CITY OF SHAKOPEE Memorandum CASE LOG NO.: 12 -034 TO: Mayor and City Council Mark McNeill, City Administrator FROM: Julie Klima, Planner II SUBJECT: Preliminary and Final Plat of Shakopee Catholic Community Plat land Conditional Use Permit for Senior Housing MEETING DATE: November 20, 2012 REVIEW PERIOD: August 9 to December 7, 2012 ACTION SOUGHT Offer and pass Resolution No. 7255, a resolution approving the preliminary and final plat of Shakopee Catholic Community Plat 1 and Conditional Use Permit for Senior Housing. This action has no immediate budget impact. INTRODUCTION Trident Development LLC has submitted an application for preliminary and final plat approval of Shakopee Catholic Community Plat 1 and Conditional Use Permit approval for Senior Housing. The subject property is located north of Thrush Street and west of Independence Drive. The subject size is approximately 10 acres and proposes the creation of a lot and an outlot. The Senior Housing facility proposes the construction of a facility that would house 84 living units, as well as, common areas such as dining, wellness center and other gathering areas. Please see the attached Planning Commission reports for further detail on the proposed use. PLANNING COMMISSION RECOMMENDATION & DISCUSSION The Planning Commission reviewed the request for preliminary plat and CUP approval at its October 4 and November 8 meetings and has recommended approval, subject to conditions, of the plat and the CUP to the Council by a 3 -2 vote. Copies of the Planning Commission reports are attached for your reference. The Planning Commission discussion included questions from the Commission regarding construction materials and building design. Specifically, Commission Collins suggested design elements, such as the use of cultured stone and Lighter colors that could be utilized to minimize the scale of the building. Staff assured the Planning Commission that building materials would be reviewed at the time of building permit to ensure conformance with the City Code requirements. Since the Planning Commission review, the applicant has provided a revised preliminary and final plat drawing (See attached Exhibit CC -1). The revised plat drawing proposes to "square up" Lot 1, Block 1. This enables the resulting parcels to be more uniform in their configurations. This revision does not have any impact on the site plan. The site plan remains unchanged from what was reviewed by the Planning Commission on November 8. The applicant has submitted a letter (see attached Exhibit CC -2) requesting a reduction in the park dedication fees that would be due for this project. Based on the adopted fee schedule, this project would have a total park dedication fee of $373,800 (84 units @ $4450 per unit). The applicant is requesting that 1 the park dedication requirement be reduced based on the negligible impact it feels the residents of this facility would have on the City's park system. If the Council wishes to reduce the amount payable for park dedication fees, it will need to propose a revised condition to the draft conditions of approval regarding park dedication payment. ALTERNATIVES 1. Offer and pass Resolution No. 7255, a resolution approving the preliminary and final plat of Shakopee Catholic Community Plat 1 and a Conditional Use Permit for Senior Housing, subject to the conditions proposed. 2. Approve the Preliminary and Final Plat of Shakopee Catholic Community Plat 1 and a Conditional Use Permit for Senior Housing, subject to revised conditions. 3. Deny the Preliminary and Final Plat Shakopee Catholic Community Plat 1 and a Conditional Use Permit for Senior Housing. 4. Table a decision on the Preliminary and Final Plat of Shakopee Catholic Community Plat 1 and a Conditional Use Permit for Senior Housing and request additional information from staff and/or the applicant. The following procedural actions must be completed prior to the recording of the Final Plat: A. Execution of a Developer's Agreement, which will include provisions for security for public improvements within the Final Plat and the engineering review fees. B. Payment to the City of Trunk Sanitary Sewer Charges, as required by the most current City of Shakopee Fee Schedule. C. Payment to the City of Trunk Storm Water Charges and Trunk Storm Water Storage and Treatment Charges, as required by the most current City of Shakopee Fee Schedule. D. Payment to the City of all storm water management plan review charges, as required by the most current City of Shakopee Fee Schedule. E. Payment of park dedication fees in lieu of land dedication shall be paid in an amount consistent with the most current City of Shakopee Fee Schedule at the time of recording of the final plat. 3 F. The proposed subdivision, as a whole, will not exceed an average impervious surface percentage of 60 %. G. The shared access for Lot 1, Block 1 and Outlot A will be a private drive and the City shall be provided a copy of the permanent access easement and maintenance agreement prior to the recording of the plat. H. No additional access, other than the one being provided by this subdivision, to Independence Drive will be allowed for the future development of Outlot A. I. All storm sewer will be private. J. The applicant will obtain a private drainage easement/arrangement from the Shakopee Area Catholic Schools for the use of their storm drainage system to accommodate drainage from the All Saints Addition. A copy of the recorded easement/agreement will be submitted to the City. If an easement/agreement cannot be obtained, the applicant and the city can investigate the ability to connect to the public storm sewer system in Independence Drive. K. Provide electronic files (AutoCAD and Adobe Acrobat formats) of the Final Plat to be recorded with datum on the Scott County Coordinate system. L. Right -of -way, in the form of a sight triangle fifteen (15) feet in dimension, will be provided at the intersection of Independence Drive and Thrush Street. M. Easements need to be shown on the Final Plat as approved by the City Engineer. II. Following the recording and the release of the Final Plat, the following shall apply: 1. Trees are required to be planted as follows: a) A minimum of four feet from impervious surfaces. b) A minimum of ten feet from property lines. c) Not in easements containing utilities. d) Not in City owned right -of -way. e) Not below overhead utilities. f) Not below high water levels (HWL) in existing or created ponds or wetlands. g) No planted tree species shall comprise more than 30% of the total quantity of trees to be planted on the site. h) Consistent with the Shakopee Tree Planting Guidelines i) Ash (Fraxinus sp.) and Colorado Blue spruce (Picea pungens) are not allowed to be planted. 2. The developer should implement the use of Best Management Practices for erosion control and storm water management during construction. NOW, THEREFORE, BE IT FURTHER RESOLVED, by the City Council of the City of Shakopee, Minnesota adopts the following findings and that the Conditional Use Permit for Senior Housing is hereby approved subject to the conditions listed: Finding #1 The City has not received any evidence that the use would be injurious to the properties in the immediate vicinity nor that it would substantially diminish or impair property values in the immediate vicinity. 4 Finding #2 The establishment of the conditional use would not impede the development and improvement of the surrounding vacant property for uses allowed in the area. The proposal considers and plans for the eventual development of the surrounding vacant parcel. Finding #3 Adequate utilities, access roads, drainage, and other necessary facilities have been or will be provided with the development of the site. Finding #4 The Board of Adjustment and Appeals has determined that this use is similar to those already permitted by conditional use permit in the Urban Residential (R -1B) Zone and should be allowed through the review process of a Conditional Use Permit (CUP). Finding #5 The proposed use is not in conflict with the comprehensive plan as the Board of Adjustment and Appeals has determined this use to be similar to those already permitted by conditional use in this zoning district. 1. The site shall be developed in general conformance with the site plan dated 10/17/12. 2. The conditions of approval noted in Resolution No. PCO2 -078 shall apply unless otherwise superseded by conditions contained within this resolution. 3. All building and parking setbacks shall comply with the requirements of the underlying Urban Residential (R -1B) Zone and Section 11.61 (Parking) of the City Code. 4. Approval of the CUP does not constitute approval of signage on site. All signage shall be reviewed through the sign permit process. 5. All trash receptacles shall be fully enclosed, including a top and shall be constructed of material similar to that used for the principal building. 6. Construction materials and landscaping requirements shall be reviewed for compliance at the time of building permit review. We remain hopeful that we can complete the process and begin construction yet this fall. One of the remaining matters we continue to work through are the city fees and we are beginning to have a clearer picture of the exact figures. You are most likely aware that part of the process in a project like All Saints is a determination by the Metropolitan Council with regard to our SAC units. The Metropolitan Council views the impact of an assisted living facility to be less than other residential uses and gives a credit based on a formula it has developed. For All Saints the Met Council determined an impact of 52 housing units and I have attached the determination letter that was sent to the city on October 29. As you are aware park dedication fees are established to offset the impact of development on cities' park systems and to pay for future growth. Shakopee's current fee for All Saints has been calculated to be $373,800 ($4,450 per unit). In the case of All Saints we would respectfully comment that we will have a nearly zero impact on the city's park system and our building will likely house residents of Shakopee who have years of dedicated service to our park system through organizations like the Shakopee Lions Club. We understand in these fiscally challenging times it would be difficult for the council to eliminate the fee entirely however, All Saints has incurred unforeseen costs due to timing and changes made to the site plan at the behest of the planning commission. These costs include a drive lane extending all the way around the easterly end of the building, additional legal and engineering expenses, frost footings and additional plantings for screening. To assist in offsetting these costs and because of the negligible impact of our facility on the park system we would respectfully ask the council to view our project in the same manner as the Met Council and use the figure of 52 units in calculating the park dedication fee which would result in a fee of $ 231,400. We believe this is a balanced, reasonable and project specific approach toward a fee we do not customarily pay in full or at all in other municipalities (as a point of reference we have paid a combined total of $ 104,646 in park dedication fees on 10 projects). We look forward to a long term relationship with the city and residents of Shakopee and would like to thank you for your consideration of this matter. The subject site of the proposed development is immediately south of the Shakopee Area Catholic Schools (SACS) campus (west of Independence Drive and north of Thrush Street). The subject site is zoned Urban Residential (R- 1 B). Please see Exhibit A for the location map. The applicant is proposing to subdivide an existing 10 acre parcel into 2 lots. The resulting lots would be approximately 7 acres and 3 acres in size. The applicant is then further requesting that a CUP be approved for the resulting 3 acre parcel (which would be purchased by Trident Development) to allow for the construction of a senior housing facility. It is the intention that the remaining 7 acre parcel would continue to be owned by the Church of St. Mary. The Church of St. Mary has not indicated any immediate plans to develop their parcel and as such it is proposed to be platted as an outlot. The proposed preliminary plat is attached as Exhibit B. Attached as Exhibit C is a copy of the site plan showing how the property is proposed to be developed with building, parking and landscaping areas. The applicant's narrative is attached as Exhibit D. The applicant is proposing to construct an 84 unit senior /assisted living building. The facility is planned to include 1 bedroom, 2 bedroom, and studio units. The facility will also provide congregate dining, wellness center and other amenities /gathering areas. Please see the applicant's narrative for further details regarding the development of the site and the proposed use. The subject site was part of the CUP that was issued for the construction of SACS school. At the time of the SACS CUP review and approval, this parcel was not proposed for development and was shown as a vacant parcel on all drawings reviewed at that time. The site plan includes 80 off - street parking stalls (72 surface and 8 tuck -under garage). City Code would require 79 parking stalls. Therefore, the applicant is meeting the City's parking requirements. The site plan proposes an impervious surface percentage of approximately 61 %. The prior CUP approval for this area allows a maximum impervious surface percentage of 60 %. The Engineering Department has provided comment that the impervious surface requirement of 60% will be required to be met on the overall plat rather than being applied to individual lots. Please find attached as Exhibits E and F, copy of the comments provided by the Engineering Department and the CUP for SACS. Staff has incorporated all applicable conditions into the draft conditions of approval. The applicant has also provided a rendering of the building proposed for construction. This drawing is attached as Exhibit G. At the time of building permit submittal and review, design standards such as construction materials and landscaping requirements will be reviewed for compliance with the City Code. The Director of Parks, Recreation, and Natural Resources has provided comments attached as Exhibit H. These comments address payment of park dedication fees and planting of trees on site. Following the recording and the release of the Final Plat, the following shall apply: 1. Trees are required to be planted as follows: a) A minimum of four feet from impervious surfaces. b) A minimum of ten feet from property lines. c) Not in easements containing utilities. d) Not in City owned right -of -way. e) Not below overhead utilities. f) Not below high water levels (HWL) in existing or created ponds or wetlands. g) No planted tree species shall comprise more than 30% of the total quantity of trees to be planted on the site. h) Consistent with the Shakopee Tree Planting Guidelines i) Ash (Fraxinus sp.) and Colorado Blue spruce (Picea pungens) are not allowed to be planted. 2. The developer should implement the use of Best Management Practices for erosion control and storm water management during construction. Staff recommends that the Planning Commission recommend to the City Council the approval of the Conditional Use Permit (CUP) for Senior Housing subject to the following conditions: 1. The site shall be developed in general conformance with the site plan dated 8/7/12. 2. The conditions of approval noted in Resolution No. PCO2 -078 shall apply unless otherwise superseded by conditions contained within this resolution. 3. All building and parking setbacks shall comply with the requirements of the underlying Urban Residential (R -1 B) Zone and Section 11.61 (Parking) of the City Code. 4. Approval of the CUP does not constitute approval of signage on site. All signage shall be reviewed through the sign permit process. 5. All trash receptacles shall be fully enclosed, including a top and shall be constructed of material similar to that used for the principal building. 6. Construction materials and landscaping requirements shall be reviewed for compliance at the time of building permit review. ALTERNATIVES: 1. Recommend to the City Council the approval of the Preliminary Plat of All Saints Addition and Conditional Use Permit for Senior Housing subject to the conditions provided. 2. Project Description - Trident proposes to develop, construct and operate an 84 -unit assisted living community at the northeast corner of Independence Drive and Thrush Street. This community will offer independent living, assisted living and enhanced services living to seniors age 55 +. The building will offer a variety of one bedroom, two bedroom and studio apartment units. All Saints Senior Living will provide a full complement of contemporary amenities including congregate dining, wellness center, beauty salon and spa, great room/coffee shop, library and a formal private dining room. The enclosed submittal materials include the proposed site plan along with grading, utility and landscape plans. Also enclosed are building elevation drawings and an artist's color perspective elevation image. A discussion of the proposed site plan and landscape plan is provided below. Neighborhood Meeting - On May 3rd, 2012, Trident Development conducted an informal neighborhood meeting at the SACS elementary school, regarding the proposed All Saints Senior Living development. Direct mail invitations were sent to 73 property owners within 350 feet of the subject property. There were 6 neighbors in attendance. The neighbors were informed of the a location of the development in relation to their property, and provided considerable details of the intended site improvements. Information regarding the developer, contractor and management company was provided, along with an estimated project time line. The neighbors in attendance expressed no opposition to the proposal and, in general, seemed supportive and inquisitive. Trident does not anticipate any great opposition from the neighborhood in obtaining land use approvals. Site Plan Analysis — The site improvements have been designed to meet or exceed the design standards of the City and the anticipated uses of the property. The building observes a set -back distance from Independence Drive of 30 feet, from Thrush Street 40.2 feet, and is set 55.5 feet from the west property line. In addition to the generously landscaped grounds, the site includes a spacious and secured outdoor memory garden, a gazebo with outdoor seating and a drive -under canopy at the main entrance. The trash enclosure is intended to be constructed of concrete and fmished with a cultured stone veneer which will match the stone exterior accents of the building. Two ground- mounted signs are proposed. Each will be externally lighted and contain colors and/or materials complementary to the building. Trident will obtain a separate sign permit for the exterior signs. The primary access drive is off of Independence Drive with a 45 foot -wide, divided boulevard with landscaped center median. Secondary access is provided off of Thrush Street, utilizing two curb cuts which allows for easy traffic circulation. Consideration was given to turning movements for garbage trucks and other delivery vehicles at the rear of the building. A total of 72 surface parking stalls (including 6 HDCP spaces) plus 8 tuck -under garage bays are provided. This equals a total parking of 80 spaces, or a parking ratio of 0.95 to 1. After deducting the 21 residents in the enhanced services wing, the parking ratio becomes 1.27 to 1. This parking ratio has been demonstrated to be adequate for assisted living facilities. Parking spaces are 9'x 20' with drive lanes designed at a minimum width of 24 feet. The existing topography has a considerable amount of grade change. The proposed site plan minimizes the use of retaining walls. There are two small retaining walls designed at the east end of the site. The northerly one is 2 — 3 feet high and the southerly one is 1.5 to 2.5 feet high. By obtaining a temporary grading easement from the owner of Outlot A, a maximum slope of 3:1 can be maintained on the western end of the site. In compliance with current regulations, two infiltration basins are utilized prior to discharging into the existing storm water structures to the north. Landscape Plan Analysis - Trident has engaged the services of a professional landscape architect to design the landscape plan and specify the planting materials. The landscape plan meets or exceeds the minimum design standards of the City, with one exception — the plan does not provide for two (2) over -story trees in each parking lot island of over 200 sf. Trident requests a deviation from this standard because it is believed to be unsustainable for the trees, and the plan exceeds the minimum quantity plantings by an additional 88 plant units elsewhere on the site. The landscape plan provides for a generous quantity of deciduous shrubs, evergreen shrubs and perennials strategically placed to enhance curb appeal of the property and to soften structures such as trash enclosure, gazebo and monument signs. All disturbed areas will be restored with sod and all landscaped areas will be irrigated with an underground sprinkler system. Conclusion - Trident Development respectfully requests approval of the preliminary plat and the conditional use permit, subject to revisions and conditions as may be required by staff. Minor modifications to the storm water management plan are required to bring the plan into conformance with the City policies. I have outlined the items that will need to be addressed to bring the proposed design into conformance with the City policies. Those items are highlighted in bold text below. The storm water management plan for the development uses off -site ponding on the Shakopee Area Catholic Education Center (SACEC) property to the north to meet the City storm water regulations. The proposed off -site storm water management plan is an acceptable method to meet the City policies as long as drainage and utility easements are secured over the off -site storm sewer drainage system, overland overflow routes, and ponding area. The City will require drainage and utility easements over the parcel to the north should be secured prior to approval of the storm water management plan. If not already completed, the Engineer must revise the plat of the SACEC to show dedicated drainage and utility easements over the ponding area, overland overflow route, and storm sewer system serving the proposed, and future, development. The submitted storm water modeling of the existing pond on the SACEC site indicates a high water elevation based on the currently- proposed site improvements. Based on my review of the storm water management plan for the All Saints Senior Living site, it appears that the proposed design is based on the currently- proposed site improvements. I recommend that the comments below be addressed considering the ultimate build -out of the site, not the interim conditions. 1. The 0.3cfs \acre discharge rate control limit from the pond downstream is being exceeded. The proposed 100 - year 24 -hour event discharge rate of 8.3 cfs is approximately 0.6 cfs above the allowable discharge rate from the 25.56 acre drainage area. The Engineer must revise the pond outlet control structure so that the proposed conditions discharge rate from the downstream pond during the 100 -year 24 -hour event is 7.7 cfs in conformance with 0.3cfs \acre discharge limit. Note that City policy requires a minimum 8" orifice for rate control. 2. The storm sewer system design calculations must be revised to use the rainfall intensity design values as shown in the latest MnDOT Drainage Manual, dated August 30, 2000. It is anticipated that any modifications to bring the storm sewer design into conformance with City policies will be made by the developer's engineer. CITY OF SHAKOPEE Memorandum CASE NO.: 12 -034 TO: Shakopee Planning Commission FROM: Julie Klima, Planner II SUBJECT: Preliminary & Final Plat of All Saints Addition and Conditional Use Permit (CUP) for Senior Housing MEETING DATE: November 8, 2012 REVIEW PERIOD: August 9 to December 7, 2012 UPDATED INFORMATION The public hearing for this item was opened at the October Planning Commission meeting and continued to November in order to allow the applicant to address several issues that were identified in October. At its October meeting, Commissioner Seidensticker indicated that he will be unable to attend the November 8 meeting and would like to be able to be a part of the discussion/vote for this item. Staff has conferred with Planning Commission members and Monday, November 19 is available as a special meeting date. After opening this discussion on this item, the Commission will need to determine if it will review this item on November 8 or if it will continue the public hearing to a special meeting date of November 19. At its October meeting, the Planning Commission identified the following issues and requested that further information be provided: 1. Possibility of relocating the trash enclosure; 2. Reducing or eliminating driveway access(es) onto Thrush Street; 3. Possibility of increasing setbacks from the property lines; 4. Development plan for the proposed outlot; 5. Possibility of reducing the building height, particularly on the east end; and 6. Providing drawings that depict the views of the site from various locations. The applicant has provided the narrative (Exhibit 1) and revised site plan (Exhibit 2) in response to these identified issues. The changes to the site plan include: 1. The trash enclosure has been relocated to the front of the building. 2. One of the driveway access points has been eliminated from Thrush Street. The remaining access point is required by the Fire Department for emergency access purposes. To ensure that this access is utilized only for emergency situations, the applicant will be installing 3 break -away bollards at this access point. This will require vehicles utilizing the back parking lot to use the drive lane on the east side of the property to access the main entrance /exit point off of Independence Drive. 3. The setback along Independence Drive has been increased to 50.3 feet (previously it was proposed at 30 feet). 4. The Church will have a representative present at the November meeting to discuss its plans for the outlot area and a potential site plan is attached as Exhibit 3. 5. The applicant has confirmed that the building height for the 3 story portions of the building is 35 feet and for the 2 story portions of the building are 28 feet. 6. The drawings attached as Exhibit 4 indicate views of the proposed site from various locations surrounding the site. The applicant indicated that they would be meeting with the residents that spoke at the October meeting prior to the November meeting to present these changes. GENERAL DISCUSSION Trident Development LLC has filed applications for Preliminary & Final Plat and Conditional Use Permit (CUP) for senior housing. The subject site of the proposed development is immediately south of the Shakopee Area Catholic Schools (SACS) campus (west of Independence Drive and north of Thrush Street). The subject site is zoned Urban Residential (R- IB). Please see Exhibit A for the location map. The applicant is proposing to subdivide an existing 10 acre parcel into 2 lots. The resulting lots would be approximately 6.5 acres and 3.5 acres in size. The applicant is then further requesting that a CUP be approved for the resulting 3 acre parcel (which would be purchased by Trident Development) to allow for the construction of a senior housing facility. It is the intention that the remaining 6.5 acre parcel would continue to be owned by the Church of St. Mary. The Church of St. Mary has not indicated any immediate plans to develop their parcel and as such it is proposed to be platted as an outlot. The applicant is proposing to construct an 84 unit senior /assisted living building. The facility is planned to include 1 bedroom, 2 bedroom, and studio units. The facility will also provide congregate dining, wellness center and other amenities /gathering areas. Please see the applicant's narrative for further details regarding the development of the site and the proposed use. The subject site was part of the CUP that was issued for the construction of SACS school. At the time of the SACS CUP review and approval, this parcel was not proposed for development and was shown as a vacant parcel on all drawings reviewed at that time. The site plan includes 79 off - street parking stalls (72 surface and 8 tuck -under garages). City Code would require 79 parking stalls. Therefore, the applicant is meeting the City's parking requirements. The site plan proposes an impervious surface percentage of approximately 61%. The prior CUP approval for this area allows a maximum impervious surface percentage of 60 %. The Engineering Department has provided comment that the impervious surface requirement of 60% will be required to be met on the overall plat rather than being applied to individual lots. Please find attached as Exhibit B, a copy of the comments provided by the Engineering Department in response to the revised plans. Staff has incorporated all applicable conditions into the draft conditions of approval. At the time of building permit submittal and review, design standards such as construction materials and landscaping requirements will be reviewed for compliance with the City Code. The Director of Parks, Recreation, and Natural Resources has provided comments attached as Exhibit C. These comments address payment of park dedication fees and planting of trees on site. Criteria #1 The use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values within the immediate vicinity. Finding #1 The City has not received any evidence that the use would be injurious to the properties in the immediate vicinity nor that it would substantially diminish or impair property values in the immediate vicinity. Criteria #2 The establishment of the conditional use will not impede the normal and orderly development and improvement of the surrounding vacant property for uses allowed in the area; Finding #2 The establishment of the conditional use would not impede the development and improvement of the surrounding vacant property for uses allowed in the area. The proposal considers and plans for the eventual development of the surrounding vacant parcel. Criteria #3 Adequate utilities, access roads, drainage, and other necessary facilities have been or will be provided; Finding #3 Adequate utilities, access roads, drainage, and other necessary facilities have been or will be provided with the development of the site. Criteria #4 The use is consistent with the purposes of the zone in which the applicant intends to locate the proposed use; and Finding #4 The Board of Adjustment and Appeals has determined that this use is similar to those already permitted by conditional use permit in the Urban Residential (R -1 B) Zone and should be allowed through the review process of a Conditional Use Permit (CUP). Criteria #5 The use is not in conflict with the comprehensive plan. Finding #5 The proposed use is not in conflict with the comprehensive plan as the Board of Adjustment and Appeals has determined this use to be similar to those already permitted by conditional use in this zoning district. STAFF RECOMMENDATION: Staff recommends that the Planning Commission recommend to the City Council the approval of the Preliminary Plat subject to the following conditions: The following procedural actions must be completed prior to the recording of the Final Plat: A. Execution of a Developer's Agreement, which needs to include provisions for security for public improvements within the Final Plat and the engineering review fees. B. Payments of Trunk Sanitary Sewer Charges need to be made, as required by the most current City of Shakopee Fee Schedule. C. Payments of Trunk Storm Water Charges and Trunk Storm Water Storage and Treatment Charges need to be made, as required by the most current City of Shakopee Fee Schedule. D. Payment of all storm water management plan review charges need to be made, as required by the most current City of Shakopee Fee Schedule. E. Payment of park dedication fees in lieu of land dedication shall be paid in an amount consistent with the most current City of Shakopee Fee Schedule at the time of recording of the final plat. F. The proposed subdivision, as a whole, will not exceed an average impervious surface percentage of 60 %. G. The shared access for Lot 1, Block 1 and Outlot A will be a private drive. H. No additional access, other than the one being provided by this subdivision, to Independence Drive will be allowed for the future development of Outlot A. I. All storm sewer will be private. J. The applicant will obtain a private drainage easement/arrangement from the Shakopee Area Catholic Schools for the use of their storm drainage system to accommodate drainage from the All Saints Addition. A copy of the recorded easement/agreement will be submitted to the City. If an easement/agreement cannot be obtained, the applicant and the city can investigate the ability to connect to the public storm sewer system in Independence Drive. K. Provide electronic files (AutoCAD and Adobe Acrobat formats) of the Final Plat to be recorded with datum on the Scott County Coordinate system. L. Right -of -way, in the form of a sight triangle fifteen (15) feet in dimension, will be provided at the intersection of Independence Drive and Thrush Street. M. On October 4, 2012, our application was presented to the Shakopee Planning Commission at their regularly scheduled meeting, at which time our application was discussed at a public hearing. Based on public testimony, questions and concerns raised by neighbors residing near our project site, the Planning Commission decided to continue the public hearing until their next regular meeting on November 8, 2012. This continuation was to allow the applicant to consider and prepared a response the neighborhood concerns, specifically: • Setbacks of the structure from the property line; • the driveway accesses from Thrush St; • the proposed location of the trash enclosure; • the height of the building (particularly the east end); • master plan for the church site; • additional drawings that depict the view from various locations on/around the site once the structure is in place. Trident has discussed the neighbors' concerns with the land owner (Church of St Mary) and has determined that their conceptual future land plan would be too greatly impacted if the All Saints site were to be reconfigured, enlarged or repositioned further north. We have also consulted with our architect and civil engineer to fmd suitable ways to address the concerns listed above. The following changes have been implemented on our revised site plan: • Increased the set back from the east property line to fifty (50) feet. The building is now 67 feet from the west curb line and 90 feet from the center line of Independence Drive. EXl 4tBITi - The building is set back 40.7 feet from the south property line, which makes it 53 feet from the north curb line, 70 feet from the center line of Thrush Street, and 130 +1- feet from the nearest residence. • The increased set back referenced above, is accomplished by increasing the lot size by 9,150 +1- square feet. The total lot area has been increased from 3.38 acres to 3.56 acres. • Impervious surface area is calculated at 61.6 %, however, because the main entry drive is intended to be shared with Outlot A, there is approx. 4,400 SF of impervious surface attributable to Outlot A, which would effectively lower it to 59 %. • Eliminated driveway access from Thrush Street, except for an emergency -only access drive for fire apparatus, as required by Shakopee Fire Marshal. • Substituted spruce trees for deciduous trees along the Thrush Street to increase year - round visual screening. • Added a drive lane on the east end of the building to accommodate residential and employee traffic circulation. • Deleted the southerly monument sign originally proposed on Thrush Street. • Relocated the trash enclosure to the northwest corner of the site, out of the view of the neighbors to the south. • We have provided building height data, for both the 3 -story portions of the building and the two -story portion of the building. • Provided the conceptual master land use plan (showing future Catholic Church site plan) for the entire 10 acre plat. • We have prepared three, separate color perspective drawings providing views from: 1) south looking north; 2) from southwest looking northeast; and 3) from the northwest looking southeast. At the October 4, 2012 planning commission meeting the applicant received several comments regarding the site design. Compliance with the Woodland and Tree Management Ordinance is not required for this development given that the site does not have any existing trees. 2. Trails and Sidewalks - The preliminary plat shows adequate sidewalks within the development. No additional trails or sidewalks are required at this time. At the time of recording of final plat: 1. Park Dedication Given the near half mile distance to two parks, Cloverleaf and Green Meadows, cash in lieu of land is recommended. 2. Park dedication fees in the amount required by the City Code and adopted City fee schedule shall be paid at the time of recording of the final plat. 3. Preliminary park dedication calculations (to be confirmed at time of final plat) are as follows: 84 units x $4,450 /unit = $373,800.00 Following the release and recording of the final plat the following shall apply: 1.
