No. 726 I s: B . }IJ CITY OF SHAKOPEE POLICE DEPARTMENT Memorandum CONSEr~T TO: Honorable Mayor and City Council Mark McNeill, City Administrator FROM: Dan Hughes, Chief of Police SUBJECT: Ordinance Amending Chapter 9, Section 9.42 Regulating Unattended Vehicles DATE: February 24, 2005 INTRODUCTION: Council is asked to consider amending the attached ordinance, Ordinance No. 725, Fourth Series. An Ordinance of the City of Shako pee, Minnesota, amending City Code Chapter 9, Section 9.42 regulating unattended vehicles. BACKGROUND: Councilor Lehman asked that I research the possibility of changing our unattended vehicle ordinance, which would allow the use of remote vehicle starters. When the ordinance was originally written, remote vehicle starters were not available. The new language, which is underlined, would address Councilor Lehman's concerns. Additional new language, also underlined, exempts fire, police and emergency vehicles from this ordinance. Emergency vehicles routinely must maintain appropriate temperatures so that life-saving equipment and computers function properly. RECOMMENDED ACTION: Offer Ordinance No. 725, Fourth Series, an ordinance of the City of Shako pee, Minnesota, amending City Code Chapter 9, Section 9.42 regulating unattended vehicles, and move its adoption. DH:pm ORDINANCE NO. 725, FOURTH SERIES AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA, AMENDING CITY CODE CHAPTER 9, SECTION 9.42 REGULATING UNATTENDED VEHICLES THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS: Section 1. City Code Chapter 9, Parking Regulations, Section 9.42 is amended to read as follows: SEC. 9.42. UNATTENDED VEHICLE. Subd. 1. Engine Running. It is unlawful for any person to leave a motor vehicle unattended while the engine is running with the key in the ignition. Subd. 2. Key in Ignition. It is unlawful for any person to leave a motor vehicle unattended with the key in the ignition. Subd. 3. Exception. This section does not apply to police,. fire, or other emergency vehicles. Section 2 - Effective Date. This ordinance becomes effective from and after its passage and publication. Adopted in session of the City Council of the City of Shakopee, Minnesota, held this _ day of ,2005.
