RE: Consideration of Approval to Issue Building Permit for Twin Home on Outlot A,
Replat of Noterman Addition

Action Sought:
The City Council is asked to make a determination whether Emmaus Companies Inc. may be
issued a building permit for the construction of a twin home on property described as Outlot A,
Replat of Noterman Addition.
Background /Discussion:
The subject property is zoned Old Shakopee Residential Zone (R -1C). Among the permitted
uses in the R -1C Zone is "single family attached dwellings, up to a maximum of two (2)
dwellings." Thus, the use proposed by Emmaus is a permitted use in the R -1C Zone. The
property's designation as an outlot dates back to 1957 -1959, and staff has not found any
legislative history going back that far that illuminates the reason it was designated as an outlot.
Given the age of this plat and the designation of the parcel as an outlot, the question that arose
for staff was whether requiring that the property be platted would serve a significant public
purpose. It does not appear on its face that it would.
However, Shakopee City Code Section 4.06. Inspections provides, among other things, that "no
building permit shall be issued for any building on an outlot." In other words, city staff does not
have the authority to issue a building permit to an outlot. The city attorney has advised staff
that the City Council has the inherent authority to grant an exception to the code requirement."
In reviewing this specific request, planning staff sought input from other city departments,
Shakopee Public Utilities Commission and other utilities. One department (Parks, Recreation
and Facikities) has suggested the property be platted, while others and the Utilities Commission
recommended that the City Council approve the issuance of a building permit on Outlot A,
Replat of Noterman Addition.
Alternatives:
1. Offer and pass a motion directing staff to accept an application for building permit, and to
issue a permit, for a twin home on Outlot A, Replat of Noterman Addition.

2. Deny the request, and require that Outlot A, Replat of Noterman Addition be replatted.
3. Table the item.
Recommendation:
Staff recommends alternative number 1 above.

Attached is a portion of the plat showing Outlot A. Since the filing of this plat Outlot A has since been split
multiple times and single family houses have been built on the other portions of Outlot A that front 10th Ave,
Madison, Monroe, and Jackson St.
In speaking with the Phil Dommer of Emmaus Companies (the developer) last week, he mentioned mentioned
that they intend to have a neighborhood meeting with the adjacent residents to outline their plans.
I looked in the PID files for evidence of when Outlot A was split into the other pieces and did not locate anything.
The building permits for the first houses to be built on the portions of the outlots were in 1965. The PIDs for the
outlot portions are numbered as if they are part of Notermann addition and the PIDs are sequential, so it would
appear that this by one action, but that is a guess. The next stop would be land records. Please let me know if
you would like me to go to the courthouse to try to determine when and how these lots were created.
