Subject: Recording of Declaration of Easement within Park Area of the
Greenfield EasUPark Meadows Park
� INTRODUCTION
A Declaration of Easement for utility purposes is being established within the
park area of the Greenfield East/Park Meadow Park. The proposed easement
contains a water main at this time.
BACKGROUND AND DISCUSSION
The water main located within the ark land of the Greenfield EasUPark
P
Meadows Park was installed during the development process in 2005. To date
the easement has not been recorded. The establishment of a utility easement
requires City Council approval since the utility easement was not recorded prior
to the land being transferred to the City. A copy of the declaration of easement
and site location is attached for your reference.
Also attached is a memo dated October, 12, 2011 from the SPUC Planning and
Engineering Director, Joe Adams seeking SPUC approval to request this utility
I easement.

REQUESTED ACTION
If the Council concurs, authorize the recording of the Declaration of Easement
located on park property within the Greenfield EasUPark Meadows Park and
authorize the proper City officials to sign the easement.

� DECLARATION OF EASEMENT
' THIS DECLAI2ATION OF EASEMENT (the "Declaration") is made this day of
201 1, by the City of Shakopee, a municipal corporation under the laws of
the State of Mi�mesota (the "DeclaranY').
Recitals
A. Declaraut is the fee owner of certain real estate (the "Property") in Scott County, Minnesota,
legally described in attached Exbibit A.
B. Declarant wishes to establish a non-exclusive, permanent easement for utility purposes as
hereinafter described in, over and across portions of the Properry.
Declazation

Now, therefore, the Declazant hereby declares that the Property shall be held, sold and conveyed
subject to the following easement, which shalt inure to the benefit of the City of Shakopee:
1. Utilitv Easement The Properry shall be subject to a non-exclusive, permanent
easement for utility purposes over, tmder and across the azea legally described in attached Exlubit B
and depicted on attached Exhibit C.
2. Scope of �asement Riehts. The perpetual drainage and utiliTy easement created
herein includes flie right of the City of Shakopee, its contractors, agents, employees and permitees to
enter the premises at all reasonable times for the purpose of locating, constructing, reconstructing,
operaUng, maintaining, inspecting, altering and repairing storm sewer, sanitary sewer and water
facilities and ground surface drainage ways in the described easement area.
I The easement created herein also includes the right to cut, tiim, or remove from the
easement area trees, shrubs, or other vegetation as in the City of Shakopee's judo�nent unreasonably
I interfere with the easement or facilities of the City of Shakopee, its successors or assigns.
3. Easement to Run with Land; No Mereer. The easement created herein shall run
I with the land and be binding on all parties having any right, title or u�terest in the Property, their
heirs, successors and assigns. The Declarant imends that the easement created herein shall not
merge in DeclaranYs title to the Property and that any future conveyance of the Properiy by
Declazaut shall be subject to this Declazation of Easement unless the instrument of conveyance
I expressly states an intention to terminate this Declaration of Easement.
4. Amendment; Modification; Terrnination. This Declaration may not be amended,
modified or ternunated wifliout the consent of the City of Shakopee.

Comtuissiou did reimburse tl�e developer for trunlc water main over sizing costs to increase the pipe diameter
I size to 12 inch per the Coirunlssion's adopted Trunk Water policy.
At the time of development, the construction plans as approved by the Utilities Manger depicted a 20 Foot wide ;
easement over tlte water maiu, but tlte platted area desiguated Outlot B of the Greenfield Addition did not
I include the easement nor was a seperate legal document created Uy tl�e developer to record the easement prior to
the developer transferring the parcel to the City for park purposes.
I
Tl�e City is the process of developing tl�e parcel with parl< improvements that include a�arking lot, a smal(
structure, fields sand play areas with equipment.
I DISCUSSION
i `I'he Utilities Coinmission sliould have an easemevt over the water main fa opezation and maintenance. City
staff has worlced cooperatively with the utility to cstablish the easement area so it does not conflict with any of
, the p�rk improvements under consttuctiou. As of now, my undeistanding is the only improvements tltat may
fall inside of the easement area are turf and a small portion of a chain linl< fence for the outfield of the ball field
in the parlc The utilities would of coui'se be responsible for restorationh'eplacement of these items shottld ttte
need ever arise to excavate foi'repair or replacement of the water main.
� RCCOMMENDATION
� Staff reconmiends the Conunission approve a request to the City Counci] for av easement for the water main as '
described on the attached documents. I
