Shakopee City Council Minutes June 5,2018 SHAKOPEE 7:00 PM City Hall 485 Gorman St. Mayor Bill Mars presiding 1. Roll Call Present: Mayor William Mars, Councilmember Mike Luce, Councilmember Matt Lehman, Councilmember Jay Whiting, Councilmember Kathi Mocol Staff Present: Administrator Bill Reynolds, Assistant City Administrator Nate Burkett, City Attorney Jim Thomson, Public Works/Engineering Director Steve Lillehaug, Planning/Development Director Michael Kerski, Finance Director Darin Nelson, City Clerk Lori Hensen 2. Pledge of Allegiance 3. Approval of Agenda Councilmember Kathi Mocol made a motion to approve the agenda as presented, seconded by Councilmember Jay Whiting and the motion passed. 5 - 0 4. Consent Business - (All items listed in this section are anticipated to be routine. After a discussion by the Mayor there will be an opportunity for members of the Council to remove any items from the consent agenda for individual discussion. Those items removed will be considered following the Public hearing portion of the agenda. Items remaining on the Consent Agenda will not be discussed and will be approved in one motion.) Councilmember Luce removed item 4.C.1. for discussion Councilmember Matt Lehman made a motion to approve the amended consent agenda, seconded by Councilmember Jay Whiting and the motion passed. 5 - 0 A. Administration *4. A.1. *City Council Minutes Approve the minutes from May 15, 2018. (Motion was carried under consent agenda.) *4. A.2. *2018-2019 Liquor License Renewals Page 1 of 4 Approve all liquor licenses for 2018-2019; and to waive the requirements of city code section 114.02 (I) for Global Restaurant Group, Inc. d/b/a Dangerfield's, Stonebrooke Golf Club LLC and Knights of Columbus Home Association, Inc., conditioned upon compliance with all licensing requirements. (Motion was carried under consent agenda.) B. Parks and Recreation *4. B.1. *Community Center Locker Room Tiling Contract Approve contract with Twin City Tile & Marble in an amount not to exceed $32,200 to replace tile and related work in community center locker rooms. (Motion was carried under consent agenda.) C. Planning and Development *4. C.1. *1st Ave. Street Closure for Clydesdale Event Councilmember Jay Whiting made a motion to approve street closure of 1st Avenue between Sommerville to Holmes Streets on Wednesday, June 6 from 4 - 8 p.m. for the Clydesdale event, seconded by Councilmember Kathi Mocol and the motion passed. 5 - 0 D. Public Works and Engineering *4. D.1. *Citizen-Assisted Monitoring Program(CAMP) - Water Quality Sampling Authorize execution of an agreement with the Metropolitan Council to participate in the 2018 Citizen-Assisted Monitoring Program(CAMP). (Motion was carried under consent agenda.) 5. RECOGNITION OF INVOLVED CITIZENS BY CITY COUNCIL- Provides an opportunity for the public to address the Council on items which are not on the agenda. Comments should not be more than five minutes in length The Mayor may adjust that time limit based upon the number of persons seeking to comment. This comment period may not be used to make personal attacks, to air personality grievances, to make political endorsements or for political campaign purposes. Council Members will not enter into a dialogue with citizens, and questions from Council will be for clarification only. This period will not be used to problem solve issues or to react to the comments made, but rather for informational purposes only. 6. A.1. 2017 Annual Financial Report, Audit Presentation and Review by Staff from Abdo Eick & Meyers Councilmember Jay Whiting made a motion to accept the 2017 Audit and accompanying reports, as presented by the audit staff from Abdo Eick & Meyers, seconded by Councilmember Matt Lehman and the motion passed. 5 - 0 9. A.2. Premise Permit for Northstar Search and Rescue Councilmember Kathi Mocol made a motion to approve Resolution R2018-064, a resolution of the City of Shakopee approving a premises permit for Northstar Search & Rescue located at Muddy Cow 1244 Canterbury Road, seconded by Councilmember Mike Luce and the motion passed. 5 - 0 B. Planning and Development 9. B.1. Zoning Text Amendment to R1 C (Old Shakopee Residential) Zone Councilmember Jay Whiting made a motion to adopt Ordinance # 02018-011, seconded by Councilmember Kathi Mocol and the motion passed. 5 - 0 9. B.2. Ordinance to Allow Outdoor Cafe in B-3 in the Public Rights of Way and Plazas Councilmember Jay Whiting made a motion to adopt Ordinance No. 02018-010 and publish its summary that will amend Title XV of the City Code by adding a new definition of Outdoor Café and Amending the Central Business Zone (B-3) to allow for outdoor cafes in the Public Rights of Way or Plazas, seconded by Councilmember Mike Luce and the motion passed. 5 - 0 9. B.3. Replacement of the Planned Unit Development Section with new PUD Zoning Page 3 of 4 Councilmember Jay Whiting made a motion to adopt Ordinance No. 02018-009 and publish its summary that Amends Title XV Land Use Section 151.048 Planned Unit Development District and replaces that current section, seconded by Councilmember Kathi Mocol and the motion passed. 3 - 2 Nays: Lehman, Luce 10. Attached is a report for your city or township for the month of May 2018. The report identifies any newly licensed adult and child foster care providers. This report will be issued monthly to each city or township in which a new adult foster care or child foster care license has been issued. DHS applications for residential services licenses instruct the applicant to contact the municipality to inquire about local ordinances that may apply, and to document the name and phone number of the person with whom they spoke. For non-foster care residential programs, DHS will continue to notify the municipality at the time an application for DHS licensure is received.
