No. 6241 IS: () r, CITY OF SHAKOPEE CONSENT Memorandum CASE NO.: 05-054 TO: Mayor and City Council Mark McNeill, City Administrator FROM: Julie Klima, Planner II SUBJECT: Approval of a Registered Land Survey (RLS) - Ryan Companies DATE: May 17,2005 INTRODUCTION Ryan Companies has submitted a request for an RLS for property that is located north of Dean Lakes Blvd and south of Highway 169. This property was previously platted as Lot 1, Block 3, Dean Lakes Second Addition (please see Exhibit A for location). BACKGROUND The property in question is Business Park (BP) Zone. The BP Zone allows one acre (minimum) lots, with 100 foot lot widths and 80% maximum impervious surface percentage. The purpose of the request is to reconfigure the existing lot in order to create the parcel that will be sold to Open Systems (Tract A). The proposed lots would exceed the minimum lot widths and minimum lot size requirements. Any development on the parcels would be required to comply with the maximum allowed lot coverage. Because this is a previously platted lot, park dedication fees are not applicable. Shakopee Public Utilities (SPUC) has commented that perimeter easements should be obtained now or upon final platting. SPUC has also noted that easements shall be granted for the watermain as necessary with the approved watermain plans. City Engineering has provided comments (Exhibit C). In those comments, the Engineering Dept. is recommending approval subject to the conditions outlined in the memo attached. Centerpoint Energy has commented that the RLS should reference easement document no. 62189 along the northern area of the property. AL TERNATIVES 1. Approve the requested Registered Land Survey, Resolution No. 6241, subject to conditions as proposed. 2. Approve the requested Registered Land Survey, Resolution No. 6241, subject to revised conditions. 3. Do not approve the Registered Land Survey. 4. Table action on this item and request additional information from the applicant and/or staff. ACTION REQUESTED Offer Resolution No. 6241, a Resolution approving the Registered Land Survey, and move its approval. g:\cc\2005\05-17\ryanrls05054.doc RESOLUTION NO. 6241 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA, APPROVING THE REGISTERED LAND SURVEY FOR RYAN COMPANIES WHEREAS, Ryan Companies, property owner and applicant, has submitted a request for a Registered Land Survey for property that is located north of Dean Lakes Blvd. and south of Highway 169; and WHEREAS, the property upon which the request is being made is legally described as: Lot 1, Block 3, Dean Lakes Second Addition, Scott County, Minnesota; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, as follows: That the Registered Land Survey submitted by Ryan Companies is hereby approved, subject to the following conditions: 1. Any proposed structure(s) on either parcel shall comply with all applicable design and performance standards as stipulated in the City Code, unless otherwise approved through the variance or PUD process. 2. Payment of Trunk storm Water Charges and Trunk Storm Water Storage and Treatment Charges shall be made, as required by the most current City of Shakopee Fee Schedule. 3. Provide electronic (Auto CAD) files ofthe RLS to the City Engineering Department. 4. Easements shall be provided as approved by the City Engineer. They shall include, but not be limited to, the following: a. Provide a minimum of five feet of drainage and utility easement adjacent to the easternmost property line of Tract A. b. Provide a minimum of five feet of drainage and utility easement adjacent to the westernmost property line of Tract B. 5. The City of Shakopee shall retain all existing rights-of-way and all existing easements. 6. Submit a revised survey prior to recording that includes easement Document No. 62189. 7. Easements shall be provided as required by Shakopee Public Utilities for watermain purposes. BE IT FURTHER RESOL YED, that the Mayor and City Clerk are hereby authorized and directed to approve and accept said Registered Land Survey. After reviewing the above referenced application, we have the following comments for the applicant and the planning department: General 1.
