CITY OF SHAKOPOEE .,A S 37, . p Memorandum Oa Loil a TO: Mayor and City Council Mark McNeill, City Administrator FROM: Julie Klima, Planner II RE: Plat Correction for Valley Creek Crossing 2 " Addition DATE: October 16, 2012 ACTION SOUGHT Offer a motion to approve the Certificate of Correction to Plat for Valley Creek Crossing 2nd Addition. This action has no budget impact. DISCUSSION In June 2012, the City Council approved the Final Plat of Valley Creek Crossing 2 Addition. Following that approval, the developer recorded the plat with the Scott County Recorder's Office and has begun site improvement/construction. The developer's engineer has informed the City that there were errors on the recorded plat document. Specifically, the distances noted for the south lines of Outlots C and D were noted incorrectly on the recorded final plat. The attached certificate of correction identifies the specific errors and provides for corrected measurements. Please note that no changes are being made to individual lots widths or depths. The lot sizes were all correctly noted on the recorded plat, however, the total distances noted did not coincide with the actual summation of distances. This certificate corrects those errors. ALTERNATIVES 1. Approve the Certificate of Correction for Valley Creek Crossing 2 " Addition and direct the appropriate city officials to work with the applicant to execute the document. 2. Do not approve the Certificate of Correction for Valley Creek Crossing 2 " Addition. 3. Table a decision on this matter and request additional information from staff and/or the applicant. That I prepared the plat of Valley Creek Crossing Second Addition dated August 15, 2012 and filed on August 21, 2012 in the office of County Recorder, Scott County, Minnesota, as Document Number 913273. 2. That said plat contains errors, omissions, or defects in the following particulars, to -wit: A southerly line of Outlot C, which is also the north line of Lots 1 through 8, Block 1, errantly shows a distance of 710.96 feet, and the south line of Outlot D errantly shows a distance of 390.39 feet. 3. That said plat is hereby corrected in the following particulars, to -wit: The correct distance for the southerly line of Outlot C, which is also the north line of Lots 1, through 8, Block 1, is 693.28 feet, and the correct distance for the south line of Outlot D is 372.65 feet.
