SUBJECT: Request of Shakopee Catholic Cemeteries Board to have the City of
Shakopee Acquire Right-of-way

INTRODUCTION:
Staff has received the attached petition from the Shakopee Catholic Cemeteries Boardrequesting that
the City exercise its authority to acquire right-of-way that would provide access to the Calvary
Cemetery for members ofthe public.
DISCUSSION:
On August 16, 1994, the Shakopee City Council adopted Resolution No. 4056 vacating Hauer Trail
east of Jasper Road and Jasper Road from Hauer Trail to County Road 16. Prior to adoption ofthe
resolution, public hearing notice was sent to several affected property owners, including Catholic
Cemeteries c!oJames Schoenberger. At the time, there was no comment for the record from Catholic
Cemeteries. (Accompanying this memo is information from that vacation action for background
purposes)
While the Calvary Cemetery technically has access from County Road 16, because of the slopes on the
property, as a practical matter, access cannot be utilized for internment and reviewal purposes.
Apparently the Cemeteries Board has not been able to secure a right to access from the adjoining
property owner, and thus is requesting that the City Council exercise its eminent domain authority to
acquire public access.
ALTERNATIVES:
1. Offer and pass a motion directing staff and the City Attorney to initiate eminent domain
proceedings to acquire right-of-way in order to provide public access to Calvary Cemetery.
2. Do not approve the request.
3. Table the item for additional information

For Acquisition by the City of Shakopee
Of Public Right-of-Way
We, the undersigned, on behalf of the Shakopee Catholic Cemeteries Board,
hereby petition the City of Shakopee to exercise its power and authority to acquire right-
of-way by purchase,. eminent domain, or such other means as may be appropriate for the
following public purpose: Providing vehicular and pedestrian public access to Calvary
Cemetery located at the east end of Hauer Trail.
The cemetery is a place where the public comes to enter and pay respects to their family
members and other loved ones. Currently, useable public access is not available for these
purposes. Because the cemetery cannot now be accessed, we ask that the City act as
promptly as possible on this request as legally feasible.

.WHEREAS, it has been made to appear to the Shakopee City Council that Hauer Trail
east of Jasper Road and Jasper Road from Hauer Trail to County Road 16 serves little public use
or . interest; . and
WHEREAS, a public hearing has been held regarding the vacation of Hauer Trail and
Jasper Road and two weeks published and posted notice thereof was given; and
WHEREAS, the Shakopee City Council wishes to retain drainage and utility easement
within the vacated right-of~way; and
WHEREAS, the public hearing to consider the action to vacate Jasper Road was held
in the Council Chambers of the City Hall in the City of Shakopee at 7:30 P.M. on the 7th of
June, 1994; and
WHEREAS, the public hearing to consider the action to vacate Hauer Trail was held in
the Council Chambers of the CitY Hall in the City of Shakopee at 7:30 P.M. on the 16th of
August, 1994; and
WHEREAS, two weeks published notice has been give in the SHAKOPEE VALLEY
NEWS and posted notice has been given by posting such notice on the bulletin board on the main
floor of the. Scott County Courthouse, the bulletin board at Shakopee Public Utilities, the bulletin
board at the'U.S. Post Office, the bulletin board at the Shakopee Public Library, and the bulletin
board in the Shakopee City Hall; and
WHEREAS, all persons desiring to be heard in the matter were given an opportunity to
be heard. at the public hearing in the Council Chambers in the City of Shakopee.
NOW,..THEREFORE, BE IT RESOLVED BY THE CITY COUNca OF THE CITY
OF .SHAKOPEE, MINNESOTA:
1. That it fmds and determines that the vacation hereinafter described is in the public
interest;

dedicated in deed document No. 103462 which lies southerly of the south right-of-way

of the southeast right-of-way line of Jasper Road, according to the record plat of
HAUER'S 4TH ADDITION, serves no further public need;

Attached is Resolution No. 4034, a resolution setting a public hearing to consider the vacation
of Hauer Trail east of Jasper Road.
BACKGROUND:
On June 7, 1994 the City Council of Shakopee held a public hearing to consider the vacation of
Jasper Road from County Road 16 to Hauer Trail. At that hearing, the resident on the northwest
comer of Hauer Trail and Jasper Road indicated that he would prefer that both Jasper Road and
Hauer Trail ,east of Jasper Road be vacated and a driveway constructed on the vacated right-of-
way for access. The City Council directed staff to prepare a resolution and legal description for
the vacation. .
While preparing the resolution, staff realized that' the, public hearing and legal notice did not
include vacating Hauer Trail. The City Attorney has advised that a' public hearing and legal
notice would be required prior to vacating Hauer Trail. . The attached resolution sets the public
hearing for August 16, 1994.

SUBJECT: Vacating Jasper Road

INTRODUCTION:
By Resolution No. 4001, the City Council of Shakopeehas set a public hearing to consider the
vacation of Jasper Road for June 7, 1994 at 7:30 P.M. or thereafter.
BACKGROUND:
On May 3, 1994, the City Council of Shakopee adopted Resolution No. 4001 which initiated the
vacation process for Jasper Road from Hauer Trail to County Road 16. The vacation .of Jasper
Road.was requested by staff due to extremely high maintenance costs associated with Jasper
Road.
Jasper Road is scheduled for reconstruction in 1997 in the Capital ImprovementPlan adopted by
City CounciIlast October.
Staff has presented the vacation of Jasper Road to. the Planning Commission as required by law.
The Planning Commission passed a motion finding the vacation of Jasper Road to be in
compliance with the Comprehensive Plan.
Jasper Road is currently utilized by one residence for access to their driveway. Staff has explored
three alternatives for vacating Jasper Road while still maintaining access. These alternatives are
to construct a cul-de-sac on Hauer Trail, to leave Hauer Trail a dead end street or to turn Hauer
Trail into a dead end alley. . Staff will give a presentation of all options at the public hearing.
The costs for each alternative are as follows:

Dead End Alley $19,566.25
The current Roadway Design Criteria requires dead end streets to have cul-de-sacs for turning
. around. The dead end street alternative was considered since Hauer Trail does not currently
conform to design standards in regards to width and section, and will. need to be reconstructed
to bring the roadway up to current standards. The dead end roadway could be eliminated with
a cul-de-sac when the road is rebuilt.
The dead end alley option was considered based on the assumption that it would be less
expensive than a cul-de-sac. The cost estimates show little difference in the cost of a cul-de-sac
and a dead end alley, while a cul-de-sac is a more preferable option. With this,. staff is
recommending constructing a cul-de-sac on Hauer Trail with driveway access to the residence
at the corner of Hauer Trail and Jasper Road.
Due to the presence of numerous utilities in the Jasper road right-of-way, staffis recommending
retaining permanent drainage and utility easements for the entire area of the Jasper road right-of-
way.
Since Jasper Road was acquired from Eagle Creek Township, and is in unplatted lands .of
Shakopee, the preparation of a resolution vacating the roadway and the associated legal
description will require extensive research. Staff is seeking direction from Council as to which
vacation option is preferred before time is spent researching the legal description.
ALTERNATIVES:
1. Vacate Jasper Road and construct a cul-de-sac on the end of Hauer trail.
2. Vacate Jasper Road and leave Hauer Trail as a dead end street.
3. Vacate Jasper Road and construct a dead end alley in the Hauer Trail right-of-way.
4. Do not vacate Jasper Road.
5. Table the vacation of Jasper Road to obtain additional information from staff.
RECOMMENDATION:
Staff recommends Alternative No. 1.
ACTION REQUESTED:
Direct staff to prepare the resolution and legal description for vacating Jasper Road as described
in Alternative No.1, and report back to City Council with the completed resolution for action
by the City Council.

INTRODUCTION:
By Resolution No. 4001, the City Council of Shakopee has set a public hearing to consider the
vacation of Jasper Road for June 7, 1994 at 7:30P.M. or thereafter.
BACKGROUND:
On May 3, 1994, the City Council of Shakopee adopted Resolution No. 4001 which initiated the
vacation process for Jasper Road from Hauer Trail to County Road 16. The vacation of Jasper
Road was requested by staff due to extremely high maintenance costs associated with Jasper
Road.
Jasper Road is scheduled for reconstruction in 1997 in the Capital Improvement Plan adopted by
City Council last October.
Staff has presented the vacation of Jasper Road to the Planning Commission as required by law.
The Planning Commission passed a motion finding the vacation of Jasper Road to be in
compliance with the Comprehensive Plan.
Jasper Road is currently utilized by one residence for access to their driveway. Staffhas explored
three alternatives for vacating Jasper Road while still maintaining access. These alternatives are
to construct a cul-de-sac on Hauer Trail, to leave Hauer Trail a dead end street or to turn Hauer
Trail into a dead end alley. Staff will give a presentation of all options at the public hearing.
The costs for each alternative are as follows:

Cul-de-sac $20,088.75
- Dead End Street $12,856.25
Dead End Alley $19,566.25
The current Roadway Design Criteria requires dead end streets to have cul-de-sacs for turning
around. The dead end street alternative was considered since Hauer Trail does not currently
conform to design standards in regards to width and section, and will need to be reconstructed
to bring the roadway up to current standards. The dead end roadway could be eliminated with
a cul-de-sac when the road is rebuilt.

A RESOLUTION SETTING THE PUBLIC HEARING DATE
TO CONSIDER THE VACATION OF
JASPER ROAD, BETWEEN COUNTY ROAD 16
AND HAUER TRAIT.,
WHEREAS, it has been made to appear to the Shakopee City Council that Jasper Road
located between County Road 16 and Hauer Trail serves no public use or interest; and
WHEREAS, a public hearing must be held before an action to vacate can be taken and
two weeks published and posted notice thereof must be given.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SHAKOPEE, MlNNESOTA, that a hearing be held in the Council Chambers on the 7th day
of June, 1994 at 7:00 P.M. or thereafter, on the matter of vacating Jasper Road, between County
Road 16 and Hauer Trail.
WHEREAS, two weeks published notice will be give in the SHAKOPEE VALLEY
NEWS and posted notice will be given by posting such notice on the bulletin board on the main
floor of the Scott County Courthouse, the bulletin board at the U.S. Post Office, the bulletin
board at the Shakopee Public Library, and the bulletin board in the Shakopee City Hall.

TO WHOM IT MAY CONCERN:
Notice is hereby given to the affected property owners and the
public that the city council of the city of Shakopee will hold a
public hearing on Tuesday, June 7, 1994, at 7:00 P.M., or
thereafter, in the Council Chambers of city Hall at 129 South
Holmes street, to consider the vacation of Jasper Road from County
Road 16 to Hauer Trail, to which the city of Shakopee has asserted
a claim.
All persons interested in said vacation will be given an
opportunity to be heard.
