Police Chief Take Home VehicleMW M0 CITY OF SHAKOPEE 1 t^ 1 Memorandum iaL� TO: Mayor and City Council FROM: Mark McNeill, City Administrator SUBJECT: Police Chief Take Home Vehicle DATE: June 7, 2011 Introduction: The Council is asked to amend the section of the Employment Agreement with Police Chief Jeff Tate, regarding a take -home vehicle. Background: Chief of Police /Emergency Management Director Jeff Tate was hired as police chief in June 1 2009. In his employment agreement, the following was stated: "Until June 1, 2011, the Employer shall allow the Employee the use of a City vehicle for City purposes, and for limited personal use incidental to travel within Shakopee, or to and from the Employee's primary residence and workplace. The limited use of the vehicle will not be excessive, and Employee shall document all personal use. It is also understood that the Employee maybe issued a Federal Income Tax W -2 form and have income tax obligations for this personal use. Continuation of said use of a City vehicle beyond June 1, 2011, shall be negotiated between the Employer and the Employee, in May, 2011. " The existing car being utilized has approximately 80,000 miles on it, but seems to be in relatively good shape. As long as the existing vehicle is operable, there is not a significant additional cost to the City at the current time to continue the existing arrangement with Chief Tate. It is not infrequently that Chief Tate gets called into work during off - hours. The City would reimburse mileage according to IRS rates, if not for the take -home vehicle. Note that the Fire Chief also has a take -home vehicle; the other department heads get reimbursed for mileage while on City business. When the current Police Chief take -home vehicle is in need of replacement, this issue will need to be re- examined. Recommendation: I recommend extending the existing arrangement for an additional two years, or until such time as the vehicle needs to be replaced, whichever is sooner. At that point, a re- examination of the issue will need to take place. Relationship to Visioning: This supports Goal E, "Deliver effective and efficient public services by a staff of well trained, caring, and professional employees." Action Required: If the Council concurs, it should, by motion, direct that the Employment Agreement with Police Chief Jeff Tate be amended to extend the take -home city vehicle provision for an additional two years, until May 31, 2013, or until such time as a replacement vehicle is needed, whichever is first.
