Dean Lakes Conservation Easement Encroachment Request ��. �. ��. � � CITY OF SHAKOPEE Memorandum TO: Mayor and City Council Mark McNeill, City Administrator FROM: Julie Klima, Planner II RE: Dean Lakes Conservation Easement Encroachment Request DATE: December 6, 20ll DISCUSSION ' In 2003 with the approval of the Dean Lakes PUD, Ryan Companies granted a conservation easement to the City over a portion of the PUD. The easement document includes the following provision. "Grantor shall not place or perfnit others to place any building, road, sign (other than entry monument signs), billboard, utiliry, or other structuNes in the easement area without the prior written consent of the City." Ryan Companies is requesting the ability to extend utilities to the new JoAnn Fabrics store through the conservation easement. Please see Exhibit A for general location of the Dean Lakes PUD. Please also find attached as Exhibit B a copy of the correspondence from Ryan Companies: The developer is requesting the ability to encroach into the conservation easement in order to extend phone and gas utilities to the JoAnn Fabrics store under construction between the existing Lowe's and Slumberland stores. As is outlined in the attached letter from Ryan Companies, they are proposing to extend the phone and gas services through the conservation easement area south of the new store. The intent is to directional bore the utilities in place and restore any disturbance to the existing condition consistent with the restoration requirements of the area. Ryan Companies has also included a graphic depicting the location for the extension of the � utilities, as well as, bids for conducting the associated work. In the letter, Ryan Companies explains the additional costs that would be incurred by using route(s) other than the one proposed through the easement area. ALTERNTIVES 1. Direct staff to prepare written communication consenting to the placement of phone and gas utilities within the conservation easement area. 2. Do not approve the request to locate utilities within the conservation easement area. 3. Table a decision on this item and request further information from staff and/or the applicant. The cost to get #he phone line from the property line to the ne�v building is $5,000. Alternate routes were e�cplored theough the Slumberland propertq and from the north. The additional cost to use an easement for the phone line through the SlumberIand property is $10,000.
