Suspension of Noise Regulation Associated with the St. Francis Regional Medical Center Expansion lS;fI,3., CITY OF SHAKOPEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Joe Swentek, Project Engineer SUBJECT: Request ofM.A Mortenson Company Regarding Hourly Restrictions on Construction Activities Associated with the St Francis Regional Medical Center Expansion DATE: March 15,2005 INTRODUCTION: By letter dated March 2, 2005, M.A. Mortenson Company, the contractor for the St Francis Regional Medical Center expansion, has requested that City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, be suspended for certain work hours. , BACKGROUND: The above named section of the City Code restricts the hours of operation from 7:00 AM. to 10:00 P.M. on weekdays, and from 9:00 A.M. to 9:00 P.M. on weekends and holidays. M.A. Mortenson Company is requesting a suspension on the hours as follows: March 1ih or 18th From 7:00 AM to 5:30 AM Start Time March 24th or 25th From 7:00 AM to 5:30 AM Start Time April ih or 8th From 7:00AM to 5:30 AM Start Time April 21 st or 22nd From 7:00 AM to 5:30 AM Start Time May 5th or 6th From 7:00 AM to 5:30 AM Start Time May 19th or 20th From 7:00 AM to 5:30 AM Start Time June 3rd From 7:00 AM to 5:30 AM Start Time M.A Mortenson Company is requesting these hours for employee safety issues during major concrete pours at the site. It is their opinion an early start time is more preferable than a late completion time. Staff would recommend that if the suspension of hours is granted, the approval is subject to the following conditions: 1. Approval is contingent upon minimizing noise exposure near residential areas. 2. If residential complaints are received by the City, the suspension can be revoked at the discretion of the City Engineer. 3. The applicant shall contact all residents adjacent to the site along County Road 17 (Marschall Road) to inform them of the new working hours and the anticipated dates these hours will be in effect. 4. Starting time for construction shall be 6:30 AM for the dates listed. If Council approves the suspension, a public notice to meet the City Code requireIVents and notice such as a news release would be placed in the Shakopee Valley News. ALTERNATIVES: 1. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, per this memo, and direct staff to publish notice of the suspension terms with the conditions as recommended by staff. 2. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, for some other period of time as determined appropriate by the City Council, and direct staff to publish notice of the suspension terms. 3. Do not approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D. RECOMMENDATION: Should the request for the suspension of City Cod Sec. 1 0.60 be approved, staff recommends the conditions listed above be attached to the approval. (M.A.Mortenson).doc March 2, 2005 City of Shakopee 129 South Holmes St. Shakopee, MN 55379 Attention: Mr. Mark McNeil City Administrator Re: Construction Start Up Time Request At St Francis Regional Medical Center Dear Mr. McNeil; We are applying for a suspension of operation of: Subparagraph 3. Hourly Restrictions on certain operations for (D.) Construction Activities to allow for construction start-up activities between 5:30am to 6:00am on major construction pour days which will usually occur every other Thursday or Friday commencing March 1 ih or 18t\ 2005, and completing on June 2nd or 3rd 2005 for a total of 7 (seven) pour dates. (See attached pour schedule) From a safety standpoint we would prefer an early start to a late completion due to early lighting availability and human stamina and fatigue issues. The construction activity would be any noise generated by concrete truck traffic though the site; the noise generated by the concrete pump and occasional back-up alarms on the northwest side of the site. We have asked for approval from St. Francis and from St. Gertrude's and they have agreed to our request. Please review and let us know at your earliest convenience. If you should have any further questions or concerns, or wish for us to present this request formally at your next city council meeting, please let us know.
