INTRODUCTION
This item is to request City Council's authorization to accept the work on Green
Meadows Park and approve the final payment to the General Contractor Chard Tiling &
Excavating, Inc.
BACKGROUND
The construction of Green Meadows Park began in 2011 with the City issuing a general
contract to Chard Tiling & Excavating, Inc. Chard Tiling & Excavating, Inc. was
responsible for all construction elements, including site work, ball diamond construction,
hockey rink construction, trails and parking lot.
The project completion date was originally November 1, 2011. The project date was
extended due to cold, dry weather that did not allow for proper turf establishment or
exterior painting. The project was reviewed in May of 2012. The majority of the park was
completed in June of 2012 however the turf establishment in the common areas and the
baseball infield has been unacceptable. The contractor made some effort to seed the
areas but with little rain the turf has not established. Per the contract, liquidated
damages could be assessed however because the contractor did make continued efforts
to correct the areas the contractor has agreed to eliminate the cost of the seed from the
amount owed. The City is therefore retaining approximately $1000 for the seed and the
Parks Department will be working to establish the turf.
The contract price was as follows:
• total bid price of the project was: $506,446.62
• Change Order #1: +$7,998.05
• Change Order #2 +$2,125.00
• Amended contract price: $ 516,569.67
The total Construction CIP allocation was $531,769.00 including 5% contingency.
The total project costs are:
• previous payments: $472,433.36
• semi -final payment total: $27,978.93
• Retainage (up to): $26,337.49
• Total Project Costs: $526,749.78
By aggressively managing the contract, we were able to keep the change order costs to
a minimum and complete the project under budget. The contractor has provided the City
with a two -year warranty bond at 50% of the improvement costs.

REQUESTED ACTION
If Council concurs, offer resolution No. 7252, A Resolution Accepting the work of Chard
Tiling & Excavating, Inc. on Green Meadows Park Improvements and Authorizing Final
Payment, project PR 2011 -1 and move its adoption.

A Resolution Accepting the Work of Chard Tiling & Excavating, Inc. on Green
Meadows Park Improvements and Authorizing Final Payment, project PR 2011 -1
Whereas, pursuant to a written contract, signed with the City of Shakopee on
June 14, 2011, Chard Tiling & Excavating, Inc. has satisfactorily completed the Green
Meadows Park Improvements in accordance with such contract.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SHAKOPEE, MINNESOTA that the work completed under said contract is hereby
accepted and approved; and
BE IT FURTHER RESOLVED, that the City Clerk and Mayor are hereby directed
to issue a proper order for the final payment on such contract in the amount of
$26,337.49, taking the contractor's receipt in full and retain the two year warranty bond
from the developer for 50% of the improvements.
