *Contract for Design Services for Quarry Lake Park Approval of the proposed concept plan for Stagecoach Park. (Motion was carried under consent agenda.) *4. B.4. *Encroachment Agreement for Train Station Authorizing the appropriate city officials to execute the Commercial Building Encroachment and Access Appurtenant Easement. (Motion was carried under consent agenda.) C. Police *4. C.1. *Amended 2020 Drug Task Force Grant Agreement Accept 2020 Amended Drug Task Force Grant Agreement. (Motion was carried under consent agenda.) *4. C.2. *Surplus Property Declare seven forfeited vehicles as surplus property and authorize disposal. (Motion was carried under consent agenda.) D. Public Works and Engineering Page 2 of 5 *4. D.1. *Shakopee Lions Club Structures Approve agreement and accept donation of shade structures for the Lions Park splashpad from the Shakopee Lions Club. (Motion was carried under consent agenda.) 5. RECOGNITION OF INVOLVED CITIZENS BY CITY COUNCIL - Provides an opportunity for the public to address the Council on items which are not on the agenda. Comments should not be more than five minutes in length. The Mayor may adjust that time limit based upon the number of persons seeking to comment. This comment period may not be used to make personal attacks, to air personality grievances, to make political endorsements or for political campaign purposes. Council Members will not enter into a dialogue with citizens, and questions from Council will be for clarification only. This period will not be used to problem solve issues or to react to the comments made, but rather for informational purposes only. 6. Business removed from consent will be discussed at this time 7. Public Hearings 7.A. Vacation of Public Right -of -Way, and Access, Drainage & Utility easements as dedicated within Powers First Addition and Jackson Elementary School Councilmember Jay Whiting made a motion to open the public hearing, seconded by Councilmember Angelica Contreras and the motion passed. 5-0 Councilmember Jody Brennan made a motion to close the public hearing, seconded by Councilmember Angelica Contreras and the motion passed. 5-0 Councilmember Jody Brennan made a motion to approve Resolution No. R2020- 078, a resolution approving the vacation of public right-of-way, and access, drainage and utility easements as dedicated within Outlot A and Lot 1, Block 1, Powers First Addition, and Lot 1, Block 1, Jackson Elementary School, located at the northeast corner of CSAH 16 (17th Avenue) and Marystown Road (CSAH 15) as depicted on the attached sketches, seconded by Councilmember Angelica Contreras and the motion passed. 5-0 8. Recess for Economic Development Authority Meeting Councilmember Matt Lehman made a motion to recess to the EDA, seconded by Councilmember Jay Whiting and the motion passed. Page 3 of 5 5-0 9. Amendment of Planned Unit Development (PUD) District #2 (Powers PUD) and Preliminary & Final Plat of POWERS SECOND ADDITION Councilmember Jay Whiting made a motion to approve Resolution No. R2020-079, a resolution approving the Preliminary and Final Plat of Powers Second Addition; and approve Ordinance No. 02020-004, an Ordinance approving an amendment of Planned Unit Development District #2 for property located north of 17th Avenue (CSAH 16), east of Marystown Road (CSAH 15) and west of Jackson Elementary School, seconded by Councilmember Jody Brennan and the motion passed. 4-1 Nays: Lehman C.
