CITY OF SHAKOPEE Memorandum CASE NO.: 11 -015 TO: Mayor and City Council Mark McNeill, City Administrator FROM: Julie Klima, Planner II SUBJECT: Final Plat of Dean Lakes Seventh Addition MEETING DATE: September 6, 2011 REVIEW PERIOD: July 28 to November 25, 2011 P,�, 9 ui �c DISCUSSION Ryan Companies has submitted an application for final plat approval of Dean Lakes Seventh Addition. The proposed plat consists of a single lot proposed to be split into two parcels. The subject property is located between the existing Slumberland and Lowe's stores in Dean Lakes. Please see Exhibit A for location. The subject property is approximately 3 acres in size. The applicant is proposing that a JoAnn Fabrics store will be constructed on one of the newly created parcels and the other parcel will be available for future development. The parcel involved in this plat has been previously platted in other phases of the Dean Lakes Development. Because of these previous platting activities, many of the typical actions associated with platting have already been addressed. For instance, park dedication fees have been satisfied and there is not a need for a Developer's Agreement due to the infrastructure already being in place. There are existing special assessments for the subject site. The draft conditions of approval allow the applicant the option of either paying the outstanding balance of these assessments with the recording of the final plat or requesting that the assessments be reapportioned to the proposed lots to be created with this new plat. Shakopee Public Utilities has comments that the applicant shall be responsible for the coordination of the relocation of the existing Slumberland electric meter and that the existing Slumberland water service is to remain separate and independent of the new building's water service. Long Term Goal This action supports: Goal B: Positively manage the challenges and opportunities present by growth, development and changes. ALTERNATIVES 1. Approve Resolution No. 7120, approving the Final Plat for Dean Lakes Seventh Addition, subject to the conditions presented. 2. Approve Resolution No. 7120, approving the Final Plat for Dean Lakes Seventh Addition, subject to revised conditions. 3. Do not approve the final plat and direct staff to prepare a resolution consistent with the direction of the Council. 4. Table the matter and request additional information from staff and/or the applicant. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Shakopee, Minnesota that the final plat of Dean Lakes Seventh Addition is hereby approved subject to the following conditions: 1) The following procedural actions must be completed prior to the recording of the Final Plat: a) Approval of title by the City Attorney. b) Payment of trunk sanitary sewer charges, as required by the most current City of Shakopee Fee Schedule. c) Provide electronic (AutoCAD) files of the Final Plat and all record drawings to the engineering department. d) If the applicant wishes to reapportion the existing special assessments, such request shall be provided in writing to the City along with payment of the fee associated with the reapportionment. If the applicant does not submit said request, the payment of the special assessments in full shall be made prior to the recording of the final plat. 2) The following procedural actions must be completed prior to the issuance of a building permit: a) Payment of Trunk Storm Water Charges and Trunk Storm Water Storage and Treatment Charges, as required by the most current City of Shakopee Fee Schedule. 3) Following approval and recording of the final plat, the following conditions shall apply: a) All conditions from Resolutions 6213 and 6214 (Dean Lakes Retail Center PUD, Third Addition Preliminary and Final Plat) shall be complied with. b) Conditions of Dean Lakes First Addition Conservation Easement filed June 3, 2004 as Scott County Document No. T157654 shall be complied with.
