Subject: Acceptance of Alan Ritchey Donation, Resolution No. 6206
INTRODUCTION
City Council is asked to adopt Resolution No. 6206, A Resolution of the City of
Shakopee, Minnesota, Accepting a Donation of Fencing from Alan Ritchey,
Incorporated.
BACKGROUND AND DISCUSSION
I was contacted on March 3 by Mona Gansen of Alan Ritchey, Incorporated about a
possible donation of fencing to the city to be reused in the city's park system: On March
3, Bill Egan, Andrea Weber and I went to inspect the fence and determine if it was
feasible to reuse the felce. The city would also need to disassemble the fence and
transport it off the site.
Alan Ritchey is a contractor for the United States Postal Service. As part of their
contract, they were required to construct a 20' high fence in their warehouse to secure
parts. The fence is a rectangle, approximately 1 04'X40'. It had a value new six years ago
of approximately $31,000. The Postal Service no longer requires the fence to be used,
so they would like to remove it from the facility.
After discussing disassembly, transportation, and reuse with Mr. Egan and Ms. Weber,
we believe the fence can definitely be reused in the park system. The most likely reuse
would be to replace existing backstops either at the Senior High or Tahpah Park, or
possibly for the new baseball field that the Youth Baseball Association is raising funds
for. We estimate that the value of the fence if purchased new today is over $40,000.
If accepted, Public Works will schedule removal of the fence for this spring. We have
also worked with the City Attorney to draft a letter that would release Alan Ritchey for
any claims related to the city's work in disassembling and removing the fence,
REQUESTED ACTION
If CityCouncil concurs, it should, by motion adopt Resolution No. 6206, A Resolution of
the City of Shakopee, Minnesota, Accepting a Donation of Fencing from Alan Ritchey,
Incorporated.
RESOLUTION NO. 6206
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA
ACCEPTING A DONATION OF FENCING FROM ALAN RITCHEY,
INCOPORATED
WHEREAS, on November 6, 2002, the City Council adopted Resolution
No. 5794, which established procedure relating to the receipt of gifts and
donations by the City; and
WHEREAS, Resolution No 5794 specifies that donations of real property
shall be accepted by resolution of the City Council, and shall require a two-thirds
majority of the Council for acceptance; and
WHEREAS, Alan Ritchey, Incorporated has generously donated
approximately 280' of fencing with a value in excess of $40,000, which will be
used to in the city's park system; and
WHEREAS, such a donation will help improve park facilities and enhance
the overall quality of like in Shakopee.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SHAKOPEE, MINNESOTA, that the donation of fencing from Alan
Ritchey, Incorporated is gratefully accepted; and
FURTHER, the fencing shall be used in the city's park system, which is
consistent with the wishes' of the donor.
FURTHER, the City staff is directed to send a letter to the donor,
acknowledging receipt of the gift and expressing the appreciation of the City
Council.
Adopted in adjourned regular session of the City Council of the City of
Shakopee, Minnesota, held this 15th Day of March, 2005.

Subject: Letter of Agreement for Acceptance of Fencing
Dear Mr. Larsen,
I want to thank you, Mona Gansen, and Alan Ritchey, Incorporated for offering to donate
the substantial fencing that you have in your Shakopee facility to the City of Shakopee
for use in our park system. As we discussed on Friday, the city can definitely reuse this
fencing in our park system to replace several older backstops. I am providing this letter
of agreement to formalize our acceptance of the donation, and to provide release of
liability for Alan Ritchey, Incorporated,
It is understood that Alan Ritchey, Incorporated desires to donate approximately 280 feet
of fencing that is currently installed in your Shakopee facility, located at 5825 11th
Avenue East. As part of the acceptance, City of Shakopee Public Works staff would
disassemble the fencing, poles, and gates, and remove them from your facility.
Alan Ritchey agrees to allow City of Shakopee staff to access your property for this
work, disassemble the fencing, remove it from your property, and reassemble it at
locations to be selected by the City of Shakopee.
It is also understood that the City, in accepting the donation of the fencing, releases Alan
Ritchey, Incorporated from any and all claims that might arise out of the City's work
related to disassembly of the fencing, removal from the property, installation at locations
to be selected by the City, and reuse of the fencing. The City further agrees to defend,
indemnify, and hold Alan Ritchey, Incorporated harmless from any such claims.
The City of Shakopee is grateful for the generosity of Alan Ritchey, Incorporated in
donating this fencing to the City. Bill Egan, our Park Maintenance Supervisor will be
contacting you to schedule the removal work.
