Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Jeff Weyandt, Assistant City Engineer SUBJECT: Public Hearing for the 2005 Bituminous Overlay, Project No. 2005-4 DATE: March 15,2005 INTRODUCTION: As per Resolution No. 6182, a resolution receiving a report and calling for a public hearing on the 2005 Bituminous Overlay, Project No. 2005-4, a public hearing is scheduled for March 15,2005. This agenda item is to conduct the public hearing for the proposed improvements associated with the 2005 Bituminous Overlay Project. BACKGROUND: On January 18,2005, City Council ordered the preparation of a feasibility report for the 2005 Bituminous Overlay Project. The report was completed and accepted by City Council on February 15,2005. This proposed project includes overlaying the following streets between 11th Avenue and 1ih Avenue: . Quincy Street . Jefferson Street . Madison Street . Monroe Street The project also includes adding two street lights on each block to meet the City's Street Lighting Policy. On February 24,2005, staff conducted an informational meeting for the property owners being affected by the proposed project. Approximately 23 residents attended the meeting. The residents in attendance at the informational meeting seemed in favor of the proj ect and had some general questions regarding the design, construction schedule and assessment payments. PROJECT COSTS: The total estimated project cost for this project is $166,656.00. 25% of the street and street lighting improvements ($41,664.00) will be assessed to the benefiting properties. The remaining costs ($124,992.00) associated with the street and street lighting improvements will be paid from General Tax Levy Funds. ALTERNATIVES: 1. Adopt Resolution No. 6204, a resolution ordering the improvement and the preparation of plans and specifications for the 2005 Bituminous Overlay, Project No. 2005-4. 2. Deny Resolution No. 6204. This action will halt the project until such time as the City Council reconsiders the resolution. 3. Table Resolution No. 6204, to allow time for staff to prepare additional information and/or revise the feasibility report as directed by City Council. 4. Modify Resolution No. 6204, to reduce the scope of the project area, as determined by City Council. RECOMMENDATION: If Council desires to proceed with this project, at this time, then Resolution No. 6204 needs to be adopted, a resolution ordering the improvement and the preparation of plans and specifications. If City Council does not wish to pursue this project, then the appropriate action would be to move the approval of Resolution No. 6204 and vote against the motion. If City Council wants more information on the project and/or to amend the feasibility report, then Alternative No.3 is recommended. ACTION REQUESTED: Offer Resolution No. 6204, A Resolution Ordering an Improvement and Preparation of Plans and Specifications for the 2005 Bituminous Overlay, Project No. 2005-4, and move its adoption. 'Ht W~ Jeff Weyandt Assistant City Engineer JW/pmp ENGRl2005PROJECTS/20050VERLA Y/WORD/MEM6204 RESOLUTION NO. 6204 A Resolution Ordering An Improvement And Preparation Of Plans And Specifications For The 2005 Bituminous Overlay 1 Project No. 2005-4 WHEREAS, Resolution No. 6182 adopted on February 15, 2005, fixed a date for Council hearing on the proposed improvement of the 2005 Bituminous Overlay Project and all appurtenant work; and WHEREAS, ten <;lays published notice of the hearing through two weekly publications of the required notice was given and the hearing was held on the 15th day of March, 2005, at which all persons desiring to be heard were given an opportunity to be heard. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. That the improvement is necessary, cost effective and feasible and is ordered as hereinafter described: 2005 Bituminous Overlay Project and all appurtenant work. 2. Bruce Loney, Public Works Director, is hereby designated as the engineer for this improvement. He shall prepare plans and specifications for the making of such improvements. 3. The work of this project is hereby designated as part of the 2005-4 Public Improvement Program. 4. The City Council shall let the contract for all or part of the improvements as authorized by Minnesota Statutes 429.041, no later than three years from the date of adoption of this resolution.
