No. 7223 � CITY OF SHAKOPEE Memorandum CASE NO.: 12-028 TO: Mayor and City Council Mark McNeill, City Administrator FROM: Mark Noble, Planner II SUBJECT: Public Hearing for Vacation of Public Right-of-Way Adjacent to Rahr Malting Company MEETING DATE: August 21, 2012 ACTION SOUGHT: Rahr Malting Company is requesting that the City Council review and approve their request to vacate public rights-of-way. INTRODUCTION: Rahr Malting Company has submitted an application for vacation of public rights-of-way adjacent to their property in the area north of 3rd Avenue West, south of 1 st Avenue West,West of Apgar Street, and East of Jefferson Street (see Exhibit A for general location). DISCUSSION These rights-of-way are proposed for vacation as a part of Rahr's plan to consolidate their property into a more manageable legal description. Rights-of-way included in this request include portions of Adams Street, Washington Street, Webster Street, Cass Street, Clay Street, Pierce Street, Shumway Street, and a number of public alleys (approx. 30,473 square feet). Should the vacation be approved, the applicant would proceed with a new plat/registered land survey that would consolidate their property. CONSIDERATIONS City departments, Scott County and other outside agencies were given the opportunity to review and provide comments regarding this application. The Engineering Department has provided a memorandum that lists conditions to be included should this application be approved by the Council. Specifically, the city would request as-built/record drawings for public utilities in Adams Street, Clay Street and Pierce Street, and dedication of drainage and utility easements for those utilities. Shakopee Public Utilities Commission (SPUC) also provided a memorandum, noting desired conditions should the request be approved. Those conditions were similar to City Engineering, where they are requiring easements for their overhead power lines in specific locations (see attached memorandum). Xcel Energy commented that they currently have several underground feeders along First Avenue that will not be considered abandoned until after August 30, 2012. There are several structures that are located within a number of these streets and alleys proposed for vacation. This is a situation that has existed for numerous years. This vacation would eliminate the conflict with structures located within public rights-of-way. ALTERNATIVES 1. Approve the vacation request, subject to recording of drainage and utility easements over portions of the subject area, as described in the City of Shakopee Engineering Deparhnent and Shakopee Public Utility Commission's memorandums. 2. Approve the vacation request, subject to revised conditions. 3. Do not approve the vacation request. 4. Table the decision to allow staff or the applicant time to provide additional information. PLANNING COMMISSION RECOMMENDATION The Planning Commission considered the request at its August 9, 2012 meeting, and by a 4-0 vote, they recommended Alternative No. 1; recommend to the City Council the approval of the vacation, subject to recording of drainage and utility easements over portions of the subject area, as described in the City of Shakopee Engineering Department and Shakopee Public Utility Commission's memorandums.
