SUBJECT Sentencing to Service Amendment

Comment:
Introduction:
The City Council is asked to approve an amendment to the Joint Powers Agreement
(JPA) with Scott County for Sentencing to Service (STS) crews.
Background:
Scott County and all of the incorporated cities in Scott County have participated in the
STS program for many years. STS allows for non - violent offenders to receive time off
their incarceration by performing work to benefit host cities. The type of work being
performed is a variety that would not normally be completed, if not for STS - clearing of
brush, sandbagging during flooding operations, clean up in the Shakopee ice arena, etc.
The STS work does not supplant the normal work done by city work crews.
Because of funding uncertainties at its level, the County has proposed to change the way
that it is reimbursed for the supervisors who work with the STS crews. Up to this time,
each city has been billed equally (most recently, $6800 per year), and for that received
approximately twenty crew -days of STS labor.
It has been noted that some cities have greater needs for STS crews than what the current
budgetary model allows. Conversely, other cities don't use their full allocation.
Therefore, in order to be fair to all, the County is proposing have participating cities be
billed $332.38 per day for each crew that works.
Budget Impact:
If the City uses the crews less than twenty days per year, this proposed change will result
in an overall savings to the City. Staff will monitor to make certain that STS crews are
not used in excess of the budgeted $6800 annual allocation, unless other internal
budgeting sources are available.
It should be noted that this amendment would be effective retroactive to July 1 2011.
Because the City had not been billed the $6800 for this year, there will likely be an
overall savings to the City.
Recommendation:
I recommend that the amended Joint Powers Agreement for STS be approved.
Relationship to Visioning:
This supports Goal D — Maintain, improve, and create strong partnerships with other
public and private sector entities.
Action Required:
If the Council concurs, it should, by motion, authorize the appropriate City Officials to
execute the attached Joint Powers Agreement with Scott County relating to the
Sentencing to Service program. n

AMENDMENT TO JOINT POWERS AGREEMENT
This Amendment to the Joint Powers Agreement by and between the County of Scott, hereinafter referred
as "County," and the City of Shakopee, hereinafter referred as "City" approved on February 2, 2011
effective January 1, 2011 through December 31, 2011.
WITNESSETH THAT:
WHEREAS, Provider has entered into an agreement with the County, effective January 1, 2011
through December 31, 2011, for the provision of "Sentencing to Service" (STS); and
WHEREAS, Provider and the County find it to be to their mutual benefit to revise the terms of the
aforementioned Agreement;
NOW THEREFORE, in consideration of the mutual covenants contained herein, the parties
hereto agree that the aforementioned Agreement is amended pursuant to the CHANGES Clause
of the Agreement as follows:
1. The TERMS OF PAYMENT clause shall be amended effective July 1, 2011 to read as
follows:
A. City agrees to pay County three hundred thirty two dollars and thirty eight cents ($332.38)
per day for crew services received.
B. Terms of Payment
County shall submit invoices on a quarterly basis to the authorized agent of the City for
payment of work completed. Payments shall be rnade within thirty (30) days after receipt of
invoices.
2. OTHER CONTRACT PROVISIONS
All provisions of the aforementioned Agreement approved and not specifically amended hereto
shall continue with full force and effect.
