CITY OF SHAKO PEE MEMORANDUM To: Mayor and City Council Mark McNeill, City Administrator From: Mark Themig, Parks, Recreation, and Facilities Director Meeting Date: March 15,2005 Subject: Community Center Expansion Special Election, Resolution No. 6207 INTRODUCTION The attached Resolution No. 6207 would establish a special election for the purpose of issuing general obligation bonds for a Community Center expansion. BACKGROUND AND DISCUSSION City Council will be considering a citizen task force recommendation to set a special election at a special work session on March 15. Should you choose to call a special election, we have prepared the attached resolution. We are waiting on the updated taxable market value of property from Scott County, and will have this information at your meeting to include in the resolution. Other changes can be made to the resolution as you deem appropriate. REQUESTED ACTION If City Council chooses to move forward with a special election, you should, by motion, move to adopt Resolution No. 6207, A Resolution Determining the Necessity for the Issuance of General Obligation Bonds and Calling a Special Election Thereon. 1 RESOLUTION NO. 6207 RESOLUTION DETERMINING THE NECESSITY FOR THE ISSUANCE OF GENERAL OBLIGATION BONDS AND CALLING A SPECIAL ELECTION THEREON BE IT RESOLVED by the City Council (the "City Council") of Shakopee, Scott County, Minnesota (the "City") as follows: 1. The City Council hereby finds and determines: a) That it is in the best interest of the health, welfare, and safety of the City and its residents that the City construct and equip improvements to and the expansion of its community center, including the addition of meeting rooms, an expanded fitness and weight-training area, an activity center for seniors, a leisure pool, additional space for aerobics and other fitness classes, a cafe and lounge, a multi-use turf field that converts to an ice sheet during hockey and skating season, locker rooms, expanded walking track, and a multi-use community room (the "Project"); b) That the City is authorized by the provisions of Minnesota Statutes, Chapter 475 (the "Act") to issue its obligations to finance the Project in whole or in part and to pledge its full faith, credit and taxing powers to the payment of such obligations; and c) That it is necessary and expedient to the sound financial management of the affairs of the City that the Project be financed in whole or in part by the issuance and sale of the City's general obligation bonds pursuant to the Act in an amount not to exceed $27,030,000. 2. The proposition for the issuance of the bonds will be submitted to the voters of the City at a special election to be held as part of the special election on Tuesday, May 24, 2005. The election will be held and conducted in accordance with the laws of the State of Minnesota relating to special municipal elections. 3. The City Clerk is directed to cause a sample ballot in substantially the form shown in Section 5 and a notice of election in. substantially the form attached as Exhibit A, to be posted, published, and delivered as required by law as follows: (a) The notice of election will be published once in the official newspaper of the City at least two weeks prior to the election; (b) The notice of election and a sample ballot will be posted at each of the polling places at least ten days prior to the election; (c) The notice of election and a sample ballot will be posted in the office of the City Clerk at least four days prior to the election; SHl55-161(JAE) 259971 v.1 (d) The sample ballot will be published in the official newspaper at least one week prior to the election; and (e) The notice of election will be delivered to the Scott County Auditor at least 53 days prior to the election, together with a written request to notify the Secretary of State of the election at least 46 days prior to the election pursuant to Minnesota Statutes, Section 205.16, Subdivision 5. 4. The polling places, hours of election, and the respective judges for the election will be those established by the City for special elections. The polls will be open from 7:00 a.m. until 8:00 p.m. 5. (a) The City Clerk is authorized and directed to prepare the ballot in substantially the following form, subject to the terms of Section 5(b) hereof: SH155-161(JAE) 259971 v.1 CITY QUESTION BALLOT SPECIAL ELECTION CITY OF SHAKOPEE Tuesday, May 24, 2005 INSTRUCTIONS TO VOTERS: To vote for a question, completely fill in the oval next to the word "YES" for that question. To vote against a question, completely fill in the oval next to the word "NO" for that question. CITY QUESTION NO.1: ISSUANCE OF BONDS FOR IMPROVEMENT OF CITY'S COMMUNITY CENTER. Shall. the City of Shakopee be authorized to issue its general obligation bonds in an amount not to exceed $27,030,000 to provide funds for constructing and equipping improvements to and expansion of its community center? 0 YES 0 NO The amount of taxes that would be raised in the first year of the property tax levy to pay the principal and interest on the bonds is estimated to be approximately $2,313,945. The maximum amount of taxes that would be raised in any subsequent year for the purpose is estimated to be approximately $2,317,479. This maximum increase in property tax levy is estimated to be approximately _ % of the taxable market value of property in the City. The City Clerk will provide each polling place with at least two sample ballots which are facsimiles of the card to be voted on in that precinct to be posted at the polling place, in accordance with Minnesota Statutes, Section 206.62. 6. The City Council shall meet in the City Hall on Thursday, May 26, 2005, at 7:00 p.m., C.T. to canvass the results ofthe election and to declare the results thereof. Dept and the many athletic programs the city has provided for adults and children. I don't believe there are many similar sized cities that can compare to our fine city when it comes to a.thletics. However, we have a huge disparity when it comeS to the Arts, and I mean arts of all kinds. Shakopee has a critical need for space and dollars for the performing arts, musical activities, artists to meet and display their talents, etc., etc., etc. Where will our future artists, musicians, song writers, poets, perfonning artists come from if they are not developed and encouraged. at a young age? How can we make this a reality in a city that currently offers little to nothing.?? Myself and a group of Shakopee residents who have an interest in the arts have organized and our goal is to bring more attention to the Arts in Shakopee. We are asking the Mayor and Cmmcil to include this group when budgets are proposed this fall. I understand that athletics bring people to the city which helps our economy, but so do the Arts. We are not asking for staff, however, it sure would be nice if the activities that Shakopee offers would make its way to the Shakopee web site. (along with lots of other items) I understand that Huber Park will help to fill some of~s void and that will be a great way to bring people to downtown. However, that will only accommodate the arts during the summa months. We also understand that if the referendum for the expansion of the Community Center is passed, that will hopefully provide some space for groups to meet, but that is an unknown at this time.
