CR 101, from CSAH 17 to Spencer Street Project

INTRODUCTION:
Attached is Amendment No. 1 to the Construction Cooperative Agreement on the CR 101
project done this past summer for Council review and approval.
BACKGROUND:
On March 15, 2011 the City of Shakopee entered into a Cooperative Agreement with Scott
County the County Project No. CP- 101 -07 (CR 101), from Spencer Street to CSAH 17. In this
agreement, the City is responsible for certain costs such as City utilities, decorative lights,
colored sidewalk, decorative bollards and engineering costs relating to these items.
Since the execution of this agreement, there were three additional engineering items relating to
street lights and storm sewer design, as described in Amendment No. 1 and attached letter from
Chris Chromy of Bolton & Menk, Inc.
The total additional cost for additional engineering services is $18,955.00 in which $5,500.00
would be from Surface Drainage Fund and the remaining costs out of the Capital Improvement
Fund (CIF). Previously, the CIF budget for this project was $325,000.00. During the project,
the City added additional lights west of Fillmore Street and paving of streets north of 1 Avenue.
The estimated costs affecting the CIF budget is approximately $275,000.00, including these
additional engineering costs
Staff has reviewed these costs with the County and consultant and have agreed to the additional
engineering services. The recommendation is for Council to approve Amendment No. 1 to the
Construction Cooperative Agreement on the CR 101. Project.
ALTERNATIVES:
1. Authorize the appropriate City officials to execute Amendment No. 1 to Construction
Cooperative Agreement on County Project No. CP- 101 -07 (C.R. 101).
2. Do not authorize Amendment No. 1.

TO
CONSTRUCTION COOPERATIVE AGREEMENT
Per section No. 5. of the Construction Cooperative Agreement made and entered into by and between
Scott County, "County" and the City of Shakopee., "City ", for cost participation for the improvements to County
Highway (CH) 101 from CSAH 17 to Spencer Street in the City of Shakopee, the below authorized
representatives of the County and City agree to the following amendment to the Agreement:
The total Amendment cost of $18,955 is 100% City responsibility. The City of Shakopee has agreed to
reimburse the County within 30 days of receipt of invoice. See Attached Exhibit.
All other terms and conditions of the original Agreement between the parties hereto not specifically
amended herein shall continue in full force and effect.
IN WITNESS WHEREOF, the County and the City by their authorized partner or officer have hereunto
subscribed their names in duplicate.

• Additional Engineering Services, requested by the City, for identifying light pole and fixture
options after completion of the final plans and specifications. ($8,455)

RE: Proposal for Professional Engineering Services
Additional Services Associated with the CSAH 101 Reconstruction Project
Shakopee, Minnesota

Dear Mitch:
We are pleased to submit the following scope of work and estimated fees for additional services
associated with the CSAH 101 Reconstruction Project. The additional services are deemed necessary for
the completion of the project and are described below:
Task 6 — Final Design/Construction Documents
Bolton & Menk assisted in identifying alternative light pole and fixture options after completion of the
final plans and specifications. The options were prepared to promote greater competiveness in the
bidding process. Our cost to provide these services was $.13,440. Per negotiation with the City Engineer,
we have agreed to waive the charge for a portion of these services deemed redundant to services provided
by another consultant directly to the City. The redundant services totaled $4985 and included research of
vendors and products as well as coordination with the City's consultant. The remaining $8455 is
associated with execution of changes into the plans and specifications, preparation of addenda,
coordination with Scott County staff to implement addenda.
Requested Additional Fee: $8,455
Per request of the City Engineer, Bolton & Menk prepared design plans and specifications for extension
of the street lighting system west of Fillmore Street. Per negotiation with the City Engineer, we have
agreed to a design fee of 10% of the bid price for this addendum. Contractor's bid for this work is
$50,000.
Requested Additional Fee: $5,000
Task 10 — Stormwater
As you are aware, Scott County and the City of Shakopee approved an amendment to our contract for the
design of the storm sewer outlet at Market Street. Two alignment options were presented in the previous
amendment. Unfortunately, the complexity of the options and the time constraint of the project delivery
resulted in work outside of amended scope of services. This additional work included final design
analysis on both options including utility verifications and modifications, flow calculations and profiles,
cost estimates, and state aid participation coordination.
Requested Additional Fee: $5,500
