Proposed Vacation of a portion of Clay Street north of 1st AvenueTO: Mayor and City Council Mark McNeill, City Administrator FROM: Julie Klima, Planner II RE: Vacation of Public Right -of -Way of a Portion of Clay Street North of County Road 69 DATE: December 20, 2011 CASELOG: 11 -019 CITY OF SHAKOPEE Memorandum INTRODUCTION The City of Shakopee has submitted an application for vacation of Public Right -of -Way of a portion of Clay Street north of County Road 69 (1st Avenue) as identified in Exhibit A. The existing right -of -way is located adjacent to the Shakopee Trading Post. This right -of -way is proposed for vacation as a part of the upcoming road improvement project for County Road 69. Should the vacation be approved, the subject property would be utilized by the Shakopee Trading Post for off - street parking and Clay Street would be reconfigured as a part of the road project. Please see Exhibit B for plan submitted by Scott County. DISCUSSION On November 1, 2011, the City Council adopted a resolution setting December 20, 2011 as the public hearing date for this vacation request. Two weeks published public notice is required prior to conducting the public hearing. The notice of public hearing has been published in the Shakopee Valley News, however, only 12 days notice has been provided, rather than the 14 days required. Therefore, staff is requesting that the public hearing be opened and continued to the January 3, 2012 meeting in order to provide adequate public notice. This will allow for sufficient published public notice and the Council would then be able to review and potentially take action on this item at that meeting. STAFF RECOMMENDATION Staff recommends that the public hearing be opened and continued to the January 3, 2012 meeting. ACTION REQUESTED Open the public hearing and continue it to the January 3, 2 2 meeting. Scott County, MN Map Scale 1 inch = 379 feet Map Date 12/1/2011 EXHIBIT B CLAY STREET VACATION CLAY STREET VACATION DESCRIPTION: EXHIBIT C Page 1 of 1 SAP 70 669 - 002 (CP 69 - 02) Parcel No. 20 All that part of the East Half of Clay Street, City of Shakopee, according to the recorded plat thereof, Scott County, Minnesota, lying northerly of a line being 7.00 feet northerly of and parallel to the North line of First Avenue and lying southerly of the following described line: Beginning at a point on the centerline of Clay Street, 40.00 feet southerly of its intersection with the westerly extension of the South line of the Alley through Block 11, City of Shakopee; thence northeasterly to the intersection of the East line of Clay Street and the South line of the Alley through Block 11, City of Shakopee and there terminating. Reserving, in favor of the City of Shakopee, an easement for drainage and utility purposes, over, under, and across the West 15.00 feet of the East Half of Clay Street, City of Shakopee, according to the recorded plat thereof, Scott County, Minnesota.
