CITY OF SHAKOPEE Memorandum �"" °"` F e l,•• r� � n.-„ , � t =: 7 TO: Mayor and City Council �` "`' °�� ��� u o-� FROM: Mark McNeill, City Administrator SUBJECT: Update-Land Donation (l Avenue & Marschall Road) DATE: November 15, 2011 Comment: Introduction: The purpose of this memorandum is to pxovide an update on the discussion which was I held at the November 1�` meeting, regarding a possible donation of land on First Avenue. Background: The attached memo from Jamie Polley dated November 1 s ` describes an undeveloped I three acre parcel of land located between the Travelodge Motel, and Valley Haven Mobile Home Park. The Minnesota Department of Natural Resources has been considering receipt of the three acres as a donation from an area landowner. The DNR intends for it to be used to construct a trailhead for a re-routed Minnesota Valley State Snowmobile Trail. A concern with keeping the trail in its existing alignment is the $25Q000 estimated replacement cost of a trail bridge across Mill Creek. Public Works Director Bruce Loney has been in contact with Mazk Themig of Scott County regatding the possible relocation ' of the snowmobile trail to the east, so that there would noY be a reconstruction necessary for the bridge. The Scott County Soil and Water Conservation District, and Three Rivers Parks District would have to agree to move the crossing. There is an existing land crossing, and, with some modification of the culvert there, the trail could be relocated to , that point. The discussion at the November 1 s ` meeting led to a consensus from the Council that it would prefer not to have snowmobiles along First Avenue, due to safety and noise considerations for adjacent businesses and residents. A further consensus of the Council was to keep snowmobile trails in the more scenic part of the river bottoms, across from Memorial Park. Retaining the trail in its existing location would also best utilize existing parking facilities at Memorial and Huber Parks. Comments since received from the secretary of the River Valley Trail Blazers snowmobile club also indicate a preference for the trail location to remain in its existing alignment. In speaking with a representative of the owners of the three acre parcel, they have no preference as to whether it goes to the City, or Minnesota DNR—from a tax advantage standpoint, those are equal options. The only preference would be to make the donation this tax year if possible. The DNR indicates that it has no need for the parcel other than the desire for a � snowmobile trail easement on it. I From the City's standpoint, we believe that the three acres have a potential for economic development-it is near busy intersection, adjacent to a recently reconstructed roadway, and utilities are available. We know that the site has had development interest in the past. Recommendation: We recommend that the Council direct staff to continue to work with the owners of the three acre pxoperty, as well as the Department of Natural Resources, Scott County, Three Rivers Parks Districts, and Scott County Water Conservation District, to facilitate a donation to the City wbich would allow for: 1. A continuation of the DNR's Minnesota Valley State Snowmobile Trail; 2. A taY-advantaged land donation by the owners, and; 3. An econon�ic development potential for the City. The City Attorney would draw up the donation papers, should this come to fruition. Relationship to Visiooing: This supports Goal D"Maintain, improve and create strong partnerships wiTh other public and private sector entities". Action Required: If the Council concurs, it should, direct staff to continue negotiations with the Department of Natural Resources, Scott County, Three Rivers Parks Districts, and Scott County Water Conservation District, for the donation of a three acre parcel of land located east of Marschall Road, and north of First Avenue. � �1� � ��C iL; Mark McNeill City Administrator l MM:cn I I �. � o g - CI7Y OF SHAKOPEE MEMORANDUM To: Mayor and City Council Mark McNeill, City Administrator From: Jamie Polley, Parlcs, Recreation, and Natural Resources Director Meeting Date: November 1, 2011 Subject: Donation of Land to MN DNR INTR�DUCTION Staff from the MN Department of Natural Resources has been approached by a local land owner to accept the donation of their land and is seei<ing comments from the City Council. BACKGROUND City Staff has currently been working with staff from the MN DNR and Scott County to determine options to replace the pedestrian bridge in Memorial Park (Attachment A). The estimated cost to replace the pedestrian bridge is $250,000. Staff is seel<ing possible grants available for application that can assist with tlie cost. During the conversations regarding the bridge a local land owner near Memorial Park has approached the MN DNR to accept the donation of his land. The land is approximately 3 acres and is located between Valley Haven Mobile Home Park and the Travel Lodge Hotel. DlSCUSSION The MN DNR is considering accepting the 3 acres as a donation. The MN DNR feels that they can use a portion of the property to possibility reroute the MN Valley State Trail from the campground through this land, along 101 and into Memorial Parl< (Attachment B). This could eliminate the need to replace the bridge in Memorial Parl<. The MN DNR does also have the ability to sell ihe land or a portion of the land that they feel they cannot use properly. It is also a high possibility that if the MN DNR does not accept the land the property owner will donate it to another entity. Prior to accepting this land the MN DNR would lil<e to obtain feedbacl< from the City Council about their thoughts and feelings of the land becoming property of ihe MN DNR, the potential for the state trail to be rerouted along 101 for a short segment and uses of the trail on this segment throughout the year. It should be noted that the MN Valley State Trail is a major snowmobile trail in this area. Staff from the MN DNR will be present at the Council meeting to answer any questions. ' REQUESTED ACTION The City Council is asked to provide staff with feedbacl< regarding the donation of land along 101 to the DNR.
