Shakopee City Council July 5, 2023 FROM: Andrea Harrell TO: Mayor and Council Members Subject: Minnesota Department of Public Safety's DWI/Traffic Safety Officer Grant Award Policy/Action Requested: Adopt Resolution R2023-075, accepting the Minnesota Department of Public Safety's DWI/Traffic Safety Officer Grant Award and authorizing the City Administrator to execute the necessary contracts and agreements applicable to accepting this award. Recommendation: Adopt Resolution R2023-075. Discussion: At the June 6, 2023 Shakopee City Council meeting, Council approved applying for the MN Department of Public Safety's DWI/Traffic Safety Officer program. The MN Department of Public Safety's DWI/Traffic Safety (TS) Officer program awards funding to law enforcement agencies to hire an officer to work during peak nights and times when data indicates impaired driving will most likely occur. While primarily seeking to detect and interdict impaired drivers, the DWI/TS Officer will also focus on the dangerous driving behaviors of speeding, distracted driving, and occupant protection. The Shakopee Police Department was originally awarded this grant in 2022, and this funding will allow the Shakopee PD to continue providing a DWI/TS Officer for one year with funding ending in September 2024. Data is currently and will continue to be collected to analyze the effectiveness of the program. The funding has been and will be utilized to provide the officer's salary, benefits, and overtime relating to duties performed within the scope of this grant. Budget Impact: A 0% match is required. However, as a commitment to the program, grant administration costs, vehicle mileage costs, and/or agency expenses incurred will be used as a match. Discussion: The Shakopee Lions Club has submitted an application for a temporary liquor license for the USA Men's Slow Pitch Softball Tournament being held at Joe Schleper Stadium from August 17, 2023 - August 20, 2023. The tournament will run from 8:00 am - 10:00 pm each day. The 10:00 p.m. hour is consistent with previous licenses issued to the Shakopee Lions. It was discovered during this process that the alley encroached on a corner of their property. Relocating the alley is not possible as the right of way is too naiTow for vehicles to navigate safely. The City needs to acquire approximately 250 square feet of property to allow for continued use of the alley. The price of $5,661.84 was achieved through a negotiation with the property owner. Recommendation: The Planning Commission reviewed the Preliminary Plat application on April 6, 2023, and by a unanimous (6-0) vote, recommended that the City Council approve the requested action. Discussion: D.R. Horton Inc. - Minnesota, applicant, and LaTour Fainis LP, David Brown, and Roger & Vickie Plekkenpol, property owners, have applied for Final Plat approval of property located south of County State Aid Highway 78 and East & West of Zumbro Avenue as identified in the attached legal descriptions and concept plan. The proposed first addition of Highview Park consists of approx. 106 acres and 172 units, including 122 single family homes and 50 twin homes. This property was rezoned to R-2, Medium Density Zone, in the northwestern portion (which consists of the twin homes), with the balance rezoned R-1B, Urban Residential Zone. This property is guided Suburban Residential (3-6 dwelling units per acre) and Suburban Edge Residential (0.01 — 3 dwelling units per acre), which is consistent with their proposed plat. The developer has agreed to construct homes compliant with the design and performance standards for those zoning districts. The applicant is proposing the first phase of development of this property, building out to the southerly line over the next several years. They have been actively developing the property to the north of this area, and with continued strong sales of those homes, they are Page 31 of 119 looking at this area for a logical expansion of the existing utilities and roadways. The developer proposed and received approval of annexation of this property into the City of Shakopee earlier this year. At the time of that annexation, it was known that additional property needed to be annexed as it related to this property, with the City presently proposing the annexation of a segment of Zumbro Avenue (on the 7/6/ PC agenda, to be presented to the Council on July 18th), and another small sliver of property proposed for annexation in August, 2023 (property ownership was recently resolved in this situation). A condition of approval is that those segments of property need to be annexed into the City properly prior to any plat recording. Attached to this report is an Annexation Exhibit identifying those areas still needing to be annexed. City, County, and SPU staff have spent considerable time discussing details of this project with the applicant, their consultant, and Jackson Township representatives. As part of this project, if approved, the developer will be providing a significant amount of park dedication fees that the city will utilize to create improvements to the Township's Jackson Park (located at the southwest corner of CSAH 78 & CSAH 15/Marystown Road). Design of the park improvements will be a joint effort between the city, developer and Jackson Township. Horton is pleased to submit this application for approval of a Final Plat for High View Park. The proposed development consists of 172 total homes (122 single family homes and 50 twin homes), on approximately 106 acres located south of County Road 78/130th Street and Zumbro Avenue. The development plan for the neighborhood was patterned after the approved City's AUAR for the area. Surrounding land uses include agricultural to the west and south, Windermere South to the north and Jackson Township property and rural residential to the east. EXISTING CONDITIONS The High View Park property, currently used for agricultural purposes, consists of 6 parcels. There are 7 wetlands within the site ranging in size from 0.06 acres to 1.8 acres. Trees are generally clustered around the homesteads and mainly consist of Oak, Ash, Boxelder, Cottonwood and Spruce among a few others. A Notice of Determination of wetlands on the property was received December 2022 and it was determined that there are 7 wetlands on the site and one water course. An update to the AUAR traffic study is in process. The study will show traffic impacts for the proposed High View Park development. THE NEIGHBORHOOD The proposed High View Park consists of 496 single family lots. There will be two lots sizes to provide diversity in the homes being proposed: 178 of the home sites will have a typical lot size of 60 feet wide by 130 feet deep and 318 will have a typical lot size of 65 feet wide by 130 feet deep. Minimum setbacks are proposed to be consistent with the City's R-1 B Zoning District: front setback of 25 feet, side setback of 7.5 feet, corner lot side setback of 25 feet and rear yard setback of 30 feet. The development will also contain a 92-unit twin home sub -neighborhood in the north portion of the site. Here, setbacks consist of 35-foot front, 10-foot side, 25-foot corner lot side and 20-foot rear. The neighborhood's primary entrance will be accessed from County Road 78/Zumbro Avenue. Zumbro will be paved to the southerly neighborhood boundary and include a planted center median to slow traffic and allow easier pedestrian crossing. Multiple streets will be stubbed to the property boundaries for roadway connections when High View Park Preliminary Plat 6/5/2023 1 Page 41 of 119 adjacent properties are developed in the future. Sidewalks will be constructed on one side of public streets. Additionally, the proposed trails in High View Park will provide connectivity to the existing public trail system. A master neighborhood association would be responsible for ownership and maintenance of the amenities serving High View Park. These include the Zumbro Avenue median, monuments and ponds. Additionally, the twin home neighborhood will be part of a separate sub -association and would be responsible for building exteriors and grounds maintenance. Three single family home styles will be offered in the neighborhood, all with multiple floorplan and elevation options: Horton Series, Express Premier and Express Select. These homes are currently being built in Windermere South 4th and 5th Additions. The Horton Series homes are traditional 2-story homes with full depth basements ranging in size from 1,800 to 3,100 square feet. The Express Premier homes are multi -level homes with square footages from 1,500 to 2,500. The Express Select homes fit on the narrower lots. The site is located west of County Road 83 (Canterbury Road) and north of Unbridled Avenue. This review should be considered preliminary, as more comments will follow with additional submittals. Shakopee City Council July 5, 2023 FROM: Michael Kerski, Planning/Development Director TO: Mayor and Council Members Subject: XCEL Energy Encroachment Agreement for Quarry Lake Park Policy/Action Requested: Approve agreement with XCEL energy. Recommendation: Approve agreement. Discussion: XCEL Energy approved use of a portion of its property for the creation of the XCEL Energy Mountain Bike Property with a condition that the city would allow XCEL access to its peaking plant property through the city's property. XCEL staff and vendors are often waiting minutes to hours to access their service road at the railroad tracks. Since this is a private crossing, it is not regulated by state or federal laws for time spent blocking a roadway by a train. There are often situations at Blue Lake where XCEL must get into the facility quickly, especially when there is a high energy demand. This driveway will allow XCEL access in the cases where access is to its facility is blocked by a train. XCEL assumes all liability for the construction and maintenance of the new driveway. The city had explored building a road in cooperation with XCEL and the water ski club, but it was determined by Council that spending almost $800,000 on a road that benefited so few parties was not in the city's best interest. XCEL looked at putting the road on the northern side of the park but could not reach an agreement with the adjacent property owner for access. XCEL will install an access gate closer to the bend in the road to limit access to its adjacent Page 60 of 119 property. Staff raised concerns about having the mountain bike trail crossing a paved driveway that might cause accidents since the tires and braking would act differently. XCEL has agreed to leave that small portion of trail crossing in gravel. XCEL will also install signs warning riders that there is a vehicle crossing at the intersection. XCEL's attorney and the city attorney and the city's attorney have worked together on this agreement. XCEL expects to begin construction this fall after the State's regional mountain bike trials. The driveway will also be used by any emergency vehicles that may have to reach the Mountain Bike Trail or lake. XCEL's contractors will also use the driveway when the train is blocking the road during construction of the new gas peaking turbines in 2024/2025. The City is willing to permit Xcel Energy to encroach on City Property for the purposes as stated herein, on a non-exclusive basis, subject to the terms and conditions of this Agreement; and F. Xcel Energy is aware of the potential need by the City to terminate this Agreement should the City determine at its sole and absolute discretion the need to remove the encroachment. AGREEMENT NOW, THEREFORE, on the basis of the premises and the mutual covenants and agreements set forth in this Agreement, the parties agree as follows: 1. City hereby grants to Xcel Energy the non-exclusive right to enter upon and use the City Property for the purpose of construction and use of the Improvements. 2. The term of this Agreement shall be for a period of five (5) years, commencing on the date first above written extending thereafter on a year-to-year basis. City or Xcel Energy may terminate this Agreement for any reason or no reason by providing the other Parties 90 day's written notice directed to the last day of any one-year term. Notwithstanding any contrary provision contained in this Agreement, this Agreement shall automatically terminate in the event that the License Agreement is terminated for any reason other than by reason of termination of the License Agreement by Xcel Energy by reason of default of the City under the License Agreement after notice and failure to cure as required by the License Agreement. 3. Xcel Energy will, at its sole expense, construct, repair and maintain all of the Improvements within the Encroachment Area as shown on Exhibit A all in good condition and repair. Without limiting the foregoing, in the area where the bike trail and Xcel Energy driveway intersect, Xcel Energy and the City shall cooperate and work together to minimize the impact of the driveway on the bike trail, such as leaving such section of the driveway in gravel to prevent accidents. 4. Xcel Energy shall use and access the Improvements within the Encroachment Area but said access will be limited to routine passenger vehicles or light duty trucks and as depicted on Exhibit A. Delivery, industrial, heavy equipment, and truck traffic shall not use Xcel Energy's easterly access only and Xcel Energy shall use the Encroachment Area for such purposes. Notwithstanding any contrary provision contained in this Agreement, Xcel Energy's use and access of the Improvements within the Encroachment Area on weekends and holidays shall be limited to emergencies and on weekends during mountain bike events the City shall have the right to close the Improvements or restrict the Improvements and the Encroachment Area to use in connection with such mountain bike events. 5. The permission granted by the City in this Agreement is limited exclusively to the proposed Improvements within the Encroachment Area as described and depicted in Exhibit A. This Agreement shall not prevent or impair the use of the Encroachment Area for park, roadway or utility purposes by the City or any other entity entitled by law to so use the Encroachment Area. Nothing contained in this Agreement shall limit or restrict the City's rights under the License Agreement. 7. In the event the City needs to repurpose, construct, maintain, operate, repair, access, improve or remove any element located within the Encroachment Area and the Improvements unreasonably interfere with such action, the City shall provide notice of no less than 30 days to Xcel Energy pursuant to Paragraph 11 of this Agreement. The City's costs of removing or relocating the necessary portion of the Improvements in order for the City to exercise its property rights shall be paid by Xcel Energy within ninety (90) days of invoicing to Xcel Energy. Xcel Energy shall be responsible for the costs of restoring or reinstalling any of the Improvements that were removed. Any damages to the Improvements resulting from the City's activities shall be borne and assumed by Xcel Energy, provided, however, that the City shall be responsible for any damages caused by the gross negligence or willful misconduct of the City, its officials, employees, contractors and agents. 8. This Agreement shall run with the land and shall inure to the benefit of and be binding upon the parties to this Agreement and their respective successors and assigns. 9. Xcel Energy shall indemnify, hold harmless and defend the City, its officials, employees, contractors and agents, from and against any and all claims, losses, proceedings, damages, causes of action, liability, costs or expenses (including reasonable attorneys' fees), arising from or in connection with or caused by any act, omission or negligence of, Xcel Energy's contractors, licensees, invitees, agents, servants or employees in connection with the construction, repair or maintenance of the Improvements. 10. Xcel Energy agrees not to suffer or allow any liens, claims and processes to be placed against the City's rights to or interest in the Encroachment Area as a result of the use of the Encroachment Area, including, without limitation, any liens for labor or materials provided for the construction, repair or maintenance of the Improvements. 11. Shakopee City Council July 5, 2023 FROM: Michael Kerski, Planning/Development Director TO: Mayor and Council Members Subject: Adoption of NFPA 70 National Electric Code 2023 Edition Policy/Action Requested: Approve Resolution R2023-078 adopting NFPA 70 National Electric Code 2023 Edition Recommendation: Approve Resolution Discussion: The city is required to adopt any changes that the State of Minnesota makes to the building codes, including the Electrical Code. The State has adopted effective July 1, 2023 the NFPA 70 National Electric Code 2023 Edition. The city must adopt that code, which will be enforced by the city's electrical inspector. It is the minimum construction standard throughout all of Minnesota. It is not enforceable by municipalities unless it is adopted by local jurisdictions, and it creates a level playing field for the electricians industry by establishing the Code as the standard for the construction of all buildings in the state. Shakopee is one of the few communities in the metro area that has its own electrical inspector so the State does not do our plan reviews or inspections. The Minnesota Electrical Code is adopted more often than the Building Code since Minnesota makes substantial changes to the International Code Council. The Electrical Code is typically adopted largely intact by the State. Minor changes to the Electrical Code have been made, and are highlighted in the attached Frequently Asked Questions. The largest changes reflect research that inspectors have found are causing injuries or worse. These include now requiring GFCI outlets in more locations, since these monitor a circuit and limit the possibilities of electrical shock, especially in wet locations. The other change is removing outlets from the sides of kitchen Page 68 of 119 islands or in kitchens. Outlets will now be required to be on top of the counters or islands to limit the opportunities for cords being pulled on and having appliances potentially falling on children or animals. Section 110.26: The requirement for "large equipment" from 110.26(C)(2) which stated that open equipment doors may not impede access to and egress from the working space was also added to 110.26. This rule now requires that when open equipment doors result in an egress path that is less than 24 inches wide or 6 feet, 6 inches high, the opening must be increased to prevent the equipment doors from obstructing the egress path. In addition, the language clarifies that the space in front of equipment must be unobstructed by fixed cabinets, walls, or partitions. 2. Section 110.26(A)(4): Since the 2014 NEC, the NEC has required working clearances and opening dimensions for safe access to electrical equipment in spaces with limited access. In the 2023 NEC, language was added to (4) to address the workspace area for safely servicing electrical equipment with limited access. The new requirement will not allow for the placement of fixed cabinets, walls, or partitions below the limited access opening. The space below the opening is required to be unobstructed to the floor and free from any obstacles that may hinder equipment access. 3. Section 210.8(A)(6): GFCI protection requirements in dwelling unit kitchens has been expanded. The revised language in the 2023 NEC removed the phrase "where the receptacles are installed to serve the countertop surfaces", thereby expanding the GFCI protection requirement to include any 125-volt through 250-volt receptacle in kitchens — not just on countertop surface. Now the NEC will require GFCI protection for all kitchen receptacles; including the wall space receptacles required by 210.52(A), and the kitchen countertop surfaces covered in 210.52(B). 4. Sections 210.8(A)(7) and 210.8(B)(3): The revised language will require GFCI protection for receptacles located in "areas with sinks and permanent provisions for food preparation, beverage preparation, or cooking". These areas are used similarly to a kitchen, but do not meet the definition. The change could affect an area that includes a "sink" such as a recreation room wet - bar, or a convenience store where beverages or food is prepared. For the purposes of determining the area where receptacle(s) are required to have GFCI protection, the area includes the contiguous countertop or work surface that contains the sink. 5. Section 210.8(D): A list of "specific appliances" was added that will require GFCI protection for the branch -circuit or the "outlet" supplying appliances rated 150V or less to ground and 60A or less. The section clarifies that these appliances must have GFCI protection provided whether they are hardwired, or cord- and plug -connected. The expansion also included 5 new appliances: 1 Page 70 of 119 o Electric range o Wall -mounted oven o Counter -mounted cooking unit o Clothes dryer o Microwave oven 6. Section 210.8 (F): A new exception was added to not require GFCI protection for listed HVAC equipment until September 1, 2026. Garages, accessory buildings, and boathouses were added to dwelling unit outdoor outlets and will require GFCI protection. In addition, GFCI protection must be added for existing outdoor equipment that is replaced. 210.8(F) is not applicable to: • Outdoor outlets that are not readily accessible such as a submersible well pumps, sewer lift pumps, load management controllers, surge protection devices, or similar equipment. • Outdoor lighting outlets 7. Section 210.52(C)(2): The requirement for receptacles serving the countertop or work surface of an island or peninsula is made optional; however, if the receptacles are not installed at the time the cabinets and countertops were initially placed, the section requires provisions for a future outlet to be provided. The provision must include a wiring method (conduit, raceway or cable) to be extended to the island or peninsula and terminated into a junction box with cover. 8. Section 210.52(C)(3): In the same section, all receptacle outlets in the kitchen serving the countertop surface will no longer be allowed below the countertop or work surface. The receptacles, or outlet assemblies, located on the top of the countertop or work surface must be listed for the use. For purposes of this section, receptacles shall not be located within 24 inches below a countertop or worksurface. Receptacles below the countertop or worksurface shall not be used for "serving the countertop or worksurface". **If receptacle placement is according to Informational Annex J and with ADA guidelines, please contact the local AHJ to discuss options for granting "special permission" in accordance with section 90.4(C). 9. Section 210.70(A)(1): Laundry areas were added to the list of rooms that are required to have at least one lighting outlet controlled by listed wall mounted control device when you enter the room. In addition, exception number one (1) was revised to clarify that the laundry area could not utilize a switched receptacle for the lighting outlet. The lighting outlet and switch requirement would not apply to laundry rooms or areas that are in small closets or rooms only large enough for the laundry equipment, if the light source located in the adjacent space provides illumination. 2 Page 71 of 119 10. Section 215.15: A new section was added to expand the barrier requirement for feeder taps and transformer secondaries. Barriers shall be placed such that no energized, uninsulated, ungrounded busbar or terminal is exposed to inadvertent contact by persons while servicing load terminations in panelboards, switchboards, switchgear, or motor control centers supplied by feeder taps in 240.21(B), or transformer secondary conductors in 240.21(C), when the disconnecting device, to which the tap conductors are terminated, is in the open position. 11. Sections 215.18, 225.42 and 230.67: New language was added similar to section 230.67 to require surge protection devices (SPDs) for both feeders and outside feeders. The need for the protection is to limit damage to electronic devices and equipment which can be rendered inoperable by a surge. The areas where the surge protection is required has been expanded and will now include new installations as well as replacement distribution equipment located in: (1) Dwelling units (2) Dormitory units (3) Guest rooms and guest suites of hotels and motels (4) Areas of nursing homes and limited -care facilities used exclusively as patient sleeping rooms The Type 1 or Type 2 SPD must be installed in or adjacent to the distribution equipment connected to the load side of the feeder that contains branch circuit overcurrent protective device(s). In addition, the SPD shall have a nominal discharge current rating (In) of not less than 10kA. 12. Section 225.41: New language now requires a one- and two-family dwelling unit "emergency disconnect" for outside feeders. This requirement was first introduced in section 230.85 in the 2020 NEC for services. The need for the change was to ensure that first responders were always able to shut off the power on the exterior of a dwelling regardless of how the building is supplied. Section 225.41(B) requires the identification of the location of other isolation disconnects for other power sources where those disconnects are not located adjacent to the emergency disconnect. In addition, this section does not require an emergency disconnect when replacing a panelboard supplied by an outside feeder which differs from the 230.85 language. For purposes of applying the emergency disconnect requirements in 225.41 and 230.85, the Department will allow an exterior utility provided disconnect as the emergency disconnect if the following conditions are met: the disconnect is located outdoors, readily accessible, and visible from the dwelling it supplies. 13. Section 250.140(B)(5): For existing branch -circuit installations only, if an equipment grounding conductor is not present in the outlet or junction box the frame of the range or dryer shall be permitted to be connected to the grounded conductor that is part of a Type SE service -entrance cable that originates in equipment other than a service. The grounded conductor shall be insulated, or field covered within the supply enclosure with listed insulating material, such as tape or sleeving to prevent contact of the uninsulated conductor with any normally non -current - carrying metal parts. Note: Prior editions of the NEC only allowed the existing branch -circuit 3 Page 72 of 119 installation to use the grounded conductors as the equipment ground if it originated in a service panelboard. 14. Section 352.44(B): A new (B) was added to address earth movement when installing PVC conduit. Expansion fittings are now required to compensate for earth settling or movement, including frost heaving, when PVC conduit emerges from the ground. In lieu of a listed expansion fitting required in 352.44(B), to protect direct buried conductors referenced in 300.5(J), the department will permit the use of a slip sleeve (pipe inside another pipe) installation to compensate for the earth movement. As shown in the diagram below, the slip sleeve shall be a minimum of 18-inches in length and schedule 40 PVC or Schedule 80 PVC conduit. The schedule 80 PVC conduit emerging from grade used to protect the underground conductors shall extend at least 12-inches in length inside of the slip sleeve to a minimum of 18-inches below grade with a bushing or terminal fitting as required by 300.5(H). Section 406.9: The 2020 NEC addressed receptacles prohibited from being installed inside a tub or shower or within a zone measured 3 feet horizontally from any outside edge and 8' vertically above the top of the bathtub rim or shower stall threshold. In the 2023 NEC, the language was 4 Page 73 of 119 changed to clearly include the space from the floor to 8 ft above the bathtub or shower threshold. In addition, some new exceptions were added. Exception No. 1: Receptacles installed in accordance with 680.73 (receptacles for hydromassage bathtubs) are allowed. Exception No. 4: to allow a single receptacle for an electronic toilet or personal hygiene device such as an electronic bidet seat. The receptacle is required to be readily accessible and not located in the space between the toilet and the bathtub or shower. 16. Section 440.14: The revised text clarifies that the required air-conditioning and refrigeration equipment disconnecting means located within sight from and readily accessible, shall meet the working space requirements of 110.26(A). 17. Section 445.19(C): New language clarified that an "Emergency Shutdown of Prime Mover" shall be provided for one -and- two-family dwelling unit generators. For other than cord -and -plug - connected portable generators, an emergency shutdown device shall be located outside the dwelling unit at a readily accessible location and shall also meet the requirements of 445.19(A)(1) and (A)(2). An emergency shutdown device mounted on the exterior of the generator enclosure shall be permitted to satisfy the requirements of this section. The site improvements will include a new 5,200 SF Convenience Store with attached carwash, 8 new fuel pump islands under a new fuel island canopy and associated parking, drive aisles, utilities, and landscaping. The project site is located within the B-1 Highway Business District and is Part of the Windermere PUD. A C-Store with a fueling station and carwash are allowed as conditional uses in the district. This submittal will require CUP Approval, a PUD Amendment approval and Final Plat approval. The proposed 24-Hour Convenience Store with gasoline sales will employ approximately ten (10) persons. The planned operations include grab -and -go prepared food, a wide assortment of beverages and grocery items and other essential items. Alcohol and tobacco products will be sold at times per city and state alcohol laws, assuming the requisite permits are approved. Utilities: • Sanitary Sewer: Sanitary sewer will be connected to the existing main located along Windermere Way. • Water: Water will be connected to the existing main located along Windermere Way. • Stormwater: The proposed development will require stormwater quality and quantity controls which have been designed to manage water quality and quantity controls on -site in accordance with the City of Shakopee requirements . • Electric, Communications, & Gas: Electric and communications service lines will be serviced from the existing utility services located along Windermere Way and Marystown Road. Erosion & Sediment Control: Land disturbance activities will be limited to the areas of the proposed demolition and development. An E&SC plan has been prepared in accordance with the City of Shakopee and State of Minnesota requirements. Plan: Institution Wold Architects, representing ISD 720, has proposed the vacation of the alley in Block 74, City of Shakopee. The school district is proposing to vacate the alley to sell the Central School property as an entire block to the Scott County Community Development Agency (see attached survey and exhibits). The current school building and portions of previous parts of the building have encroached into the alley since at least 1937, which is the earliest aerial photo available of the site. Planning staff have notified the different utility companies serving this area of the proposed vacation. None of the utility companies have responded that they have existing or proposed utilities within the alley right-of-way. Recommendation: Adopt 02023-008 repealing section 110.999 paragraph C, adding section 110.069 and amending section 114.99 of the Shakopee City Code relating to penalties for licensed tobacco and liquor retailers. Discussion: Staff was directed to draft an ordinance amending certain penalties for tobacco and liquor violations and to mail notices to tobacco license holders advising of the proposed changes. The increase to the fees were due to the inflation costs and the increase of administrative costs in compliance checks and license failures. The fees have not been looked at since 2009. The attached ordinance repeals Section 110.999 paragraph C and adds Section 110.069 under Chapter 110 Tobacco, Tobacco Products, and Tobacco -related devices. It also amends Section 114.99 of the liquor penalties. Budget Impact: ATTACHMENTS: 0 02023-008 Page 96 of 119 ORDINANCE NO. 2023-008 AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA, REPEALING SECTION 110.999 PARAGRAPH C, ADDING SECTION 110.069 AND AMENDING SECTION 114.99 OF THE SHAKOPEE CITY CODE RELATING TO PENALTIES FOR LICENSED TOBACCO AND LIQUOR RETAILERS The City Council of Shakopee, Minnesota ordains: Section 1. Section 110.999, Paragraph C of the Shakopee City Code is repealed. Section 2. Chapter 110 of the Shakopee City Code is amended by adding the following Section: 110.069 Penalties A. Licensee. Any licensee who furnishes, sells, or attempts to sell tobacco, tobacco products, or tobacco -related devices to a minor or whose employee furnishes, sells, or attempts to sell tobacco, tobacco products, and tobacco -related devices to a minor shall be penalized as follows: 1. First incident: $1,000 fine, plus 1-day license suspension; provided; however, that the day license suspension will be suspended for 1 year on the condition that both the licensee and his or her employees have no further incidents of furnishing, selling or attempting to sell tobacco, tobacco products, and tobacco -related devices to a minor; 2. Second incident within 36 months of first incident: $1,500 fine, plus 5-day license suspension; and 3. Third or subsequent incident within 36 months of first incident: $2,000 fine, plus 30-day license suspension or revocation. B. Procedure. The penalty for a first or second incident may be imposed and administered by the City Administrator if the licensee waives the hearing authorized by § 110.065 and the licensee admits the violation. The penalties for a third or subsequent incident may only be imposed by the City Council. No suspension or penalty may take effect until the licensee has received notice of the alleged violation and an opportunity for a hearing as provided in § 110.065. C. Revocation. Any revoked license shall not be eligible for reinstatement for at least 12 months. D. Other individuals. Any individual who sells tobacco, tobacco products, and tobacco - related devices to a minor shall be charged an administrative penalty of $100, subject to the right to a hearing before the City Council as provided in § 110.065. Nothing in this Section shall prohibit the city or other jurisdiction from seeking criminal 1 Page 97 of 119 prosecution for any alleged violation of this Section by any individual other than a licensee or employee of a licensee. E. Criminal penalties. 1. Except as otherwise provided in subparagraph (5) below, it shall be a misdemeanor for anyone to sell or furnish tobacco, tobacco products, and tobacco -related devices to a minor. Whoever violates this Section a subsequent time within 5 years of a previous conviction under this paragraph shall be guilty of a gross misdemeanor. 2. It shall be a petty misdemeanor for a minor to smoke, chew, sniff, or otherwise use or ingest tobacco, tobacco products, and tobacco -related devices. 3. It shall be a petty misdemeanor for a minor to have in their possession tobacco, tobacco products, and tobacco -related devices. This provision does not apply to a minor who is an employee of a license holder while stocking tobacco, tobacco products, and tobacco -related devices or to a minor lawfully involved in a compliance check. 4. It shall be a petty misdemeanor for a minor to purchase, or attempt to purchase tobacco, tobacco products, and tobacco -related devices, or for any person to purchase or otherwise obtain such items on behalf of a minor. This provision does not apply to a minor who purchases or attempts to purchase tobacco - related products while under the direct supervision of a responsible adult for training, education, research, or enforcement purposes. 5. It shall be a petty misdemeanor for a minor to sell, furnish, or give away any tobacco, tobacco products, and tobacco -related devices. 6. It shall be a misdemeanor for a minor to attempt to disguise minor's true age by the use of a false form of identification, whether the identification is that of any other person or one on which the age of the minor has been modified or tampered with to represent an age older than the actual age of the minor. F. Continued violation. Each violation, and every day in which a violation occurs or continues, shall constitute a separate offense. Section 3. Section 114.99, Paragraph B of the Shakopee City Code is amended to read as follows: B. 1. The purpose of this division (B) is to establish a uniform set of penalties for licensees who furnish or sell alcoholic beverages to minors. The penalties for a first or second incident shall be imposed and administered by the City Administrator upon an admission by the licensee that the licensee furnished or sold an alcoholic beverage to a minor. The penalties for a third or fourth incident may only be imposed by the City Council. 2 Page 98 of 119 2. The following penalties shall be imposed if a licensee furnishes or sells alcoholic beverages to a minor: a. A $1,000 fine and a 1-day license suspension for the first incident; provided, however, that $500 of the fine and the 1-day license suspension will be suspended for 1 year on the condition that the licensee has no further incidents of furnishing or selling alcoholic beverages to minor during that 1-year period; b. A $1,500 fine and a 5-day license suspension for a second incident occurring within 3 years of the date of the previous incident; c. A $2,000 fine and a 10-day license suspension for a third incident occurring within 3 years of the dates of the previous 2 incidents; d. A $2,000 $3,500 fine and a suspension of the license for a minimum of 30 days or a revocation of the license for a fourth or subsequent incident occurring within 3 years of the dates of the previous incidents. Section 4. Effective Date. This ordinance becomes effective from and after its adoption and publication.
