Introduction
The City Council is asked to adopt the attached Policy Handbook for the Shakopee Public
Access Studio, effective January 1, 2007.
Background
The Shakopee Public Access Cable Studio is currently operating under a Policy
Handbook adopted in 2003. While utilizing the handbook to guide our operation ofthe
studio, Telecommunications Coordinator John Peterson and I have found it to be
cumbersome and confusing. In an attempt to make it more user-friendly and easily
understandable, we have revised the handbook, resulting in the attached document. In
whole, the revised handbook does not reflect significant policy or procedural changes.
The document has been reviewed and discussed in depth by the Telecommunications
Advisory Commission and by attorney Robert Voss of Kennedy & Graven.
Relationship to Vision
The successful and user-friendly operation of the ShakopeePub1ic Access Studio
contributes to a high quality oflife for users and residents (Goal B).
Recommendation
The Telecommunications Advisory Commission recommends adoption ofthe attached
Policy Handbook for the Shakopee Public Access Studio.
Requested Action
Ifthe Council concurs, it should offer Resolution No. 6553, A Resolution Adopting the
Policy Handbook for the Shakopee Public Access Studio, and move it adoption.
RESOLUTION NO. 6553
ADOPTING THE POLICY HANDBOOK FOR THE
SHAKOPEE PUBLIC ACCESS STUDIO
WHEREAS, the City of Shakopee ("City") operates the Shakopee Public Access
(SPA) Studio for the benefit of residents of the Shakopee cable franchise area;
WHEREAS, there is a need for rules and regulations to ensure that all Shakopee
residents have equal access to SPA equipment and facilities, that the channel maintains a
professional broadcast appearance and for the protection of SPA users, staff, equipment
and facilities;
WHEREAS, the Telecommunications Advisory Commission recommends
adoption of the attached Policy Handbook in order to accomplish the above listed goals;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Shakopee, Scott County, Minnesota that the Policy Handbook for the Shakopee Public
Access Studio, attached hereto is hereby adopted, effective January 1,2007.
BE IT FURTHER RESOLVED, that Resolution No. 5869 is hereby repealed in it
entirety.

INTRODUCTION
Public Access Television exists to provide citizens of a local government jurisdiction access to cable
television and video production equipment and facilities. Shakopee Public Access (SPA) provides
residents and businesses of the Shakopee cable franchise area free use of equipment, video editing
suites and television studio space for the sole purpose of producing or submitting programming to be
broadcast on Shakopee Public Access Cable Channel 15 (SPAI5).
Public Access Television is intended to enrich communities by providing avenue for community-
initiated programming. Examples of programming types commonly broadcast on Public Access
include local high school sporting events, local church services, original comedy or variety shows,
concerts, recitals or other school events, community events such as parades and festivals, informational
or how-to programs, and local historical videos. Residents are encouraged to create programming on
whatever topic interests them.
No previous video production experience is necessary. SP A staff is available to provide basic training,
tips and professional opinions to assist users in producing or sponsoring a program for broadcast.
However, the content of the program and completion of a ready-to-broadcast program is the
responsibility of the individual user or group of users.
SP A encourages Shakopee residents to become involved in producing video programming that has
local appeal and can be broadcast on SPAI5. The following rules, regulations and forms have been
adopted to ensure that all Shakopee residents have equal access to SPA equipment and facilities, that
the channel maintains a professional broadcast appearance and for the protection of SPA users, staff,
equipment and facilities.

GETTING STARTED
1. Statement of Compliance (See green form p.13)
The first step in becoming a SPA user is submitting a Statement of Compliance Form, which
supplies SPA with the information needed to register a new user (i.e. name, address, valid
drivers license, and contact info). The Statement of Compliance also details broadcast rules to
which new users and the SPA15 must comply.
A Statement of Compliance must be read and signed by any user wishing to move forward with
usage of SPA equipment and its facilities as well as individuals submitting programs produced
elsewhere. A Statement of Compliance once signed will be finalized by SPA staff.
(Depending on staff duties finalization may take up to 24 hours),
2. Shakopee Certified User Card
All SPA users will be assigned a Certified User Card with an individual ID number. This card
will be used by SPA staff to easily identify users who have already filled out and submitted a
statement of compliance form. This card will also be used by residents when reserving and
checking out equipment, edit suite time or studio time as well as submitting programs for
broadcast.
3. Parental Consent (See purple form p.14)
Individuals under the age of 18 must have a parent or legal guardian sign the Statement of
Compliance Form and a Parental Consent Form. The certified user card will be assigned to the
parent or legal guardian ofa user under the age of 18. The user under the age of 18 may then
check out SPA equipment as well as reserve SPA facility time under the parent or legal
guardian ID number.

Utilizing SPA Equipment & Facilities
SPA has a wide variety of video production equipment available to residents of the Shakopee cable
franchise area as well as Shakopee businesses and their employees at no cost. SPA offers in-house
production space, an in-house production studio, edit suites, non-linear editing systems, field cameras
with necessary accessories, and a fully portable studio.
SPA equipment may only be used to produce non-commercial productions for SP A15. Equipment
may not be used for private purposes (e.g. weddings or birthdays), commercial purposes, producing
shows for other parties (for-hire), or for purposes in violation ofthe SPA rules.
1. Reservations
Equipment check-out, studio reservations and edit suite reservations will be provided on a first-come,
first-serve basis.
Users wishing to utilize SPA equipment and/or facilities are asked to make reservations at least 24
hours in advance in order to ensure availability. However, equipment is sometimes available on short
notice. SPA staffwill do their best to accommodate same day and drop-in requests made during
regular studio hours.
Reservations can be made by calling and speaking directly to an SPA staff member or by visiting the
studio during regular hours of operation. Reservations requested by voicemail or email should not be
considered official unless and until confirmed by an SPA staff reply.
2. Check out
Equipment may be checked out only from SPA staff. Individuals wishing to check out equipment will
be asked to present their certified user card.
Users may check out only one camera at a time unless prior arrangements have been made with SPA
staff. (Checking out only one camera at a time does not apply to the portable studio which may
include up to four cameras.)
Users will be required to sign a check out sheet; this sheet will list and/or describe the equipment being
checked out.

3. Use
The user (or his or her parent or legal guardian in the case of user under the age of 18) acknowledges
receipt of equipment when checking out equipment, and agrees to assume all responsibility for any
damage that may occur while it is in his/her name. This responsibility may extend to repair or
replacement costs arising from damage or loss, with the exception of ordinary wear and tear.
Users are responsible for protecting equipment from damage, including inclement weather. Users
failing to stop production when potential damage to equipment is imminent will be subject to covering
full repair or replacements costs and may be subject to suspension.
4. Return
Equipment must be returned to the studio during regular studio hours. Equipment is due back within
24 hours of check out or the next day the studio is open, unless other arrangements are made with SPA
staff at the time of check out. Requests or extensions in excess. of three days must be approved by the
City's Telecommunications Coordinator.
Any user returning equipment after the scheduled return date or to a City office or employee other than
the SPA studio or SP A staff without making prior arrangements may be subj ect to suspension.
Equipment should be returned in the same condition as at the time of check out. Equipment will be
inspected by SPA staffat the time of return for any problems or damage beyond normal wear and tear.
The cost of repairing damage caused by anything other than normal wear and tear, as determined by
the City's Telecommunications Coordinator, will be the responsibility of the user.
Users will be asked to clean or organize equipment that is dirty or in disarray before it is recognized
for check in. If equipment requires more than simple cleaning, the user will be required to pay for
professional cleaning or repair (if needed).
All accessories (batteries, cables, adapters, etc.) must be returned along with the primary equipment.
Any problems or issues related to the operation of the equipment should be reported to SPA staff at the
time of return so that any necessary maintenance or repair can be scheduled.
Users retuming the portable studio with footage stored on the hard drive must transfer that footage to
DVD or an edit suite hard drive within three SPA business days.

Edit Suite Usage
Edit suites (both portable and in-house) are to be used onlyfor the purpose of editing footage into a
program for broadcast on SPAI5. Individuals must submit a signed statement of compliance form and
be issued a certified user card before utilizing the edit suites. Users may use only one edit suite at a
time. No food or drink is allowed inside SPA edit suites.
Users may store project files on the local hard drive or on an external hard drive. Every effort is made
to protect information stored on SPA equipment. However, SPA is not responsible for files
accidentally deleted, relocated, misplaced or otherwise harmed. 'SPA recommends users provide a
personal external hard drive to ensure the safety of in-progress and completed programs.
Program files may be stored on SPA owned equipment for a period of no more than one month to
allow for editing.
Footage may be captured to an edit suite overnight; however, SPA does not assume responsibility for
failure due to a power outage or other unforeseen circumstances.
Users other than SPA stafffoundaccessing another user's file information without written permission
may have their privileges suspended. SPA staff may access user file information from time to time to
check on the status of project.
SPA Staff
SP A staff will assist and train users on all available SPA equipment to the best of their abilities.
However, all setup, program production, transferring and editing is the responsibility of the user. Staff
is not permitted to create, edit, modify or alter program content submitted by users.

SUBMITTING A PROGRAM FOR BROADCAST
All programs must be submitted ready-to-broadcast and accompanied by a completed Program
Submittal Form (See salmon form p.lS). Eligible submissions include programming produced
locally using SPA equipment and/or facilities as well as programming produced elsewhere but
submitted by a resident of the SPA franchise area. Additionally SPA may choose to supplement
programming submitted by residents with programming submitted directly to SPA, in cases where
such materials are likely to be of interest to SPA viewers as determined by the City's
Telecommunications Coordinator. Programming submitted by local residents will be given priority
over that which is submitted directly to SPA.
Requirements for broadcast include but are not limited to: Appropriate Format and Program
Identification. Programs not submitted in the appropriate format or without title slates may be
broadcast at the discretion of SPA Staff.
Appropriate Format-
SPA appropriate formats are - DVD, SVHS, VHS, MiniDV and DV.
If your program is not submitted in one of these formats, staffwill notify you of the need to
schedule time to make a transfer. If you need assistance during the transfer process please
notify staff when scheduling time.
Program Identification -
A graphic slate (or approved equivalent) at the beginning and end of each program is required.
Identification requirements include but are not limited to: title of show, date taped or produced
and user name with valid phone number. Phone number may be provided on ending graphic
only but must be provided.
Submitted programs in SPA's possession shall not be considered accepted for broadcast until they have
been reviewed by SPA staff for compliance with SPA policy.
SPA does not air programs containing advertising or commercial content. If a program is determined
to be incomplete, of poor video and/or audio quality or without the appropriate disclaimer(s) the
program may not be accepted. In such cases, SPA staff will contact the appropriate user and notify
them of the problems that need to be corrected in order for the program to be broadcast. Any SPA user
submitting a program takes full responsibility to complete that program. SPA staffwill not create,
edit, modify or alter your program in any way.
Users are responsible for seeking the necessary permissions to broadcast all images and audio
contained in their program. This responsibility includes, but is not limited to, making all necessary
arrangements with and obtaining all required clearances from broadcast stations, networks, sponsors,
music licensing organizations, performers, representatives, authors, composers and any and all other
persons or entities involved in the program. Each user may be requested to provide a letter written
and/or signed by the subject(s) of the video granting permission to broadcast their image and/or audio
on Shakopee Public Access Cable Channe115. The letter must include signature of the subject(s),
subject(s) contact information, date of event, and desired timeline of broadcast (e.g. two months). In
the case that a user is unable to provide a letter, the submitted programming will not be accepted.

Political Programming
SPA will not accept programming containing advertising which includes any advertising messages by
or on behalf of a political candidate, ongoing political issues or ballot measure.
This shall not prevent the presentation of official materials or programming produced by SPA staff
members or users that provides the opportunity for all candidates for a particular elective position or
proponents of all sides of any issue to appear in an equitable manner.
Technical Disclaimers
Although true "broadcast standards" will not be used in considering programs for broadcast, a program
may be rejected iftheaudio and/or video is not present or quality is so poor that the viewer will have
difficulty watching or listening.
SPA may reject a program or ask a user to edit or re-submit a program if any of the following are
found
. The tape or DVD is in poor physical condition.
. Video displays too much generational loss (i.e. it is a copy of a copy of a copy).
. The picture is too noisy, snowy or grainy.
. Loss of control track.
. The video is unstab1e(e.g. the picture jumps or flickers).
. Audio has a loud hum or buzz on the normal audio track.
. The audio is distorted
. The video/audio is not present
. The program during broadcast causes technical interference with other channels on cable
system lineup.
. Video and/or audio is over compressed.
In the event that a program submitted for broadcast is found to have a technical problem, but that
technical problem is not severe enough to warrant rejecting the entire program, SPA may request that
the user place the following disclaimer prior to the beginning graphic of the program for at least 20
seconds:
"The viewer may find the technical quality of some portions of the following program
unsatisfactory. "
In the case that a user refuses to include the requested disclaimer, the submitted programming will not
be accepted.
SPA staffwill have full discretion to determine whether or not a program is acceptable for broadcast
based on technical merit.

V nderwriting/Sponsorship Policy
In the event that funds, equipment, or other items of value, including volunteers, are provided by an
individual, business, or non-profit organization, the user must identify the person or business according
to the following policy:
. Goods, services or money received from an underwriter are to be used ONL Y to defer the costs
of production.
. The program must be unrelated to the commercial interests of the Underwriter.
. The program may not discuss or show products or services made available by persons,
corporations or institutions which have a commercial interest in the subject of the program.
. No discussion of products offered by the Underwriter is permitted. Prices of products may not
be given.
. Underwriting credits must be clearly identified as such; The following format is strongly
encouraged: "This program has been made possible in part by (Underwriter'sfull name). J}
. The general location, community or neighborhood of an Underwriter may be given, but specific
addresses and phone numbers are prohibited.
. Corporate logos or still photographs of businesses are permitted at the close of the program.
Photographs of products are not permitted.
. Underwriting credits may be no longer than 20 seconds per underwriter and may appear only at
the beginning and/or end of the program.
. Underwriting credits may not contain comparative or qualitative language about the
underwriter or its product.

Inappropriate Material
SPA strives to assist people in making infonned viewing decisions while providing an opportunity for
all fonns of expression without censorship and in accordance with existing laws. It is the intention of
SP A 15 to notify parents or guardians up front when programming is. broadcast that may be
inappropriate for children,
Programs containing vulgar language, nudity, extreme physical violence, extreme degradation, graphic
depiction of invasive medical procedures, or indecent material will be preceded by a disclaimer
advising viewer discretion. Such programming will be scheduled at the discretion of SPAin neither
prime-time nor daytime viewing hours.
Users requesting broadcast time with SPA shall be responsible for notifying SPA, via the Program
Submittal Fonn, if their program contains material requiring a disclaimer. Failure to notify SPA staff
of material requiring a disclaimer may result in suspension.
Required Disclaimers
At the direction of SPA staff, users may be required to place one or both of the following disclaimers
at the beginning of their program (prior to the opening graphic or title slate) for at least 20 seconds:
"The following program is considered to be of a mature theme and therefore may be offensive
to some viewers. Viewer/parental discretion are advised."
"The following program is made available through the facilities of Shakopee Public Access.
However, the content and opinions presented are not necessarily those of SPA, the City of
Shakopee, or Comcast Cable."
In the case that a user refuses to include the requested disclaimer(s), the submitted programming will
not be accepted.

Suspension Policy
Users who violate SPA rules may be suspended from using SPA equipment and facilities, and from
submitting programs for broadcast.
User privileges may be revoked for any of the following reasons:
. Failure to abide by the policies, procedures and guidelines of SPA;
. Using SPA equipment for anything other than the production of programs to broadcast on
SPA15.
. Making statements to SPA, verbally or in written form, which is knowingly false, misleading,
or incomplete.
. Using excessive force, dropping, or mishandling equipment. Failure to protect the equipment
from loss or damage. Using equipment in a dangerous or frivolous manner.
. Failure to stop production when potential damage to equipment is imminent, including
inclement weather.
. Repeatedly returning equipment that is dirty or in disarray or after the scheduled return date.
. Using SPA facilities and/or equipment to facilitate or carry out any action that violates federal,
state or local laws.
. Representing oneself as an employee of the City of Shakopee, SPA or Comcast.
SP A staffwill notify the City's Telecommunications Coordinator of any issue or behavior they feel
warrants suspension or other disciplinary action. The Telecommunications Coordinator will review
staff s concerns and make a decision whether or not to proceed with disciplinary action.
Length of Suspensions
The length of suspension will be based on the severity of the violation and determined on a case by
case basis. Severe violations, as determined by the Shakopee Telecommunications Advisory
Commission, may result in permanent suspension.

Appealing a Suspension or SPA Ruling
Any user who disagrees with a decision by the City's Telecommunications Coordinator to the
application of any of the foregoing rules may request a review and determination by the Shakopee
Telecommunications Advisory Commission,
. A review request must be made in writing to the Shakopee Telecommunications Advisory
Commission within thirty (30) days from the time the person or entity is informed of the
decision by the City's Telecommunications Coordinator.
. The Shakopee Telecommunications Advisory Commission will conduct the review and issue a
written decision within thirty (30) days of the meeting following receipt ofthereview request.
. Ifthe user disagrees with the Shakopee Telecommunications Advisory Commission's
suspension decision, the suspended user may make an appeal in writing to the Shakopee City
Council within thirty (30) days of the Shakopee Telecommunications Advisory Commission's
decision.
. The Shakopee City Council will conduct a review and issue a written decision within thirty
(30) days of the meeting following receipt of the review request.
. The review conducted by the Shakopee Telecommunications Advisory Committee or City
Council shall afford the affected user the right to participate, be represented by an attorney, and
present evidence and argument.
Copyright Policy
The creator of non-commercial programming is entitled to all non-commercial use of that program,
may copyright that program in his/her name and is entitled to the rights of a copyright holder.
SPA encourages users to include copyright information/notices in their submitted programs and to
submit their programs for broadcast on the cable access channels of other cities. Programs produced
using SPA equipment and distributed for broadcast on other public access channels must include a
notice identifying SPA as the originating studio or cable access provider at the end of the program.
SPA does not own the rights to programs submitted by users for broadcast on the cable access channel.
However, all programs submitted and broadcast on SPA15 are available to any citizen requesting a
copy for personal or home viewing. Citizens wishing to utilize material from an SPA program for any
other purpose must first obtain permission from the program producer.
To compensate for the cost of SPA equipment use, a fee will be charged to any citizen who requests a
copy ofa program broadcast on the SPA Channel. (See Appendix A for a copy of the current fee
schedule. )
1 st Amendment
In accordance with the First Amendment of the Constitution of the United States of America, SPA
does not act as a censor for programs broadcast on our channels. Any program submitted and accepted
by SPA will be broadcast at least once in accordance with existing laws. However, programs
containing material that contradicts the Statement of Compliance will not be accepted.

Public Records / Program Retention
SPA maintains a roster of certified users. This roster contains, but is not limited to, the users name,
address and phone number. Information contained on the roster will be disclosed in accordance with
the Minnesota DataPractices Act.
SPA also maintains an inventory of submitted programs. A copy of this inventory will be made
available to any Shakopee resident upon request. Programs will be included on the inventory if a
program was accepted for broadcast and as long as SPA has in some form a copy of the program.
One copy of each accepted locally produced program will be created and retained by SPA for a
minimum of one year, after one year SPA may choose to discard the created copy. SPA staffwill offer
the appropriate user the opportunity to claim his or her originally submitted program materials as soon
as it becomes available. Materials not claimed by the user within 30 days of the notification will be
recycled or discarded. If a submission is not accepted it will be returned to the appropriate user as
soon as it has been determined to be unacceptable.
Limits of Liability
SP A is not liable if the program or material submitted is damaged, lost or stolen while in its custody.
If gross negligence on the part of SPA causes a tape to be damaged irreparably, SPA will replace the
tape itself with a blank tape of similar quality and format, but will in no way be held responsible for
any lost content on the tape. Users are encouraged to submit a copy of their original or master tape(s)
for broadcast.
Indemnification and Hold Harmless:
All users shall indemnify and hold harmless Shakopee Public Access, the City of Shakopee, and
Comcast Cable, their officers, directors, employees, agents and representatives from any and all
liability, damage, injury, judgment, including cost of defending claims (including reasonable attorney's
fees) arising from or in connection with any claim for failure to comply with any laws, rules or
regulations of federal, state or local government, claims ofliab1e, slander or invasion of privacy,
claims of infringement of copyright, patent or unauthorized use of any material or trademark, service
mark or image, or for any other injury or damage in law or in equity claimed as a result of or from or
connected with their use of SPA broadcast time, SPA equipment, facilities or other resources.
Amendments to this Policy Handbook
The City of Shakopee reserves the right to add to, delete from or otherwise amend this policy as
needed for the protection of SPA users, staff, equipment and/or facilities.
Ifusage of SP A equipment and/or facilities warrants, SPA may elect to implement additional operating
practices and procedures. Such practices and procedures may include, but are not limited to:
. Production Proposal Policy and Form
. Hours Logged Policy and Form
. Appropriate Time-limits on Equipment, Edit Suite and/or Studio Usage

Shakopee Public Access Statement of Comnliance
In consideration for permission, use and access to the replay of programs on the cable system from Shakopee Public Access
and Comcast Cable or its successors, I hereby make the following representations, agreements and releases:
I certify that no advertising material or other commercial programming; lotteryor lottery information; obscene
material, sexually explicit conduct, or material soliciting or promoting unlawful conduct (as those terms are
defined or interpreted under applicable FCC regulations); or indecent, slanderous or libelous material, is contained
in this program.
I certify that this program is not for commercial or profit-making purposes and was not produced on a for-hire
basis, If facility or equipment usage results in a profit to the user, that user must pay the City of Shakopee for
rental of the equipment at commercial rates.
I request that my program(s) be shown on the Shakopee Public Access Channel. I authorize the subsequent replay
of this program at the discretion of Shakopee Public Access, the Shakopee Telecommunications Advisory
Commission and/or the City of Shakopee,
I certify that I have obtained any and all clearances for the broadcast of this program from broadcast stations,
networks, sponsors, music and film licensing organizations, performers; representatives, authors, composers, and
all other license or copyright holders for any content contained in the program, as required. I certify the program
is not an invasion of privacy or publicity right and is shown with all the necessary permissions obtained from
persons/organizations appearing in the program.
I accept full responsibility for the content of the program and the consequences of its presentation. I acknowledge
and agree that I am liable for any costs arising from the use of copyrighted or licensed materials,
I am familiar with the Shakopee Public Access Rules and Policies; I have read the Rules, I understand the
requirements contained within the Rules, I will comply with them, I understand and agree to the Rules and
Procedures surrounding the treatment of programming that violates the Shakopee Public Access Rules, and hereby
authorize Shakopee Public Access to remove any of my programming that violates the Public Access Rules,
I hereby indemnify and hold harmless Shakopee Public Access, the ShakopeeTelecommunications Advisory
Commission, the City of Shakopee, Comcast Cable, the Shakopee Public Access facility and staff, respective
officers, directors, managers, agents and representatives from any and all liability, damage, injury and judgments
arising from the broadcast, or production of any programming or any other claim arising from my use of Shakopee
Public Access facilities or equipment.
I further attest that I have truthfully filled out this Statement of Compliance form.

Appendix A
2007 Shakopee Video Dubbing Fees I Media Fees
A Duplication Request and appropriate fees are applicable to all duplication requests of any
program(s) or meeting(s). Duplication takes real time (i.e. if the program you request is 40
minutes long it will take 40 minutes to copy).
Staff reserves the right to create dubs as time allows (within reason) and to deny a duplication
request exceeding three copies of the same program or meeting. Staffwill assist a user in finding
a duplication facility if one is needed.
Staffmay choose to run a dub overnight or at the end ofa shiftwhich will not allow the dubto
be available until the next day or shift.
Shakopee facilities do not have the ability to create copies on any media formats other than those
listed.
Shakopee Public Access (SPA) does not provide free media for the purposes of production, The
purchase of media for production is based on availability. Sales will not be made if SPA media
inventory is five pieces or less on the requested media type.
Shakopee staff does not copy or duplicate materials not submitted for broadcast on SP A15.
Video Dubbing Fees
$10.00each Dubbed onto SVHS, VHS, MiniDV or DVD(does not include the cost of media)
No Cost Any SPA user submitting a program created with SPA equipment for use on
SPA 15 may request one free copy at no charge; however the user must provide or
pay for the necessary media. Duplication charges will apply for each additional
copy beyond the one free copy.

Definitions
ADVERTISING refers to any material designed to promote the sale of commercial products or
services including advertising by or on behalf of candidates for public office, the solicitation of
donations, payment, trade or barter. Programs may not identify, promote, or make reference to
any product, service, trademark, brand name or business in any manner which does not further
the noncommercial message of the program, or which would jeopardize the noncommercial
mandate of SPA. Programs may not solicit funds or other property of value from viewers.
Prices of products may not be mentioned. Programs fitting under these descriptions will not be
accepted.
BALLOT MEASURE (also known as a ballot proposition, ballot initiative or referendum)
refers to any policy question that is decided by voters, typically on the state or local level.
Measures can be binding (i.e, the voters' decision becomes law) or nonbinding.
MINNESOTA DATA PRACTICES ACT refers to MN Statute 2005 Chapter 13 "Government
Data Practices" which categorizes information collected by local governments as either public or
private data and directs when and how public data must be disclosed.
OBSCENE MATERIAL refers to any material that is obscene under applicable local, state or
federal law. The Supreme Court generally uses the case of Miller v. California, 413 U.S. 15
(1973) as a standard. The case establishes a three-part test to determine whether material is
obscene:
1. Whether the average person, applying contemporary community standards would find that the
work, taken as a whole, appeals to the prurient interest (a morbid, degrading and unhealthy
interest in sex, as distinguished from a mere candid interest in sex.)
2. Whether the work depicts or describes, in a patently offensive way, sexual conduct
specifically defined by applicable state law: and
3. Whether the work, taken as a whole, lacks serious literary, artistic, political, or scientific
value.
