ACTION SOUGHT
Offer and pass Resolution No. 7222, a resolution approving the preliminary and final plat of Valley Park
17`�' Addition. This action has no immediate budget impact.
INTRODUCTION
HHS LLC has submitted an application for preliminary and final plat approval of Valley Park 17`�'
Addition on property located south of 12'�' Avenue, north of Highway 169, and east of CSAH 83. The
subject size is approximately 1 1 acres and proposes the creation of 3 lots and an outlot.
PLANNING COMMISSION RECOMMENDATION
The Planning Commission reviewed the request for preliminary plat approval at its August 9`�' meeting
and recommended to the Council that the preli�ninary plat be approved s�ibject to the conditions proposed.
A copy of the report to the Planning Commission is attached for tl�e Council's reference.
ALTERNATIVES
1. Offer and pass Resolution No. 7222, a resolution approving the preliminary and final plat of
Valley Park 17`�' Addition.

RESOLUTION NO. 7222
A RESOLUTION OF THE CITY OF SHAKOPEE,MINNESOTA APPROVING THE
PRELIMINARY AND FINAL PLAT OF VALLEY PARK 17'�F� ADDITION
WHEREAS, HHS, LLC,applicant and property owner, has made application for preliminary and
final plat approval of Valley Park 17`�'Addition; and
WHEREAS,the subject property is legally described as:
That part of Lot 1, Block 2, Valley Park 12`"Addition lying Easterly of the following described lirre:
commencing at the northea�st corner of said Lot 1, I3lock 2; thence South 89 degrees 02 minutes 41 seconds
West, an assumed bearing, along the north lin�e of�said Lot 1, a distance of 12�8.77 feet to the point of
beginning of the line to be described; thence South 0 degrees 56 rninutes 58 seconds East a distance of
450.58 more or less to the south lot line of Lot 1 and said line there terminating; and
WHEREAS, on August 9, 2012, the Planning Commission recommended approval of the
proposed preliminary plat of Valley Park 17`�' Addition with conditions; and
WHEREAS,the Shakopee City Co�incil reviewed the Preliminary and Final Plat for Valley Park
17`�'Addition at its August 21, 2012 meeting; and
NOW THEREFORE, BE IT RESOLVED by the City Cou��cil of the City of Shakopee,
Minnesota that the preliminary and final plat of Valley Park 17`�' Addition is I�ereby approved subject to
the following conditions:
I. The following procedural actions must be completed prior to the recording of
the Final Plat:
A. Approval of title by the City Attorney.
B. Execution of a Developers Agreement, which shall include provisions for security for
public improvements within the Final Plat, as well as payment of engineering review
fees, a��d any otl�er fees as required by the City's adopted fee schedule.
1. Street lighting to be installed in accordance with the requirements of the
Shakopee Public Utilities Commission.
2. Electrical system to be installed in accordance with the requirements of the
Shakopee Public Utilities Commission.
3. Water system to be installed in accordance with the requirements of the
Shakopee Public Utilities Commission.
4. Ii�stallation of sanitary sewer and storm sewer systems in accordailce with the
requirements of the Design Criteria and Standard Specifications of the City
of Shakopee.
5. The developer shall be responsible for payment of Trunk Storm Water
Charges, Tl-unk Storm Water Storage and Treatment Charges, and Trunk
Sanitary Sewer Charges, as required by the most current City of Shakopee
Fee Schedule.
6. Payme»t of all storm water management review charges as required by the
most current City of Shakopee Fee Schedule.

7. The City shall be granted a 20 foot trail easement over the draina�e and
utility easement along 12°i Avenue for the entire length of the plat.
8. Park dedication fees in the amount req�iired by the City Code and adopted
City fee schedule shall be paid prior to the recording of the final plat. Park
dedication fees in the amount required by the City Code and adopted City fee
schedule shall be paid per lot at the tiine of building permit if submitted prior
to the recording of the final plat.
9. Easements shall be shown on the Final Plat and as approved by the City
Engineer. They will include, but are not limited to, the followi��g:
a) Minimuin drainage and utility easements for public utilities need to
be dedicated per the City of Shakopee Design Criteria, Section
10.1(A-D). The ease�nents need to be centered alo►�g the public
utility alignments.
b) Provide a minimum of twenty(20)feet of drainage and utility
easement adjacent to the west, north, and south property lines of Lot
1, Block l.
c) Provide a mii�imum of twenty (20) feet of drainage and utility
easement adjacent to the north and south property lines of Lots 2 and
3, Block l.
d) Provide a minimum of sixty(60)feet of drainage and �itility
easei��ent centered on the existing sanitary sewer located in the
northern portions of Lots 1, 2, and 3, Block 1.
e) Provide a minimum often (]0) feet ofdrainage and utility easement
adjacent to all interior lot lines.
� Outlot A will be deeded to the City of Shakopee.
g) Provide a drainage and utility easement over all of Outlot A.
h) Provide a mi»imum of twenty (20)feet of trail easement adjacent to
northern lot lines.
IL The following procedural actions must be completed prior to the issuance of a grading
permit:
A. No public improvements shall be constructed until the City Ei�gineer and the
Shakopee Public Utilities Commission (SPUC)approves the Final Construction Plans
and Specifications.
B. The applicant shall obtain a NPDES permit prior to any land disturbing activity. A
copy of this permit shall be provided to the City.
C. The applicant needs to submit a landscaping plan in compliance with the most rece»t
version of the City of Shakopee's Easement Fencing and Landscaping Policy.
D. Surface water runoff for each of the lots will be required to be piped to the regional
storm water basin to the south. Overland flow will not be allowed as this creates a
potential for future erosion issues.
III. Following approval and recording of the final plat,the following conditions shall apply;
A. All effort should be made to save the 32" oak tree located on the site.
l. If the applicant can preserve the 32' oak tree, silt fence and/or tree protection
fence must be installed at the drip line of the tree. The applicant must
co��tact the Parh, Recreation &Natural Resources Director prioc to ai�y land
disturbing activities for an inspection of the tree protection/silt fence installed
at the drip line of the tree to be preserved.
2. Tree protection fence for mass grading is to remain in place the duration of
the la��d disturbi»g activities, including the building of structures. Removal
of the silt fence and tree protection fence for mass grading will be the
responsibility of the applicant.

B. Bui(ding constructioi�, sewer, water service, fire protection and access will be
reviewed for code compliance at the time of building permit application(s).
C. Provide electronic (AutoCAD and Adobe Acrobat) files of the Final Plat to be
recorded with datum on the Scott County coordinate system.

DISCUSSION:
HHS, LLC has submitted an application for preliminary and final plat approval of Valley Parlc
17t�, Addition located north of Hwy. 169 and south of 12t�'Avenue East (please see Exhibit A).
The plat, as currently proposed, contemplates the creation of 3 lots and an outlot on
approximately 11 acres. Please see Exhibit B for a copy of the proposed preliminary plat. The
proposed parcel that is shaded gray indicates the location for the proposed Holiday Inn
EYpress that the City recently issued a Conditional Use Permit(CUP) for.
The property is currently zoned Business Park (BP) however, an application for rezoning the
property to Highway Business (B1) is currently under review. The plat has been reviewed
against the design standards for both zones and meets the appropriate lot sizes for either zone.
Therefore, regardless of the outcome of the rezoning application, the preliminary plat should
be in compliance with zoning requirements for either zoning district.
Cohzments fi°om Citv De�artments/Outside A e�
The City's Engineering Department has provided comments that are attached as Exhibit C.
The recommended conditions of approval have been ulcoi-porated into the staff

recommendation. Primarily, these recommeizded conditioi7s relate to easements that will i7eed
to be provided on the plat prior to recording with Scott County.
The Park aizd Recreation Department has provided comments which are attached as Exhibit
D. These comments relate to park dedication fees that will be required with the recording of
the final plat, provision of a trail easement, and tree preservation.
Shalcopee Public Utilities (SPUC)has commented that it will review the site grading plan to
verify i�any adjustments to the depth of utility lines will be necessary.
STAFF RECOMMENDATION:
Staff recommends that the Plannii7g Commission recommend to the City Council the approval
of the Preliminary Plat of Valley Park 17t" Addition, subjec�to the following conditions:
I. The following procedural actions must be completed prior to the recording of
the Final Plat:
A. Approval of title by the City Attorney.

Criteria, Section 10.1(A-D). The easements need to be
centered along the public utility aligiunents.
b) Provide a minimum of twenty (20) feet of drainage and
utility easeinent adjacent to the west, north, and south
property lines of Lot 1, Block 1.
c) Provide a miiumuin of twenty (20) feet of drainage and
utility easeinent adjacent to the north and south property
lines of Lots 2 and 3, Block 1.
d) Provide a miniinuin of sixty (60) feet of drainage and utility
easement centered on the existing sanitary sewer located in
the northern portions of Lots 1, 2, and 3, Block 1.
e) Provide a minimum of ten (10) feet of drainage and utility
easement adjacent to all interior lot lines.

II. The following procedural actions must be completed prior to the issuance of a

The application indicates a request for a Preliminary Plat and Final Plat review of a property
currently zoned as Business Park (BP). The property is Lot 1 of Block 2 of the Valley Park 12tn
Addition and is located along the south side of 12th Avenue, east of County Road 83 (Canterbury
Road).
This review should be considered preliminary, as more comments will follow with additional
submittals. However, I offer the following comments at this time for the applicant and for the
planning department:
General Conditions
The following items need to be addressed/completed prior to release of the Final Plat for
recording:
1. Execution of a Developer's Agreement, which needs to include provisions for security
for public improvements within the Final Plat and applicable engineering review fees.
2. Payments of Trunk Sanitary Sewer Charges need to be made, as required by the most
current City of Shakopee Fee Schedule.
3. Payments of Trunk Storm Water Charges and Trunk Storm Water Storage and Treatment
Charges need to be made, as required by the most current City of Shakopee Fee
Schedule.
4. Provide electronic files (AutoCAD and Adobe Acrobat formats) of the Final Plat to be
recorded with datum on the Scott County coordinate system.

The following items need to be addressed/completed prior to approval of a grading permit
and/or a street and utility plan:
1. No improvements (site grading and street and utility) will be constructed until the City
Engineer and the Shakopee Public Utilities (SPU) approves the required Final
Construction Plans and Specifications.
2. The applicant will comply with the applicable maximum allowable impervious surface
percentage set forth by the City Code.
3. Surface water runoff for each of the lots will be required to be piped to the regional
storm water basin to the south. Overland flow will not be allowed as this creates a
potential for future erosion issues.
4. The applicant needs to obtain a NPDES construction site permit prior to any land
disturbing activity. A copy of this permit will be provided to the City.
5. The applicant needs to submit a landscaping plan in compliance with the most recent
version of the City of Shakopee's Easement Fencing and Landscaping Policy.
Final Plat Conditions
The following items need to be addressed/completed prior to release of the Final Plat for
recording:
1. Easements need to be shown/referenced on the Final Plat and as approved by the City
Engineer. They will include, but are not be limited to, the following:
• Minimum drainage and utility easements for public utilities need to be dedicated per
the City of Shakopee Design Criteria, Section 10.1 (A-D). The easements need to be
centered along the public utility alignments.
• Provide a minimum of twenty (20) feet of drainage and utility easement adjacent to
the west, north and south property lines of Lot 1 of Block 1.
• Provide a minimum of twenty (20) feet of drainage and utility easement adjacent to
the north and south property lines of Lots 2 and 3 of Block 1.
• Provide a minimum of ten (10) feet of drainage and utility easement adjacent to all
interior lot lines.
• Provide a minimum of sixty (60) feet of drainage and utility easement centered on
the existing sanitary sewer located in the northern portions of Lots 1, 2 and 3 of
Block 1.
• Outlot A will be deeded to the City of Shakopee.
• Provide a drainage and utility easement over all of Outlot A.
• Provide a minimum of twenty (20) feet of trail easement adjacent to the northern
lot lines.

STAFF RECOMMENDATIONS
Staff recommends approval of the requested Preliminary& Final Plat for Valley Park 17tn
Addition with the following conditions;
1. Park dedication fees in the amount required by the City Code and adopted City fee
schedule shall be paid at the time of recording of the final plat. Park Dedication
fees in the amount required by the City Code and adopted City fee schedule shall
be paid per lot at the time of Building Permit if submitted prior to the recording of
the final plat.
2. Grant the City a 20' trail easement over the drainage and utility easement along
12th Avenue for the entire length of the plat.
3. All effort should be made to save the 32" Oak Tree located on the site.
a. If the applicant can preserve the 32" Oak tree, silt fence and/or tree
protection fence must be installed at the drip line of the tree. The applicant
must contact the Parks, Recreation&Natural Resources Director, 952-
233-9514, prior to any land disturbing activities for an inspection of the
tree protection/silt fence installed at the drip line of trees to be preserved.
b. Tree protection fence for mass grading is to remain in place the duration of
the land disturbing activities, including the building of structures.
Removal of the silt fence and tree protection fence for mass grading will
be the responsibility of the applicant.
