SUBJECT: Preliminary and Final Plat of Opus MVW 2nd Addition

DISCUSSION
Opus Northwest has submitted an application for preliminary and final plat approval of
two properties located at 600 Canterbury Road. Both properties are currently owned by
Hansen and Hansen, LLC. The southern parcel is currently occupied by Twin City
Outboard; the northern parcel is currently vacant. As proposed, this plat would adjust the
lot lines of the two parcels; no additional parcels would be created.
The northern parcel is un-platted and the southern is part ofthe Koskovich Valley Park
First Addition. Opus Northwest is proposing to adjust the lot lines and purchase the
proposed Lot 1 from Hansen and Hansen with intentions of developing it at alater time.
As proposed, Lots 1 and 2 are 2.98 and 2.56 acres respectively.
No additional accesses to Canterbury Road would be created as the Scott County
Highway Department is requiring that access to lot 1 be from the existing driveway and
that a driveway easement be granted to Twin City Outboard (lot 2).
The conditions initially drafted by staff and supported by the Commission resulted in a
few modifications to the plat drawings in regards to easements. The applicant has
recently submitted revised plans that address the conditions necessary for final plat
approval. If the plat receives preliminary and final approval the remaining conditions
must be addressed by the applicant prior to the release of the plat for recording or prior to
the plat being recorded.
PLANNING COMMISSION RECOMMENDATION
The Planning Commission reviewed the preliminary plat at its December 7, 2006
meeting, and by a 5-0 vote, they recommended approval ofthe preliminary plat
application.
VISIONING RELATIONSHIP
This action supports:
Goal D: "Vibrant, Resilient, and Stable", and
Strategy 4: "Improve Individual Financial Health".
ALTERNATIVES
1. Approve Resolution No. 6549, approving the Preliminary and Final Plat for
Opus MVW 2nd Addition, subject to the conditions presented.
2. Approve Resolution No. 6549, approving the Preliminary and Final Plat for
Opus MVW 2nd Addition, subject to revised conditions.
3. Do not approve the preliminary and final plat and direct staff to prepare a
resolution consistent with the direction of the Council.
4. Table the matter and request additional information from staff and/or the
applicant.
ACTION REQUESTED
Offer a motion to approve Resolution No. 6549, a resolution approving the Preliminary
and Final Plat of Opus MVW 2nd Addition subject to the conditions as presented by staff,

A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING
THE PRELIMINARY AND FINAL PLAT OF OPUS MVW 2nd ADDITION
WHEREAS, Opus Northwest, applicant and Hansen and Hansen LLC, property
owner, has made application for preliminary and final plat approval of Opus MVW 2nd
Addition; and
WHEREAS, the subject property is legally described as:
The South 400 feet ofthe East 653 feet ofthe Northeast Quarter of the Southwest Quarter of
Section 4, Township 115, Range 22 according to the United States Government Survey
thereof, Scott County, Minnesota, excepting therefrom Koskovich Valley Park First
Addition.
and
Lot 1, Block 1, Koskovich Valley Park First Addition, according to the recorded plat
thereof, Scott County, Minnesota.
WHEREAS, the Planning Commission reviewed the preliminary plat on
December 7, 2006, and recommended approval of the plat with the proposed conditions;
and
WHEREAS, the City Council reviewed the proposed preliminary and final plat
on December 19,2006.
NOW THEREFORE, BE IT RESOLVED by the City Council ofthe City of
Shakopee, Minnesota that the preliminary and final plat of Opus MVW 2nd Addition is
hereby approved subject to the following conditions:
I. The following procedural actions must be completed prior to the
recording of the Final Plat:
a. Approval oftitle by the City Attorney.
b. The applicant must revise the viCinity map on the preliminary plat drawing to
show the correct area.
c. Execution of a Developer's Agreement, which shall include provisions for
security. for any public watermain within the Final Plat and the associated
engineering review fees.
d. Payment of Trunk Sanitary Sewer Charges shall be made, as required by the
most current City of Shakopee Fee Schedule.
e. The applicant shall provide suitable access easements to all adjacent
pr9perties utilizing the private driveway.
f. The applicant shall provide a sign easement for the Twin City Outboard
monument sign, or relocate the sign to Lot 2, according to ordinance
standards.
g. Provide electronic (Auto CAD) files of the Final Plat and all record drawings
to the engineering department.
II. The following items shall be completed prior to approval of a grading permit,
a building permit and/or a street/utility plan:
a. No public improvements shall be constructed until the City Engineer and the
Shakopee Public Utilities Commission (SPUC) approves the Final
Construction Plans and Specifications.
b. Payment of Trunk Storm Water Charges and Trunk Storm Water Storage and
Treatment Charges shall be made, as required by the most current City of
Shakopee Fee Schedule.
c. The applicant shall obtain a NPDES permit prior to any land disturbing
activity. A copy of this permit shall be provided to the City.
d. The applicant shall work with City staff to design and construct an acceptable
storm water conveyance system to route runoff to the regional storm water
basin to the West.
e. When adjacent properties to North and West develop, access to Lots I and 2
from 4th A venue shall be provided.
III. The following items shall be completed prior to release of the Final Plat for
recording:
a. Twin City Outboard must receive a hazardous waste generator license from
Scott County Environmental Health.

owned by Hansen and Hansen, LLC. The southern parcel is currently occupied by Twin
City Outboard; the northern parcel is currently vacant. As proposed this plat would adjust
the lot lines of the two parcels, no additional parcels would be created.
The northern parcel is un-platted and the southern is part of the Koskovich Valley Park
First Addition. Opus Northwest is proposing to adjust the lot lines and purchase the

proposed Lot 1 from Hansen and Hansen with intentions of developing it at a later time.
As proposed, Lots 1 and 2 are 2.98 and 2.56 acres respectively. The applicant has filed
requests for both preliminary and final plat. The Planning Commission will be reviewing
the application for preliminary plat and making a recommendation to the City Councill at
which time the City Council may review both preliminary and final plat applications
concurrently.
Discussion
Twin City Outboard cun"ently accesses Canterbury Road by means of a paved driveway
located on the northern parcel. Access to proposed Lot 1 would be from the existing
driveway onto Canterbury Road, an easement will beprovided to allow for access to Lot
2 (Twin City Outboard). The applicant has agreed to provide an easement and depict it on
future drawings. Perimeter easements are not depicted on the drawings, however they
will be required ifthe plat is approved.
The Engineering Department has reviewed the application and provided comments
(Exhibit D). These comments have been attached for the Commission's review. The
comments have been included in the list of recommended conditions of approval.
Scott County Environmental Health has reviewed the application and has provided their
comments on the attached memorandum (Exhibit E). Those comments have been
incorporated into the list of recommended conditions of approval.
Shakopee Public Utilities has reviewed the application and have provided comments
(Exhibit F). The comments have been incorporated into the list of recommended
conditions of approval.
Scott County Highway Depmiment has reviewed the application mId has provided
comments. The Highway Department reconunends that the applicant work to provide
easements across adjacent prorerties to the north and west that would allow for future
access of Lots 1 and 2 from 4t Avenue (Exhibit F). Planning staffbelieves this to be a
relevant concern, however at this time does not feel compelled to require the applicant to
secure easements at tins time; due to the fact that Lot 1 is approximately 920 feet from
tile Right-of-Way of 4th Avenue and development patterns for the adjacent properties are
unknown. A condition will be included in the recommendation that when the adjacent
properties develop, access to Lots 1 and 2 from 4th Avenue be provided.
STAFF RECOMMENDATION
Staff recommends that the Plannhig Commission recommend to the City Council the
approval of the Preliminary Plat of Opus MVW 2nd Addition subject to the following
conditions:
I. The following procedural actions must be completed prior to the
recording of the Final Plat:
a. Approvaloftitle by the City Attorney.

b. The applicant must revise the vicinity map on the preliminary plat drawing to
show the correct area.
c. Execution of a Developer's Agreement, which shall include provisions for
security for any public watermain within the Final Plat and the associated
engineering review fees.
d.Payment of Trunk Sanitary Sewer Charges shall be made, as required by the
most current City of Shako pee Fee Schedule.
e. The applicant shall provide suitable access easements to all adjacent
properties utilizing the private driveway.
f. The applicant shall provide a sign easement for the Twin City Outboard
monument sign, or relocate the sign to Lot 2, according. to ordinance
standards.
g. Provide electronic (Auto CAD) files of the Final Plat and all record drawings
to the engineering department.
II. The following items shall be completed prior to approval of a grading permit,
a building permit and/or a street/utility plan:
a. No public improvements shall be constructed until the City Engineer and the
Shakopee Public Utilities Commission (SPUC) approves the Final
Construction Plans and Specifications.
b. Payment of Trunk Stonn Water Charges and Trunk StOlm Water Storage and
Treatment Charges shall be made, as required by the most current City of
Shakopee Fee Schedule.
c. The applicant shall obtain a NPDES permit prior to any land disturbing
activity. A copy of this pennit shall be provided to the City.
d. The applicant shall work with City staff to design and construct an acceptable
storm water conveyance system to route runoff to the regional storm water
basin to the West.
III. The following items shall be completed prior to release of the Final Plat for
recording:
a. Easements shall be shown on the Final Plat as approved by the City Engineer.
They shall include, but not be limited to, the following:

adjacent to the County Road 83 (Canterbury Road) right-of-way.
c. Provide a minimum of twenty (20) feet of drainage and utility easement
adjacent to each additional property line.

Scott County Enviromnental Health.
IV. Other items
a. When adjacent properties to North and West develop, access to Lots 1 and 2
from 4th Avenue shall be provided.
ALTERNATIVES
1. Offer a motion to recommend to the City Council the approval of the
Preliminary Plat subject to the conditions as presented by staff.
2. Offer a motion to recommend to the City Council the approval ofthe
Preliminary Plat subject to revised conditions.
3. Offera motion to continue the public hearing to request additional
infomlation from the applicant and/or staff.
4. Offer a motion to table a decision and request additional information from the
applicant and/or staff.
5. Offer a motion to recommend denial of the Preliminary Plat to the City
Council.
ACTION REQUESTED
Offer a motion to recommend to the City Council the approval of the Preliminary Plat of
Opus MVW Second Addition subject to the conditions as presented by staff, and move its
adoption.

The application indicates a request for Preliminary Plat and Final Plat approval of a Light
Industry (I-I) development located West of the intersection between County Road 83
(Canterbury Road) and Valley Industrial Boulevard South.
This review should be considered preliminary, as more comments are to follow with additional
. submittals. However, T offer the following comments at this time for the applicant and for the
planning department:
General Comments
Thefollow items shall be completedprior to release of the Final Platfor recording:
1. Execution of a Developer's Agreement, which shall include provisions for security for
any public watennain within the Final Plat and the associated engineering review fees.
2. Payment of Trunk Sanitary Sewer Charges shall be made, as required by the most current
City of Shakopee Fee Schedule.
3. The applicant shall provide suitable access easements to all adjacent properties utilizing
the private driveway.
4. Provide electronic (Auto CAD) files of the Final Plat and all record drawings to the
engineering department.
The following items shall be completed prior to approval of a grading permit, a building
permit and/or a street/utility plan:

1. No public improvements shall be constructed until the City Engineer and the Shakopee
Public Utilities Commission (SPUC) approves the Final Construction Plans and
Specifications.
2. Payment of Trunk Storm Water Charges and Trunk Storm Water Storage and Treatment
Charges shall be made, as required by the most current City of Shakopee Fee Schedule.
3. The applicant shall obtain a NPDES permit prior to any land disturbing activity. . A copy
of this permit shall be provided to the City.
4. The applicant shall wOIk with City staff to design and construct an acceptable storm
. water conveyance system to route runoff to the regional storm water basin to the West.
Preliminary Plat and Final Plat
The following items shall be completed prior to release of the Final Plat for recording:
1. Easements shall be shown on the Final Plat as approved by the City Engineer. They shall
include, but not be limited to, the following:
. Provide a minimum of twenty (20) feet of drainage and utility easement adjacent to
the County Road 83 (Canterbury Road) right-of-way.
. Provide a minimum of twenty (20) feet of drainage and utility easement adjacent to
each additional property line.
Recommendation

We have reviewed the request for a preliminary plat and offer the following conunents:
. The east 17 feet of Lot 1 shall be dedicated as right-of-way for CSAH 83.
. Lot I and Lot 2 shall be required to share one access to CSAH 83. The proper easements shall
be in place to allow for shared access. .
. We strongly recommend the applicants work to provide easements over the property to the north
and west to enable development on Lot 1 and Lot 2 to have access to 4th Avenue in the future.

Enclosed for your review are the following:
1. Completed Application for Preliminary Plat and Final Plat;
2. Completed Environmental and Park Plan Review;
3. List of property owners within 350 feet of the subject property from
First American Title Insurance Company with mailing labels of
property owners listed;
4. Check in the amount of $972.16;
S. Twenty-six (26) copies of the preliminary plat;
6. Twenty-six (26) copies of the fInal plat; and
7. Twenty-six (26) copies of the existing conditions map.
As noted in the application, the plat is being filed to permit our client, Opus
Northwest, L.L.C. ("Opus"), to purchase part, but not all, of a vacant unplatted lot owned by
Hansen & Hansen ("Hansen"). Hansen also owns the adjacent platted lot. The plat proposes
to add the part of the unplatted lot that is not being purchased by Opus to the platted lot,
which results essentially in a boundary line adjustment. The Shakopee City Ordinance
permits the Planning Department to handle this type of boundary line adjustment as an
administrative matter for unplatted lots, but, because in this case, one lot is platted and the
other is not platted, the boundary line adjustment can only occur through the formal plat
application.
