SUBJECT: Accepting the Donation of a Trail Easement at Lot 22, Block 1, Riverside
Fields 1 st Addition (8464 Blazing Star Circle)

INTRODUCTION:
Attached is Resolution No. 6546, a resolution declaring the donation of a trail easement
with an estimated value greater than $1000.
BACKGROUND:
A trail easement was necessary on the property located at 8464 Blazing Star Circle in the
Southbridge Fields 1 st Addition development to eliminate wetland impacts for a proposed
trail to connect the existing Southbridge Fields trail to the Glacier Estates trail and park.
Mr. and Mrs. Domingo and Susan Vega generously donated the 312 square foot easement
on their property to the City for the purpose of a trail.
In compliance with Resolution No. 5794 specifying cash donations of over $1000 be
accepted by resolution of the City Council this resolution is being offered for your
consideration.
ALTERNATIVES:
1. Adopt Resolution No. 6546.
2. Deny Resolution No. 6546.
3. Adopt Resolution No. 6546, with Council modifications.
4. Table for additional information.
RECOMMENDATION:
Staff recommends Alternative No.1, to adopt Resolution No. 6546, accepting the
donation of a Trail Easement at Lot 22, Block 1, Riverside Fields 1 st Addition (8464
Blazing Star Circle).
ACTION REQUESTED:
Offer Resolution No. 6546, A Resolution Accepting the donation of a Trail Easement at
Lot 22, Block 1, Riverside Fields 1 st Addition (8464 Blazing Star Circle) and move its
adoption.
RESOLUTION NO. 6546
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA,
ACCEPTING ATRAIL EASEMENT
WHEREAS, on November 6,2002, the City Council adopted Resolution No.
5794, which established procedure relating to the receipt of gifts and donations by the
City; and
WHEREAS, Resolution No. 5794 specifies that cash donations of over $1,000
shall be accepted by resolution of the City Council, and shall require a two-thirds
majority of the Council for acceptance; and
WHEREAS, Mr. and Mrs. Domingo and SusanVega, residents residing at 8464
Blazing Star Circle in Shakopee, MN, donated a trail easement over, above, and below a
portion of their property, which will be used to construct a trail; and
WHEREAS, such a donation will increase the use of park and recreation, foster
community connections, .and enhance the overall quality oflife in Shakopee. .
NOW, THEREFORE, BE ITRESOL VED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA, that the trail easement donation in an amount ,..
greater than $1000 be gratefully accepted; and
FURTHER, that City staff is directed to send a letter to the donor, acknowledging
receipt of the gift and expressing the appreciation of the City.Council.
Adopted in adjourned regular session of the City Council ofthe City of Shakopee,
Minnesota, held this 19th day of December, 2006.
