SUBJECT: Applications for Taxicab and Taxicab Driver's License

INTRODUCTION:
City Council is asked to hold a public hearing and take action on
on applications from Terry Busch (doing business as Southwest
Metro Taxi) for a taxicab license and for a taxicab driver's
license.
BACKGROUND:
Mr. Busch has applied for a taxicab license and for a taxicab
driver's license to operate within the City of Shakopee. He is
not licensed in another community so does not qualify for the
exception from obtaining a license as provided for in the city
code. (His application indicates that he is applying for a
license in Prior Lake as well.) Before Mr. Busch completes a
number of requirements outlined in the City Code in order to
obtain licenses, he desires to know that he can obtain a license.
Should his applications be approved by City Council, he intends to
purchase new mini vans, install taximeters, have the vehicles
inspected, and provide proof of insurance among other
requirements.
Pursuant to the City Code, notice of the required public hearing
has been given to the applicant and to all licensees (Oscar Salas
dba Shakopee Taxi) and notice has been published in the City's
official newspaper. The applicant plans on attending the May 17th
meeting.
The police department has conducted the required background
investigation and has advised that there is no reason to preclude
Mr. Busch from obtaining licensure through the City of Shakopee.
RECOMMENDED ACTION: After holding a public hearing and if Council
concurs:
Approve the applications and grant a taxicab license for two
taxicabs and a taxicab drivers license to Terry Busch dba
Southwest Metro Taxi, 753 Lupine Court, conditioned upon meeting
all requirements of the City Code for said licenses.

H. Such further information as the Council may require.
Subd. 4. Public Hearina. Upon the filing of an application, the City Clerk shall set a time and
place for a public hearing before the Council. Notice of such hearing shall be given to the applicant
and to all licensees. Due notice shall be given in the legal newspaper at least ten (10) days prior to
such hearing.
Subd. 5. Issuance of Taxicab Licenses.
A. If the Council finds that further taxicab service in the City is desirable for the. public
convenience and necessity and that the applicant is fit, willing,.and able to perform
such public transportation and to conform to the provisions of this Section, the
Council shall grant a license stating the name and address of the applicant and the
number of vehicles authorized under said license; otherwise, the application shall
be denied.
B. In making the above findings, the Council shall take into consideration the number
of taxicabs already in operation.
C. The City shall issue a numbered identification tag which shall be displayed upon
the rear exterior of each licensed vehicle at all times during the license period.
Subd. 6. Bond or Insurance.
A. No license shall be issued or continued in operation unless there is in full force and
effect a liability insurance policy for each vehicle authorized in the amount of
$100,000.00 for bodily injury to anyone person, in the amount of $300,000.00 for
injuries to more than one person which are sustained in the same accident, and
$50,000.00 for property damage resulting from anyone accident. Said insurance
shall inure to the benefit of any person who shall be injured or who shall sustain
damage to property proximately caused by the negligence of a holder, the holder's
servant, or agents. Notwithstanding any other provision of this Chapter, the
insurance coverage need not extend for the exact .term of the license if the
applicant or licensee also operates similar service in other cities.
B. The Council may in its discretion allow the holder to file in lieu of an insurance
policy a bond or bonds issued by a surety company authorized to do business in
the State of Minnesota.
C. If the applicant for a license under this Section had qualified as a self-insurer under
MSA ~ 170.52 as amended and has filed with the City Clerk a certified copy or a
duplicate original of the self-insurance certificate issued by the State Commissioner
of Highways, then no policy of insurance or surety bond shall be required to be
filed with the City.
Subd.7. Taxicab License Fees. No license shall be issued or continued in operation unless the
holder thereof has paid the annual license fee as prescribed by resolution.

It is my belief that Shakopee's growth has surpassed the
daily capabilities of one taxi company. In contacting just a '
small portion of the businesses in Shakopee, along with
the business, I feel my efforts will help satisfy their taxi
needs. Every business contacted has a need for more
options at all times of the day.

Shako pee City Council,
We too support allowing another Taxi company service the Shakopee
Area. During busy times, it is not always easy to get transportation
in a timely manner for a reasonable price. It's always nice to have
choices.

area. I believe it would only enhance the coverage and service currently provided, along

To Whom It May Concern:
This letter is written to support the view that Shakopee needs more
taxicab service available for residents as well as for patrons of
Shakopee businesses. We at Turtle's have found it difficult to get
service later in the evening, unless we call a competitor from another
town, in which case a hefty minimum fare is incurred.
Competition in any marketplace is good for the consumer, in this case
primarily Shakopee residents. I would be. in favor of another taxicab
company operating in Shakopee, and would use it extensively.
I would hope that the decision to allow or disallow another taxi service
would have nothing to do with the fact Scott County runs a service
already. This service is available only limited hours. Also, I believe
the free enterprise system should be allowed to work it's course to
provide transportation to those in need, rather than a government
subsidized program costing us all thousands of dollars.

Shakopee City Council,
We would like to see another Taxi Company service in Shakopee. As Shakopee is a
growing area with more businesses and residents moving into the area. We feel another
Taxi Company service would help speed our customer demands.

Dear City Council,
This letter is to support Terry Busch in the process of starting a local taxi service. I have customers that have a
very hard time getting a taxi in Shakopee. The waiting time is over a hour or longer. Terri Busch did sober cab
for the local bars in Shakopee during the Holidays this last year and many years in the past. As a business owner
it is very important to keep in mind the safety of our customers. Please allow us to have other options in Shakopee.

Paradise Auto, LLC. would certainly support allowing another Taxi service to the
greater Shakopee area. We believe it would greatly benefit the area. Due to the
high number of accidents and injuries that result from people wanting to drive
intoxicated because of the shortage of taxi services. This services would also
benefit residents and local businesses as well.

Dear City Council,
It has come to my attention that a Shakopee resident is in the process of starting a local taxi service.
Please let me explain how much I am in support of this effort. I have customers repeatedly tell me that
they have tried to contact current services from and around the area with no luck. Even members of my
staff have tried, with the same outcome. I feel it is very important for my business to have this option
available to my patrons. Take into consideration the growth of this community, we need more options.
The taxi's in the bigger Cities can't and most ofthe time won't service our area.
