No. 7122 • CITY OF SHAKOPEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Public Hearing for the CSAH 69 Utility Improvements, Project No. 2011 -6 DATE: September 20, 2011 INTRODUCTION: As per Resolution No. 7112, a resolution receiving a report and calling for a public hearing on the CSAH 69 Utility Improvements, Project No. 2011 -6, a public hearing is scheduled for September 20, 2011. This agenda item is to conduct the public hearing for the proposed improvements associated with the CSAH 69 Utility Improvements Project. This is a Council initiated project that requires a supermajority vote to move forward. BACKGROUND: On July 15, 2011, City Council ordered the preparation of a preliminary engineering report for the CSAH 69 Utility Improvements. The report was completed and accepted by City Council on August 16, 2011. The proposed project is to extend sanitary sewer and water service to properties along CSAH 69 while this County road is being reconstructed by the County. The improvements would be installed with the County project and to be designed by the County's consultant if this project is approved. There are three property owners proposed to be assessed and staff has made contact with each owner on the proposed project and assessments. Staff also informed the property owner of extending sewer and water lines to their building and the requirement of a building permit with SAC (Sewer Availability Charges) and WAC (Water Availability Charges). PLEASE BRING YOUR FEASIBILITY REPORT TO THE MEETING. PROJECT COSTS: The total estimated project cost for the CSAH 69 Utility Improvements Project is $115,752.00 and is proposed to be 100% assessed. The cost proposed to be assessed on a per lot basis and that cost is $38,584.00 per commercial lot. ALTERNATIVES: 1. Adopt Resolution No. 7122, a resolution ordering the improvement and the preparation of plans and specifications for the CSAH 69 Utility Improvements, Project No. 2011 -6. 2. Deny Resolution No. 7122. This action will halt the project until such time as the City Council reconsiders the resolution. 3. Close the public hearing and table Resolution No. 7122, to allow staff to prepare additional information. 4. Continue the public hearing and table Resolution No. 7122 to allow staff to prepare additional information. RECOMMENDATION: Offer Resolution No. 7122, A Resolution Ordering an Improvement and Preparation of Plans and Specifications for the CSAH 69 Utility Improvements, Project No. 2011 -6, and move its adoption. If Council has concerns on this project, then continuing the public hearing and tabling Resolution No 7122 and provide staff direction would be in order. ACTION REQUESTED: Offer Resolution No. 7122, A Resolution. Public Wor irector ENGR/ 2011- PROJECTS /CSAH69 -U MITY- IMPROVEMENTS/WORD/MEM7122- ORDERING PROJECT RESOLUTION NO. 7122 A Resolution Ordering An Improvement And Preparation Of Plans And Specifications For The CSAH 69 Utility Improvements Project No. 2011 -6 WHEREAS, Resolution No. 7112 adopted on August 16, 2011, fixed a date for Council hearing on the proposed improvement of the CSAH 69 Utility Improvements Project and all appurtenant work; and WHEREAS, ten days published notice of the hearing through two weekly publications of the required notice was given and the hearing was held on the 20th day of September, 2011, at which all persons desiring to be heard were given an opportunity to be heard. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. That the improvement is necessary, cost effective and feasible and is ordered as hereinafter described: CSAG 69 Utility Improvements Project and all appurtenant work. 2. Bruce Loney, Public Works Director, is hereby designated as the engineer for this improvement. He shall prepare plans and specifications for the making of such improvements. 3. The work of this project is hereby designated as part of the 2011 -6 Public Improvement Program. 4. The City Council shall let the contract for all or part of the improvements as authorized by Minnesota Statutes 429.041, no later than three years from the date of adoption of this resolution.
