CITY OF SHAKOPEE MEMORANDUM To: Mayor and City Council Mark McNeill, City Administrator From: Mark Themig, Parks, Recreation, and Facilities Director Meeting Date: May 3, 2005 Subject: Fillmore Street Extension Feasibility Study INTRODUCTION City Council is asked to accept Resolution No. 6235, A Resolution Receiving a Report and Calling for a Hearing on the Fillmore Street Extension and Alley Improvements and move it's adoption. BACKGROUND On March 15, 2005 City Council authorized a feasibility study for Fillmore Street extension and adjacent alley improvements. Bonestroo Rosene and Anderlik completed the study as part of their contract for the Huber Park design. Although the study also included cost estimates for the park parking lots, the feasibility study considered the work for Fillmore Street extension and alley improvements independent of the parking lots for determining the feasibility, cost estimates, and estimated assessments for adjacent properties DISCUSSION The feasibility study developed cost estimates and preliminary assessments for constructing curb and gutter, installing stormwater systems, and paving Fillmore Street from First Avenue north to the beginning of the park parking lots, as well as improving the alley north of First Avenue. It also developed the cost estimates for the park parking lots and extending utilities for future development. There are four primary items that City Council should be aware of: 1. Proposed Improvements for Fillmore Street Extension The city's assessment policy, adopted by resolution of the City Council, assesses 100% of the costs for improving gravel roads to adjacent property owners. In this case, the city would be assessed 50% of the cost of Fillmore Street due to the amount of frontage, and the two other adjacent property owners would share the other half. See Appendix B. 2. Proposed Improvements to the Alley The city's assessment policy, adopted by resolution of the City Council, assesses 100% of the costs for alley improvements to the adjacent property owners. However, the feasibility study found that one property, Gesswein, would not benefit from the alley improvements. (Although the alley has frontage on the property, there is no access to the alley due to elevation changes.) Therefore, the assessment would be shared between the remaining four property owners, with the city being assessed 58% of the costs. See Appendix B. 3. Parking Lot Construction The costs for construction the parking lot would be 100% city costs andwould be paid from the Huber Park project budget. 4. City's Roadway and Street Assessments According to Mr. Voxland, the city's roadway and street assessment would be paid out of the general fund as with other roadway projects that are adjacent to park land (e.g. Vierling Drive and Lions Park). Our preliminary cost estimates that City Council reviewed in early 2005 for the park development had the total parking lot and roadway improvements estimated at approximately $341,000. If assessments remain as proposed, this study estimates that the parking lot would cost approximately $340,700. However, the $340,700 amount includes a 10% contingency and a 25% indirect cost factor, or $119,245. As part of the final design, we will need to develop more accurate cost estimates and designs to ensure the parking lots meet the overall park development budget. The attached resolution sets a date for the public hearing for this project for June 7, 2005. Approving the resolution does not order the project, nor does it commit the Council to the project. The intent of this resolution is to accept the feasibility study report and set the public hearing date. The public hearing will allow the property owners adjacent to the project area and the general public the opportunity to address any concerns with the project. REQUESTED ACTION If City Council concurs, it should, by motion, accept Resolution No. 6235, A Resolution Receiving a Report and Calling A Hearing for the Fillmore Street Extension and Alley Improvement Project. ,RESOLUTION NO. 6235 A Resolution Receiving a Report and Calling A Hearing for the Fillmore Street Extension and Alley Improvement Project Whereas, pursuant to Resolution No. 6206 of the City Council adopted March 15, 2005, a report has been prepared on the Fillmore Street Extension and Alley Improvement Project. Now therefore be it resolved by the City Council of the City of Shakopee, Minnesota: 1. The City Council will consider the Fillmore Street Extension and Alley Improvement project and all appurtenant work in accordance with the report and the assessment of abutting and benefited property for all or a portion of the cost of the improvements pursuant to Minnesota Satatues Chapter 429 at an estimated total cost of $498,000. 2. A public hearing shall be held on such proposed improvements on June 7, 2005 at 7:00 p.m. or thereafter, in the Council Chambers of City Hall at 129 South Holmes Street, Shakopee, Minnesota, and the Clerk shall give mailed and published notice of such hearing and improvements as required by law. Appendix A - Cost Estimates Appendix B - Preliminary Assessment Roll City of Carver - Downtown Improvements Page 2 Introduction On March 15,2005 the City of Shakopee adopted Resolution No. 6209 which ordered the preparation of a feasibility report to analyze the feasibility of placing concrete curb and gutter, aggregate, bituminous paving, and utilities on Fillmore Street north of First Avenue (County Road 101) to Huber Park, including reconstruction of the existing alley adjacent to Huber Park, construction of two parking lots and rough grading of the community built playground area. These improvements are part of the redevelopment plan for Huber Park, and the work associated with this phase is shaded in Figure No. 1 on the next page. This report examines the feasibility and cost effectiveness of the proposed improvements. Descriptions of the proposed improvements are found in the following sections of this report. Cost estimates and preliminary assessment rolls are provided in the Appendices, and financing considerations are provided in the cost analysis section of this feasibility report. Currently, existing Fillmore is a gravel street from First Avenue (County Road 101) to the alley at Huber Park. Fillmore will be extended to the north to serve the two proposed parking lots. Fillmore Street is proposed to be constructed at a 28 feet width as measured from face of curb to face of curb. A right turn lane is proposed at the intersection with First Avenue. Because the existing alley to the east of Fillmore Street will no longer be connected, a gravel turn-a-round is proposed. The construction of the new Fillmore Street will disturb the existing emergency access at Bluff A venue. This access will be restored with gravel. Sidewalk will be placed adjacent to the west side of Fillmore Street and connect to the existing sidewalk at First Avenue (County Road 101). Figure No. 20n the next page shows the proposed typical section for the improvements. The costs for the recommended street improvements are presented in the Cost Analysis section and Appendix A. Currently, the existing alley drains water along an inverted crown in the center and continues to the- west toa catchbasin placed in 2004. The improvements will bring this drainage to the curb line and then to new and adjusted storm sewer structures. The curb and gutter is not proposed to be constructed against the building side of the alley. The new bituminous will match into existing sidewalk and frontage in this area. Striping of new parking stalls and existing parking stalls will be part of the project. The alley is proposed to be constructed to the same section as Fillmore Street as shown in Figure No.2. The costs for the recommended alley improvements are presented in the Cost Analysis section and Appendix A. Section 3 - Parking Lots The parking lot improvements involve construction of two parking lots that will serve the community built playground and other future improvements. The playground is scheduled for construction in October 2005, and rough grading of the playground is part of the project. The parking lot improvements include construction of portions of the sidewalk and trail that will connect to existing trails in the area. Additional fill quantity within the amounts consistent with previously obtained permits will be needed for these parking lots, and it is proposed to construct the parking lots to the same section as shown in Figure No.2. The costs for the recommended parking lot improvements are presented in the Cost Analysis section ::llld Appendix A. City of Shako pee - Fillmore Street Extension and Alley Improvements Page 7 Utility Improvements The major utility improvements will be the construction of storm sewer structures and piping to convey surface water runoff from the new improvements to the existing storm sewer system in the park. Some of the drainage in the parking lots will be routed to the proposed rainwater filtration basins or gardens in the islands to help improve water quality. Rainwater gardens are becoming more widely-used method in the Metro Area for water quality. The gardens were recommended by the Environmental Advisory Commission, and their use in this situation will be evaluated in the final design of the parking lots. A sanitary sewer and water. service will be extended to the future restroom and storage building at this time. These utility improvements are shown in Figure No.3 on the next page. An existing 6-inch watermain currently ends at the hydrant on Bluff A venue. A 4- inch diameter line is proposed to be extended from this location. The size of this water service line will need to be approved by Shakopee Public Utilities. The sanitary service will be extended from the existing sewer stub placed as part of the 2004 West River Interceptor Improvements. Due to the poor condition of some of the soils in Huber Park, final design will review how the utilities are affected by these soils and any trench backfill that is needed to stabilize the piping. PllOd.M:l, 7704105 Easements and Permits Almost all of the work is proposed to be done within City right-of-way or property; however some areas of the existing parking stalls in the alley fall outside of the alley right-of-way. Permission in the form of a right of entry will be needed from the adjacent property owners to reconstruct this area outside of the right-of-way. If this right of entry cannot be obtained, then the work would need to be adjusted to stay within the existing alley right-of-way. Costs associated with right of entry acquisition would be included in the project costs and assessed. Work in the right-of-way ofPirst Avenue (County Road 101) will require a permit from Scott County. Due to the size of the project, a General Storm Water Permit for Construction Activity will be needed from the MPCA. Approval of the proposed water service extension will be needed from the Shakopee Public Utilities. City of Shako pee - Fillmore Street Extension and Alley Improvements Page 10 Cost Analysis The estimated costs of the proposed improvements are summarized in Table 1 and Appendix A. The costs in Appendix A include 10% for contingencies and 25% for indirect costs. The City's policy is to assess 100% ofthe proposed improvements, and preliminary assessment rolls are presented in Appendix B based on this policy. It is anticipated that storm sewer improvements, water service, and sewer service will be funded by combinations of the General Storm Sewer Fund and Huber Park project funding. As discussed above, it is proposed to assess benefit for the street and alley improvements on a front footage basis in accordance to the City's Policy. The estimated amount of assessable front footage for Fillmore Street and the alley is approximately 560 and 519 feet, respectively. NO. PROJ. HD. 7704105 Recommendations and Conclusions The improvements described in this report are feasible from and engineering standpoint. This project is necessary to provide access, parking, and utility improvements to Huber Park and adjacent properties. The project is cost effective based on conditions and acceptable standards proposed to construct the improvements. The estimated cost of the improvements is $498,000. The following recommendations are presented for consideration of Shakopee City Council and Staff: 1. That the improvements presented herein be considered for 2005 construction. If the improvements were completed, the cost is estimated at $498,000. 2. That the City Council review assessing the benefited properties in accordance with the City's assessment policy and as described herein, with the City reviewing the percentage used for the assessment. Under Chapter 429, the City is limited in assessing the benefit of the improvements to the adjacent properties and should review this based on the City policy. 3. That a public hearing be held to discuss the proposed improvements and assessments. 4. That the City review the improvements in the alley parking area outside of the alley right-of-way with the adjacent property owners and get permission to reconstruct this area. The following schedule is proposed to meet this requirement. The project schedule can be modified if the City requests it based on timing of notices to the Local Paper. APPENDIX B - Page 1 of 1 LICENSE AGREEMENT THIS LICENSE AGREEMENT is made and entered into this _ day of , 2005, by and between CITY OF SHAKOPEE, a municipal corporation under the laws of Minnesota, having its principal office at 129 South Holmes Street, Shakopee, MN 55379 ("City"), and Norman Shutrop and Janet Shutrop, husband and wife, residing at 6865 Eagle Creek Boulevard, Shakopee, Minnesota 55379 ("Shutrops"). WHEREAS, the City acquired certain real estate in the City of Shakopee, County of Scott, State of Minnesota, which is legally described on the attached Exhibit A and incorporated in this License Agreement (the "Property") for park and other purposes; WHEREAS, prior to the City owning the Property, the Shutrops had conducted farming operations on the Property; WHEREAS, the City has agreed to allow the Shutrops on the Property for the purposes of conducting farming operations until the City is ready to utilize the Property for park and/or other purposes; and NOW THEREFORE, the parties agree as follows: 1. Access. The City grants to the Shutrops, with respect to such title and interest as the City may have in the Property, and upon the terms and conditions stated below, on a revocable, non- exclusive basis, the permission and right to access and use the Property for Farming Operations. "Farming Operations" are defined exclusively as the growing, producing, raising or keeping of plants or the primary products of those plants; the clearing, draining, irrigating or cultivating of the Property; the use of farm machinery, equipment or devices; or the application of fertilizers, manure, pesticides or biological control agents by ground spraying. The Shutrops shall not construct any structures or improvements on the Property without the written consent of the City. Such right of access and use is granted only for the term of this License as set forth below, and only for the purposes set forth above. 2. Term. This License shall tenninate upon the City giving the Shutrops actual written notice of such termination at least ninety (90) days prior to termination. The Shutrops may terminate this License by giving the City actual written notice of such termination at least thirty (30) days prior to actually vacating the Property. 3. License Fee. The Shutrops shall pay a license fee to the City of $1.00 prior to entry upon the Property. 4. Safety and Maintenance. The Shutrops agree to: a) keep the Property in a sightly condition at all times, at the Shutrops' sole expense; b) keep the entire Property free from all rubbish, waste, dirt, debris and obstructions of any sort; c) keep the Property in a condition as required by law, including by the ordinances of the City of Shakopee. The Shutrops also agree not to use the Property for the production, storage, deposit or disposal of toxic, dangerous or hazardous substance pollutants, wastes or contaminations, including but not limited to, nuclear fuel or wastes or wastes that are considered hazardous by law and regulations. To the fullest 262038vl (SJS) 1 SH155-23 extent permitted by law, the Shutrops shall indemnify the City, its officials, employees, agents and other acting on City's behalf, hold it harmless and defend and protect it from and against any and all loss, damage, liability, claim, cost or expense (specifically including attorneys' fees and other costs and expenses of investigation and defense), of any sort, resulting from injury or death to any person or from loss of or damage to any property, however caused, which occurs on the Property with respect to the production, storage, deposit or disposal of toxic, dangerous or hazardous substance pollutants, wastes or contaminations. 5. Hold Harmless and illdemnitv. The Shutrops, their employees, agents and assigns agree to indemnify, defend and hold harmless the City, its agents, city officials, employees, successors and assigns from any and all claims, losses, damages, liabilities, causes of action, judgments, costs or expenses because of personal injury, death or property damage caused by Shutrops' use ofthe Property or the Shutrops' Farming Operations on the Property. 6. illsurance. The Shutrops agree to fully insure the Property throughout the term of the License Agreement and to list the City as an "additional insured" on their insurance policy for the Property. The Shutrops agree to provide and maintain at all times during the term of the License Agreement insurance coverage for the Property with a general liability policy limit of at least $500,000.00 each occurrence, applying to liability for bodily injury, personal injury and property damage. On execution of the License Agreement, the Shutrops shall provide the City with evidence that the insurance coverage required hereunder will be in full force and effect during the License Agreement term. ill the event that any insurance renews or is terminated during the License Agreement term, the Shutrops shall promptly provide the City with evidence that such coverage will be renewed or replaced upon termination with insurance that complies with these provisions. Such evidence of insurance shall be in the form of a standard Certificate of illsurance, or in other such form as the City may reasonably request, and shall contain sufficient information to allow the City to determine whether there is compliance with these provisions. At the request of the City, the Shutrops shall, in addition to providing such evidence of insurance, promptly furnish the City with a complete (and if so requested, insurer-certified) copy of the insurance policy intended to provide coverage required by this License Agreement. 7. City's Reserved Rights. The City reserves the right, at any time and from time to time, to make such use of the Property as it may desire, at its sole discretion and for any purpose. ill the exercise by the City of the foregoing rights, the City will use its best efforts not to unreasonably interfere with the Farming Operations. However, the City shall not in any event be liable for inconvenience, annoyance, disturbance, or other damage to the Shutrops, or the Farming Operations, by reason of the exercise of the foregoing rights or any other rights of the City to enter into or use the Property, and the obligations of the Shutrops under this License shall not be affected in any manner. 8. Non-exclusive License. This License is issued subject to any prior licenses, easements, leases or other such rights granted by the City for improvements of other parties. The City reserves the right to license others to install improvements in, on, or under, or along the Property provided that same shall not interfere unreasonably with the Farming Operations authorized by this License. 9. Assignment. The Shutrops shall not assign, sell, delegate, sublet, or otherwise transfer or encumber in any manner whatsoever, all or any portion of the rights, duties or obligations 262038vl (SJS) 2 SH155-23 under this License. Any such transfer or encumbrance shall be null and void and shall pennit the City to tenninate this License immediately without written notice. 10. Costs. The Shutrops shall be responsible and timely pay all fees, taxes, wages and other charges and expenses in any manner associated with the Shutrops' activities under this License. 11. Other Authority or Rights. The Shutrops shall bear the sole obligation of obtaining such other authority or rights as they may need in addition to the rights provided in this License for the Farming Operations and the use of the Licensed Premises. 12. Not to Record. The Shutrops shall not record this License with Scott County and such recordation shall permit the City to tenninate this License immediately without written notice. 13. Liens and Encumbrances. The Shutrops shall keep the Property free of all liens and encumbrances arising out of their interest in or activities on the Property. 14. Disclaimer of Warranty. The Shutrops have conducted their own investigation and inspection of the Property and are familiar with the physical condition of the Property and surrounding terrain, and are fully informed as to the existing conditions and limitations. The City makes no representation or warranty as to the suitability of the Property for use by the Shutrops and no such representation, warranty, or any other representations are made by the City or shall be implied by operation of law or otherwise. The Shutrops accept the Property in an as-is, where-is condition with all faults, defects and deficiencies. 15. Governing Law. The parties agree that the interpretation and construction of this License Agreement shall be governed by the laws of the state of Minnesota, without regard to such state's conflict of laws provisions. 16. Execution. The parties agree that an executed copy of this License Agreement is as effective as the original. 17. Amendment. This License may be amended only by a written amendment signed by both parties. 18. Relationship of Parties. Nothing in this License shall be interpreted or construed as a partnership or joint venture between the City and the Shutrops concerning the Farming Operations on the Property. This License shall not be interpreted to be any type of lease or easement to the Property and does not convey an interest in the Property to the Shutrops 19. Severance. Should any portion of this License be declared invalid and unenforceable, then such portion shall be deemed to be severed from this License and shall not affect the remainder thereof. 20. Default. If any default is made.by the Shutrops in any of the agreements contained in this License, it shall be lawful for the Licensor to declare the tennended and to enter the Property, either with our without legal process, . and to remove the Shutrops or any other person occupying the Property, using such force as may be necessary, without being liable for prosecution, 262038vl (SJS) 3 SH155-23 or for damages, and to repossess the Property free and clear of any rights of the Shutrops.
