SUBJECT: Public Hearing for the 2005 Street Reconstruction,
Project No. 2005-1

INTRODUCTION:
As per Resolution No. 6181, a resolution receiving a report and calling for a public
hearing on the 2005 Street Reconstruction, Project No. 2005-1, a public hearing is
scheduled for March 15,2005. This agenda item is to conduct the public hearing for the
proposed improvements associated with the 2005 Street Reconstruction Project.
BACKGROUND:
On November 16, 2004, City Council ordered the preparation of a feasibility report for
the 2005 Street Reconstruction Project. The report was completed and accepted by City
Council on February 15, 2005. This proposed project includes reconstructing the
following streets:
. Sommerville Street, from 4th Avenue to 5th Avenue and from 6th Avenue to
Shakopee Avenue
. Fuller Street, from 10th Avenue to 8th Avenue
. Apgar Street, from 10th Avenue to Meadows North
. Scott Street, from 10th A venue to Meadows North
. Atwood Street. from 10th Avenue to Meadows North
On February 24,2005, staff conducted an informational meeting for the property owners
being affected by the proposed project. Approximately 26 residents attended the
meeting. The residents in attendance at the informational meeting had some general
questions regarding the design, construction schedule and assessment payments.
PROJECT COSTS:
The total estimated project cost for this project is $1,589,085.36.
25% of the street improvements ($213,131.34) will be assessed to the benefitting
properties. The remaining costs ($639,394.02) associated with the street improvements
will be paid from General Tax Levy Funds.
Storm sewer improvements ($74,250.00) will be paid from the Storm Sewer Fund.
Watermain improvements ($319,000.00) will be funded by Shakopee Public Utilities.
Sanitary sewer main line improvements ($200,750.00) will be paid from the Sanitary
Sewer Fund. Sanitary sewer service improvements ($142,560.00) will be assessed to the
benefitting properties.
ALTERNATIVES:
1. Adopt Resolution No. 6205, a resolution ordering the improvement and the
preparation of plans and specifications for the 2005 Street Reconstruction, Project
No. 2005-1.
2. Deny R~solution No. 6205. This action will halt the project until such time as the
City Council reconsiders the resolution.
3. Table Resolution No. 6205, to allow time for staff to prepare additional
information and/or revise the feasibility report as directed by City Council.
4. Modify Resolution No. 6205, to reduce the scope of the project area, as
determined by City Council.
RECOMMENDATION:
If Council desires to proceed with this project, at this time, then Resolution No. 6205
needs to be adopted, a resolution ordering the improvement and the preparation of plans
and specifications. If City Council does not wish to pursue this project, then the
appropriate action would be to move the approval of Resolution No. 6205 and vote
against the motion. If City Council wants more information on the project and/or to
amend the feasibility report, then Alternative No.3 is recommended.
ACTION REQUESTED:
Offer Resolution No. 6205, A Resolution Ordering an Improvement and Preparation of
Plans and Specifications for the 2005 Street Reconstruction, Project No. 2005-1, and
move its adoption.

A Resolution
Ordering An Improvement And Preparation Of
Plans And Specifications For The
2005 Street Reconstruction
Project No. 2005-1
WHEREAS, Resolution No. 6181 adopted on February 15, 2005, fixed a date for Council
hearing on the proposed improvement of the 2005 Street Reconstruction Project and all
appurtenant work; and
WHEREAS, ten days published notice of the hearing through two weekly publications of
the required notice was given and the hearing was held on the 15th day of March, 2005, at which all
persons desiring to be heard were given an opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA:
1. That the improvement is necessary, cost effective and feasible and is ordered as
hereinafter described:
2005 Street Reconstruction Project and all appurtenant work.
2. Bruce Loney, Public Works Director, is hereby designated as the engineer for this
improvement. He shall prepare plans and specifications for the making of such improvements.
3. The work of this project is hereby designated as part of the 2005-1 Public Improvement
Program.
4. The City Council shall let the contract for all or part of the improvements as authorized
by Minnesota Statutes 429.041, no later than three years from the date of adoption ofthis
resolution.
