SUBJECT: Consider Amendment to Resolution No. 6469, by Approving a
Full Access on Crossings Boulevard at Penstemon Lane East

INTRODUCTION:
Attached is Resolution No. 7113, a resolution amending Resolution No. 6469, approving
the final plat of Southbridge Fields Addition.
BACKGROUND:
The final plat of Southbridge Fields Addition was approved on August 29, 2006 by
adopting Resolution No. 6469. The installation of the improvements included a right
in/right out access to the neighborhood commercial property which lines up with
Penstemon Lane East.
Since the installation, there have been problems with trucks exiting the commercial
property and turning eastbound on Crossing Boulevard at Penstemon Lane West as well
with vehicles making U -turns on Crossing Boulevard at Penstemon Lane West. Staff was
first contacted by Mr. Mohmmed Shah of 1801 Penstemon Lane and attached is his e-
mail and picture of damaged boulevard. Later staff was contacted by residents of West
Penstemon Lane to consider alleviating traffic concerns of the neighborhood. Attached is
their letter that was shared with the Council.
The Traffic Safety Review Committee (TSRC) has met on December 3, 2009, June 17,
2010 and May 19, 2011 to discuss alternatives. Early this year, staff had concept
drawings of alternatives prepared which are attached.
The TSRC did review the three alternatives and Option No. 2 was the preferred
alternative for opening the median. The committee felt the median could be opened with
the following reasons:
1. Traffic volumes on CSAH 18 will be reduced with the opening of CSAH 21. This
will therefore require less traffic signal timing for the CSAH 18 approaches and
providing more green time for Crossing Boulevard, which then will remove the
concern of traffic potentially backing up past the Penstemon Lane East
intersection. Less left turn storage approaching CSAH 18 will also be required.
2. The traffic volume on Crossings Boulevard will be reduced with the purchase of
several acres by the Shakopee Mdewakanton Sioux Community. This will result
in less conflict and delays for westbound Crossings Boulevard traffic attempting
to turn left onto the existing Penstemon Lane East.
3. Observation of the current traffic problems and difficulties would be improved by
opening the median by businesses and for the neighborhood. By allowing traffic
to turn left out of the business access, the issue of the truck driving on the
boulevard will be eliminated.
4. With the opening of the access, the amount of traffic past the swimming pool and
through the Penstemon Lane West intersection will be reduced, which will
improve the safety for residents walking or biking in this area.
In reviewing the geometries of the area, the East Penstemon Lane intersection is
approximately one City block in length. An example of a similar situation would be 4th
Avenue and CSAH 17 and 1 Avenue and Sommerville Street in the Downtown area.
For low speeds (30 m.p.h.) and low volume collector streets, the committee feels the full
access will function and be a better situation than the current arrangement.
The TSRC recommends amending the resolution to allow for a fall access at Penstemon
Lane East.
An informational meeting is scheduled to be held at 5:00 PM, July 28 by Steve Soltau of
Shakopee Crossings Limited Partnership with the neighborhood. The results of this
meeting will be presented by the August 3 meeting.
If this change of access is approved by the City Council, staff would approve the use of
our consultant, WSB & Associates, Inc. to complete the design for the development and
payment of design to be by the developer. The actual work would be done under a right -
of -way permit and this work would be done privately and paid by the developer.

1. Approve Resolution No. 7113, a Resolution Amending Resolution No. 6469,
Approving the Final Plat of Southbridge Fields Addition.
2. Do not approve Resolution No. 7113.

RESOLUTION NO. 7113
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA AMENDING
RESOLUTION NO. 6469 APPROVING THE FINAL PLAT
OF SOUTHBRIDGE FIELDS ADDITION
WHEREAS, Southbridge Crossings, L.P., applicant and property owner, has made application
for final plat approval of Southbridge Fields Addition; and
WHEREAS, the subject property is legally described as:
Outlots B, Riverside Fields 3 according to the recorded plat thereof, Scott County, Minnesota;
and
WHEREAS, the Planning Commission recommended approval of the proposed preliminary plat
with conditions; and
WHEREAS, on February 21, 2006, the City Council approved the proposed preliminary plat;
and
WHEREAS, on July 18, 2006, the City Council approved the proposed final plat pursuant to
Resolution No. 6460; and
WHEREAS, on August 29, 2006, the City Council considered a request by the applicant to
revise the conditions contained in Resolution No. 6460.
WHEREAS, on August 3, 2011, the City Council considered a request by the applicant to
revise Condition II.L on the access to Crossings Boulevard; and
WHEREAS, the City's Traffic Safety Review Committee received a request and made a
recommendation on May 19, 2011 to open the median with Option No. 2.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SHAKOPEE, MINNESOTA THAT RESOLUTION NO. 6469 IS HEREBY RESCI NDEE
AND THAT THE FINAL PLAT OF SOUTHBRIDGE FIELDS ADDITION IS HEREBY
APPROVED, SUBJECT TO THE FOLLOWING CONDITIONS:
I. The following procedural actions must be completed prior to the recording of the
Final Plat:
A. Approval of title by the City Attorney.
B. Remove the signature block for the City Planning Commission.
C. Execution of a Developer's Agreement, which shall include provisions for security
for public improvements within the plat and the engineering review fees, and any
other fees as required by the City's adopted fee schedule.
1. Shakopee Public Utilities Commission shall be contacted if the applicant
wishes to contract with them for security lighting.
2. Electrical system to be installed in accordance with the requirements of the
Shakopee Public Utilities Commission.
3. Water system to be installed in accordance with the requirements of the
Shakopee Public Utilities Commission.
4. Public sanitary sewer, public storm sewer and public watermain have
been extended through the site. The applicant shall work with City of
Shakopee staff to provide acceptable access to each system and their
associated appurtenances. This includes providing adequate easements
and entering into an encroachment agreement with the City.
5. The developer shall be responsible for payment of Trunk Storm Water
Charges, Trunk Sanitary Sewer Charges, Trunk Storm Water Storage and
Treatment Charges, security for the public improvements, engineering
review fees, and other fees as required by the City's most recent adopted
Fee Schedule.
6. No public improvements shall be constructed until the City Engineer and
the Shakopee Public Utility Commission approve the Final Construction
Plans and Specifications.
7. The applicant shall obtain an NPDES permit prior to any land disturbing
activity. A copy of this permit shall be forwarded to the City. The
applicant shall adhere to all MPCA NPDES requirements.
8. The applicant shall provide evidence of suitable easement agreements for
access to all adjacent properties utilizing the private sewer system. These
easements shall be approved by the City prior to recording of the plat.
Maintenance of these utilities shall be the responsibility of the applicant.
D. The applicant shall provide a more defined site plan showing impervious surface
percentages complying with the requirements set forth by City Code, at time of
Conditional Use Permit and Building Permit application submittals.
E. Easements shall be shown on the Final Plat as approved by the City Engineer.
F. The applicant shall contact City Engineering to apply for and secure an
encroachment agreement for the trunk storm sewer located along the westerly line
of Lots 1, 3, 4, 5 & 6, as well as secure an encroachment agreement for the trunk
sanitary sewer located between Lots 4 & 5.
G. The survey data (length and bearings) shall be shown for each lot.
H. Temporary street signs shall be provided until such time that permanent street
signs are installed.
I. The water distribution system shall be revised to comply with Shakopee Public
Utilities Commission's requirements. This shall include, but not be limited to,
identifying and providing water services for each lot.
J. Adequate easements for watermains shall be required, consistent with Shakopee
Public Utilities Commission's requirements.
K. The applicant shall meet park dedication requirements by providing cash in lieu of
land dedication.
L. Park dedication fees in the amount required by the City Code and adopted City fee
schedule shall be paid prior to the recording of the final plat.
M. The applicant shall provide an 8' wide bituminous trail connection, as per City
Standard Details, between Crossings Boulevard and Southbridge Parkway along
the west side of County Road 18.
N. Screening elements required by the Board of Adjustment and Appeals, the City
Council, and /or City Staff shall be allowed within drainage and utility easements
adjacent to Riverside Fields 3` Addition. The applicant shall be responsible for
the maintenance of the screening and shall repair and/or replace any landscaping
located in the easements that may be damaged due to need to access the
easements.
O. The applicant shall obtain a grading permit prior to any additional land disturbing
activity.
P. The soils on site shall be subject to sampling and testing at the City's discretion.
The cost associated with the testing, and if necessary, the removal of any material
deemed unacceptable by the City shall be the applicant's responsibility.
Q. The applicant shall provide storm water computations for the proposed
development as required by City Engineering to insure the downstream system
can accommodate the runoff.
R. The applicant shall ensure that the emergency access from Crossings Boulevard to
Southbridge Parkway be well maintained and accessible at all times.
H. Following approval and recording of the final plat, the following conditions shall
apply;
A. The applicant shall record the private road access easement document.
B. The developer and /or their assigns shall be responsible for any required or desired
noise or dust mitigation measures.
C. Shall provide electronic (AmoCAD) files of the Final Plat to the Engineering
Department.
D. The applicant shall meet the screening and landscaping ordinance requirements of
the City Code.
E. The applicant shall submit a landscaping plan for review and approval by the City
of Shakopee Natural Resource Specialist.
F. The applicant shall provide six (6) inches of topsoil below areas to be sodded.
The soil composition should be similar to the MnDOT topsoil borrow
requirements.
G. The applicant shall provide rain sensors for any irrigation system.
H. The applicant shall implement the use of Best Management Practices for erosion
control and stormwater management during construction.
I. The applicant shall utilize the MPCA Protecting Water Quality in Urban Areas as
a technical reference for erosion control.
J. The applicant shall comply with the design and performance standards for the
Planned Residential District (PRD).
K. Silt fence and/or tree protection fence is to be removed following establishment of
vegetation as determined by an inspection by City staff.
L. The easternmost access to Crossings Boulevard shall be constructed and signed
as a full access according to plans approved by the City Engineer (Option No. 2).

N. Any impact this development has, as far as adjusting or relocating existing
facilities, is subject to reimbursement to Time Warner Cable applicable costs of
relocation/ adjustment and subject to scheduling of work requested.
O. The developer is authorized to submit an application for a Minor (administrative)
Subdivision for Lot 3.
P. The applicants or their heirs and assigns shall be responsible for payment of the
costs of any future closing of the right -out access, as well as any future
improvements to the Crossings Boulevard infrastructure attributable to the
impacts of Southbridge Fields and the land uses contained therein.

Hello Bruce,
We are having serious problems with vehicles driving into our drive way for turns causing safety issues to my family
Yesterday (Friday 6th Nov. 2009) about 5.30 PM, my wife saw a silver color SUV drove into our drive way to take a turn
when my 3 year old kids and the elder daughter were playing in the front yard. It was a miraculous escape that my kids
didn't get hit by this vehicle.
Most of these driver who take turn like this are angry drivers who will not bother to hit anyone. I don't want to put my
family in the line. I hope you can understand the seriousness of my complaint and request you to take necessary action.
Yesterday, evening another vehicle ran in between the boulevard and my fence. Attached is a picture with the tire
tracks.
Today morning someone ran on the median and took down the sign board on Penstemon Lane and crossing Blvd
junction. Attached is a picture with broken sign board.
I would like to know if I have to make a written and signed complaint also, If you think I have to attend meetings or meet
any person in particular, I am willing to do it.

Hello Bruce,
Thanks for your time and listening to my concerns I have with my property and potential danger to my family that is
caused due to illegal U -Turns taken by several vehicles coming out of the Kwik Trip gas station.
I have attached a couple of pictures for you to look at and we are also planning on having a security camera to capture
the illegal turn that the vehicle makes to expedite the matter.

Re: Intersection of Crossings Boulevard and County Road 18
Dear Mayor Schmitt and City Council Members:
This letter is written on behalf of the residents of Penstemon Lane in Shakopee,
MN. In particular, the residents of the west side of the Penstemon Lane "loop."
As a group, we have concerns about the traffic patterns created by the roads and
accesses surrounding the Kwik Trip located at County Road 18 and Crossings
Blvd. We feel these traffic patterns have introduced safety issues into our
neighborhood, and led normally good- natured drivers to knowingly break traffic
laws in order to get to their destination.

Our neighborhood originally fought the construction of a gas station at this
intersection, fearing the inevitable increase in traffic — traffic that doesn't live
locally and therefore cares very little about our neighborhood. Since the day the
Kwik Trip has opened, our concerns have become reality.
The map below (Figure 1) shows the current road layout. As far as we know, the
Kwik Trip access loop road does not have a name, although it appears to be two
separate city streets.

The issues we see with the traffic patterns primarily revolve around customers
who wish to return to Co. Rd. 18 from Kwik Trip. In error, they take a left out of
the Kwik Trip. This leads to several issues (all shown in Figure 2 below):
• U -turns around the concrete median on Crossings Blvd (in spite of the "No
U- turn" sign directly overhead). This sign has been hit by cars and bent
over on at least two occasions.
• Taking a left onto Penstemon Lane, and realizing Penstemon doesn't lead
to where they want to go. Then they turn around in a residential driveway,
or do a U -turn in the middle of the road. Some residents have placed
unsightly large rocks at the corners of their driveways, in order to deter
these people from driving on their lawn during the turn - around process.
• Taking a left onto Penstemon Lane, and driving way too fast around our
horseshoe - shaped road to return to Crossings Blvd. There are a
significant number of children living on Penstemon Lane — out of 38
homes with lawns touching Penstemon Lane, 32 have children.
• Some cars choose not to take a right out of the Kwik Trip access road,
and instead take a left onto Crossings Blvd. east, driving directly over the
concrete median. This is very evident when the snow flies, as we can see
the tire tracks going across the snow - covered median (often times before
the snow is done falling).
In addition to these problems, there are issues with traffic that does follow the
recommended path to return to Co. Rd. 18. Traffic turning left from the Kwik Trip
access road onto Crossings Blvd east often times cannot make the turn given the
narrow width of Crossings Blvd and the placement of the concrete median. This
is particularly true for the 18 -wheel truck - trailer rigs. As shown in photos, there is
a significant hole in the lawn of 1801 Penstemon Lane, (currently 9 inches deep)
caused by repeated tires going up and over the curb. Soon, the mudhole may
get so deep that someone will bottom out the suspension of their vehicle, causing
an accident and blocking all traffic from the narrow road.

As we see it, there are two options to alleviate the issues noted above.
• Restrict the Kwik Trip access loop to one -way traffic, flowing counter-
clockwise. This would require narrowing the road to one lane, and
changing the Kwik Trip accesses to make it very clear that customers may
only take a right out of the business.
• Modify the median on Crossings Blvd to allow traffic to take a left out of
Kwik Trip, and then a left onto Crossings Blvd. The opening in the median
would have to be wide enough to allow truck - trailer rigs to make a left turn.
This modification could also allow residents of the east side of Penstemon
Lane, and the residents of Blazing Star Circle and Lobelia Court, to turn
left through the median and get into their homes slightly faster.
When the Kwik Trip project was approved, and the business opened, many
residents of Penstemon Lane were upset about the entire process and had
animosity toward Kwik Trip. Since then, most of us have realized the benefit and
convenience of having a business like this so close. However, we still feel the
need to address the numerous traffic and safety concerns caused by the roads
surrounding the business. We also understand that not every decision is made
properly the first time, and that actions we do not anticipate can become common
and unsafe. This is an opportunity to correct those decisions, benefitting both
residents and drivers.

Dear Bruce:
Please accept this correspondence as a request by Shakopee Crossings LP, Kwik Trip and US
Bank in response to the suggestion by the Transportation Advisory Committee to consider
opening of the median in Crossings Blvd. at Penstemon Lane. We collectively request the City
consider an amendment to the original resolution approving the plat of Southbridge Fields
Addition. This original resolution limited the traffic movements at the first point of access,
largely in part to the uncertainty of timing and completion of CSAH 21. With this improvement
currently under construction and scheduled to open, the underlying assumptions with the original
traffic analysis are significantly changed. We request an amendment to the Resolution allowing
the opening of the median and full movement. If this is approved we will move forward
privately with engineering, permitting and construction assuming satisfactory cost estimates and
bidding.
Although no Public Hearing would typically be required for this action, we believe it is critically
important the surrounding residents and Associations of Riverside Fields are provided ample
opportunity to review and comment. We will hold a neighborhood meeting prior to
consideration of this item and would encourage acceptance of public comment during Council's
consideration of this request.
I have attached a copy of the original traffic study and a concept drawing, Option Two,
developed by WSB. Please note that we are requesting only the opening of the median at the
first point of access and believe no other changes to the approved improvements are required.

This memo has been prepared to address the traffic related issues associated with the Alternative Site
Plan with a full movement access at Crossings Boulevard and East Penstemon Lane, developed as a
potential solution to neighborhood traffic concerns, as part of the Southbridge Fields commercial
development in Shakopee, MN.
The Alternative Site Plan was developed as a response to neighborhood traffic concerns to move traffic
away from the pool area on the southwest side of the site and creating a full movement access (with
suggested restricted westbound left turn movements during the PM peak hours) at the East Penstemon
Lane and Crossings Boulevard intersection by removing the center median in Crossings Boulevard to
allow left turn movements from the Southbridge Fields Addition to eastbound Crossings Boulevard.
The Alternative Site Plan, which details the median removal and turning movement restriction, is
illustrated in Figure 1. The Preliminary Site Plan with the existing full median closure and right -
in/right -out configuration at the East Penstemon Lane intersection is illustrated in Figure 2 for
comparison purposes.
The following details the steps taken to arrive at the estimated Build traffic volumes. Subsequently, the
results of the analysis are presented, which evaluates the operations of the surrounding roadway network
with the Build traffic volumes and the proposed alternative access configuration, along with any
additional suggestions and recommendations.
Existing Traffic Conditions
The existing conditions of the nearby roadway system were documented by a field inventory conducted
by RLK on June 13, 2006. The purpose of the inventory was to identify features that affect roadway
capacity, including traffic control, lane designations, turn lane storage bay lengths, speed limits, etc. It
is noted that the posted speed limit on Crossings Boulevard is 30 mph. In addition to the field inventory,
manual turning movement counts were conducted by RLK on Tuesday, June 13, 2006 from 7:00 -9:00

AM and 4:00 -6:00 PM to document existing weekday AM and PM peak hour traffic volumes at the
following intersections:
• County Road 18 & Crossings Boulevard
• Crossings Boulevard & East Penstemon Lane
• Crossings Boulevard and West Penstemon Lane
Review of the data indicates that the peak hour volumes generally occur during the following time
periods:
➢ Weekday AM Peak Hour: 7:00 to 8:00 AM
➢ Weekday PM Peak Hour: 4:45 to 5:45 PM
It is also noted that many westbound U -turns were observed at the Crossings Boulevard and West
Penstemon Lane intersection during both the AM and PM peak period.
Build Traffic Conditions
Site - Generated Traffic
The volume of vehicle trips generated by the proposed Southbridge Fields commercial development has
been estimated for the weekday AM and PM peak hours using the data and methodologies contained in
the 7 Edition of Trip Generation, published by the Institute of Transportation Engineers (ITE). The
estimated volume of site - generated trips for the proposed land uses, as detailed in the site plan, is
summarized in Table 1.

It is noted that these estimates include trip reductions for shared and pass -by trips. The shared trip
reduction accounts for trips that are predicted to be shared between land uses within the site. The pass -
by trip reduction accounts for trips that are attracted from traffic passing the site on adjacent streets
(County Road 18 and Crossings Boulevard). These pass -by trips are accounted for in the turning

movements at the proposed accesses as they enter and exit the site. The pass -by trips on Crossings
Boulevard do not result in an increase of traffic on the surrounding roadways. The pass -by trips from
County Road 18 result in an increased traffic on Crossings Boulevard as the vehicle have to utilize
Crossings Boulevard to gain access to the site.
Trip Distribution and Assignme nt
The estimated site - generated traffic for the Alternative Site Plan has been distributed to the roadway
network based on existing traffic patterns and predicted future traffic patterns. Figure 4, titled Site -
Generated Trip Assignment, illustrates the estimated changes in traffic volume on the study area
roadways expected as a result of the proposed development with the alternative access configuration. It
is noted, and illustrated in the Site - Generated Trip Assignment, that some of the existing trips to the
residential area on the south side of the site have been redistributed between the West Penstemon Lane
and East Penstemon Lane intersections the to reflect predicted future traffic patterns with the proposed
alternative access scenario.
Build Traffic Volumes
When combined, the site - generated traffic volumes and the existing traffic volumes result in the Build
scenario traffic volumes for the Alternative Site Plan, shown on Figure 5. It is noted that the Build
traffic volumes do not take into account the suggested westbound left turning restriction at the East
Penstemon Lane intersections for the PM peak period to provide a "worst case analysis ".
Intersection Operational Analysis
Intersection Operational Analysis Description
The operating conditions of transportation facilities, such as traffic signals and stop - controlled
intersections, are evaluated using current standards contained in the 2000 Highway Capacity Manual
(HCM), which are based on the relationship of the theoretical capacity of a facility to the actual traffic
volumes on that facility. Various factors affect capacity, including travel speed, roadway geometry,
grade, number and width of travel lanes, and intersection control. The procedures within the HCM
describe operating conditions in terms of a Level of Service (LOS). Facilities are given letter
designations from "A," representing the best operating conditions, to "F," representing the worst.
Generally, Level of Service "D" represents the threshold for acceptable overall intersection operating
conditions during a peak hour.
Also included in the results of the analysis is the estimated 95' percentile queue (the queue length that is
to be expected at most 5% of the time) reported from both Sychro software and from an average of five
SintTraffic simulations. The 95"' percentile queue was investigated to determine if there is predicted
spill -over from inadequate turning lane storage length or if any movements are anticipated to be blocked
by lengthy queues during peak hour traffic conditions associated with the Build conditions.
Results of the Build Analysis
This section contains the results of the intersection operational analyses for the Build conditions for the
alternative access configuration. Table 2, on the following page, details the results of the Build
Analysis:

1. LOS reported from Sync hro per HCM methodology. The worst movement LOS per approach is reported and overall intersection LOS.
2. The first 95" percentile queue for critical movements is reported from Synchro, while the second is a result of 5 SimTraffic simulations.
The results of the analysis of the Build conditions with the alternative access configuration detailed
above indicate acceptable peak hour operations. In particular, for the full movement intersection of
Crossings Boulevard and East Penstenom Lane, no approach LOS is predicted below `B" and all 95
percentile queues are accommodated by the proposed lane geometries. Additionally, no movements at
this intersection, especially the southbound left turning movement, are anticipated to be blocked or
inhibited by lengthy queues from surrounding intersections, mainly the eastbound left turn queue at the
County Road 18 and Crossings Boulevard intersection.
To further facilitate traffic operations and improve safety during the PM peak hour by reducing the
number of conflict points, a restricted left turn movement on westbound Crossings Boulevard to
southbound Penstenom Lane is suggested. Modeling indicates acceptable operations without this
restriction, but to address potential safety concerns a restriction is suggested.
Associated with the adoption of the Alternative Site Plan, the developer suggests conditional approval to
allow the City to close the median opening should the City perceive that either a safety issue develops,
or the access is no longer operating at an acceptable Level of Service due to further development of the
surrounding area and increased mainline traffic on Crossings Boulevard.
