of Way Acquisition Services for the CSAH 17/Vierling Drive Intersection
Improvement Project No. 2012 -6

ACTION SOUGHT:
For City Council to authorize an extension agreement with WSB & Associates, Inc. for right of
way acquisition services associated with CSAH 17/Vierling Drive intersection improvement,
Project No. 2012 -6.
INTRODUCTION:
Attached is an extension agreement from WSB & Associates, Inc. for obtaining necessary right
of way for the CSAH 17/Vierling Drive project for Council consideration.
BACKGROUND:
On February 21, 2012 the City Council of Shakopee approved a cooperative agreement with
Scott County and an extension agreement with Bolton & Menk, Inc. for intersection
improvements at CSAH 17/Vierling Drive and CSAH 17/North TH 169 Ramp.
Project design has been proceeding this year and the design has identified the need to obtain right
of way. Tentatively, right of way will be needed from two sites.
The right of way work includes appraisals and is estimated to be at $22,400.00. By commencing
with the right of way acquisition now, the affected property owners can be notified and any
concerns with the design can be discussed and possible design alterations can be made.
Bolton & Menk, Inc. will be working with WSB & Associates, have on the right of way
acquisition with the City paying WSB directly. Cost of right of way and engineering services
will be split with the County.
ALTERNATIVES:
1. Approve a motion authorizing the appropriate City officials to execute an extension
agreement with WSB & Associates, Inc. for right of way acquisition services associated
with the CSAH 17Nierling Drive intersection improvement project.
2. Do not approve the extension agreement at this time.

BUDGET IMPACT:
Project is being funded with Federal, County and City funds. City funding is through the Capital
Improvement Fund (CIF).
RECOMMENDATION:
Staff would recommend Alternative No. 1.
RELATIONS HIP TO VISIONING:
This supports Goal D: "Maintain, improve and create strong partnerships with other public and
private sector entities.

Two Commercial Parcels

Dear Mr. Loney:
On behalf of WSB & Associates, Inc., we are pleased to offer right -of -way acquisition services
to assist the City with the acquisition of easements for two parcels, yet to be determined. The
work will be performed according to our Agreement for Professional Services with the City of
Shakopee Section I -C -2 (Major Projects).
We are able to provide the following scope of services for two parcels:
Task 1: Right of Way Agent Services
WSB will provide right of way acquisition services including:
o Negotiator's log and parcel file per Mn/DOT and Federal requirements
o Early Notification letter
o Site visit with owners and appraiser
o Field Title Investigation and Report
o Offer to Purchase
o Negotiation
o Settlement, if appropriate
o Sign Relocation, if needed
o Finalized original parcel file
o Payment request
o This task also includes coordination with the City Attorney, who will provide the
easement documents and other required legal documents and lender consents.
WSB can draft these if the City attorney provides a template and reviews the final
version.
o Represent the City at the Mn/DOT review of parcel files as related to the R/W
Certificate review, as well as, provide assistance and presentation of files for
federal audit, if applicable.

o This scope of services will be provided in accordance with applicable laws and
regulations including the Uniform Act, State Statutes, and Mn/DOT manuals.
Task 2: Survey Services (provided by Bolton & Menk, Inc.)
Bolton & Menk's role as design engineer will provide efficiency in the delivery of the survey
services required for the easement acquisition, including:
o Legal descriptions
o Parcel sketch
o Staking of easements
Task 3: Appraisal Services (provided by Patchin, Messner, Dodd & Brumm)
Jason Messner will provide a full Before & After appraisal of two properties following
guidelines set by USPAP, Mn/DOT and FHWA. The appraisal fee of $10,000 does not include
appraisal updates, preparation for hearing or testimony, but these can be provided for an
additional fee. This fee assumes that no improvements will be affected or included in the
valuations.
Task 4: Appraisal Review Services (provided by Kelly Lindstrom)
Kelly Lindstrom, Certified General Appraiser, will provide two appraisal reviews, as required.
Assumptions:
• The City Attorney will provide legal documents such as easements, consents, disclaimers,
certificates, etc., as required.
• The City will provide review of permits request and issue permits, as appropriate.
• The City will determine the type of title research that meets their needs and obtain title
research, title commitments and insurance as the City determines it is needed.
• The City or City Attorney will record the documents, or this can be provided.
• The City Attorney will provide all eminent domain tasks, if needed. WSB's assistance
would be limited to providing all data, summaries, correspondence and input related to
why agreement could not be reached with the landowner(s).
• The City will provide tax forms (1099's), as required.
Estimated Fee:
WSB & Associates, Inc will perform the above scope of services in accordance with our
Agreement for Professional Services. Our estimated fee for these services is outlined as follows:
