SUBJECT: Text Amendment Regarding Registered Land Surveys (RLS)
MEETING DATE: April 5, 2005
INTRODUCTION:
Increasingly, city staff has experienced problems getting minor subdivisions that have complex metes
and bounds descriptions recorded. Scott County's stated preference is to have an RLS prepared in
these cases. To address that situation, staffis asking that the City Council consider revising City Code
Chapter 12 by deleting Sec. 12.45, Registered Land Surveys.
PLANNING COMMISSION RECOMMENDATION:
The Planning Commission reviewed the proposed text amendment at their meeting of March 3,
2005, and recommended approval unanimously.
ALTERNATIVES:
1. Approve Ordinance No. 728, revising City Code Chapter 12 by deleting Sec. 12.45,
Registered Land Surveys as presented.
2. Approve Ordinance No. 728, with revisions.
3. Do not approve Ordinance No. 728.
4. Table the matter for additional information.

ORDINANCE NO. 728, FOURTH SERIES
AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA,
AMENDING CITY CODE CHAPTER 12, SUBDIVISION REGULATIONS
THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS:
Section 1 - That City Code Chapter 12, SUBDIVISION REGULATIONS, is hereby
amended by deleting the following struckthrough language.
SEC. 12.45. RECISTERED LAND SURVEYS. No parcel ofland may be divided
through a registered land survey. If a registered land survey is designed to create more than
one (1) parcel of land, modify property lines, or combine parcels of land, the property must
be platted under this Chapter. If a registered land survey only clarifies a metes and bounds
description on a single parcel of land, platting is not required.
Section 2 - - Effective Date. This ordinance becomes effective from and after its passage
and publication.
Adopted in session of the City Council of the City of Shakopee, Minnesota, held
the day of ,2005.
