CITY OF SHAKOPEE MEMORANDUM To: Mayor and City Council Mark McNeill, City Administrator From: Jamie Polley, Director of Park, Recreation and Natural Resources Date: June 7, 2011 Subject: Award of Contract for Greenfield East /Park Meadows Park, Project PR2011 -1, Resolution No. 7103 and Authorize a Contract Extension for Construction Staking. INTRODUCTION The City Council is asked to offer Resolution No. 7103, A Resolution of the City of Shakopee Accepting Bids for Construction of Greenfield East /Park Meadows Park to Chard Tiling and Excavating, Inc. and provide direction to staff on project alternates. Council is also asked to authorize a contract extension for construction staking. DISCUSSION The bids for Greenfield East /Park Meadows Park were opened at 2:00 p.m. on June 1st, Wednesday. The bid tabulation is attached. There were six bids submitted and the apparent low bidder is Chard Tiling and Excavating, Inc. with a total base bid of $596,975.44. Chard Tiling have successfully completed projects for the City of Shakopee and received good recommendations from Public Works /Engineering Staff. Proiect Budget The current CIP allocation for this project is $675,000. The main components of this budget include: park construction, play equipment, design and construction administration. The construction budget, which includes a 5% contingency, is $555,060.00 and the Engineer's Estimate of the work bid was $577,367.53. The apparent low bid of $596,975.44 by Chard Tiling and Excavating is over the project estimate of $577,367.53. The project was bid with several deduct alternates to try to ensure it would be awarded within budget. Since the base bid is over budget, it makes sense to award the base bid with a few of the alternates. Council is asked to review the total bid, as well as the bid alternates and determine which, if any alternates should be approved. As per City Standard Specifications, quantities may be reduced before or after the award of the bid. Deduct Alternates and price reductions Bid Reduction 1. Deduct Alternate 1; Delete Basketball Court Paving - $9,422.53 2. Deduct Alternate 2; Delete Hockey Rink Paving - $46,629.46 3. Deduct Alternate 3; Delete Park Shelter (small shelter) - $27,870.00 4. Deduct Alternate 4; Delete Sand Volleyball and Horseshoes - $6,03220 5. Deduct Alternate 5; Delete 29 Parking Stalls - $34,236.29 6. Deduct Alternate 6; Use Recycles Hockey Rink Lights - $19,000.00 Total Re ductions -$ 143,190.48 Staff is recommending the approval of deduct alternates 1, 3, 5 and 6 to construct the park within budget while including the greatest number of amenities for the users. 1. Add Alternate 7; Concrete Rink $50,920.56 2. Add Alternate 8; Concrete Walk along Parkin Lot $7,574.35 3. Add Alternate 9; Run Electrical Service to Ball Field $4,150.00 Total Additions $62,644.91 The youth baseball association may request that add alternate 9 be included in the project at the cost of the association. The electrical service will serve the scoreboard and future batting cage. This addition may be completed through a change order. Below is a summary of the project budget with the base bid including alternates 1,3, 5 and 6: Park Construction $506,447 5% contingency $ 25,322 Play Equipment Purchase and Installation $ 85,000 Design $ 34,940 Construction Administration and Fees 25,000 Total $ 676,709 CIP Budget $ 675,000 Total over budget $ 1,709 PARK RESERVE The current balance in the Park Reserve Fund is $1,751,000.00. Following the construction of the Greenfield East /Park Meadows Park, the Riverside Fields /Riverside Bluffs playground and the park signage purchases the balance at the end of 2011 is anticipated to be approximately $992,000. CONSTRUCTION STAKING Construction staking will be completed by WSB and Associates. The construction staking fees are in addition to the park construction totals and will be funded utilizing the Park Reserve Fund. The quote for construction staking from WSB is an hourly rate not to exceed $12,000.00. ALTERNATIVES 1. If desired, offer Resolution No. 7103, A Resolution of the City of Shakopee Accepting Bids for Construction of Greenfield East /Park Meadows Park to Chard Tiling and Excavating Inc., or 2. Offer Resolution No. 7103, A Resolution of the City of Shakopee Accepting Bids for Construction of Greenfield East/Park Meadows Park to Chard Tiling and Excavating Inc. with desired alternate deducts as follow: a. With Alternate 1, deduct (Separate paved basketball court) b. With Alternate 3, deduct (Small shelter) c. With Alternate 5, deduct (29 parking stalls) d. With Alternate 6, deduct (Use of recycled hockey lights) 3. Reject the low bid and award the bid to another qualified bidder. 4. Reject all bids. RELATIONSHIP TO VISION A- Keep Shakopee a safe and healthy community where residents can pursue active and quality lifestyles. RECOMMENDATION Staff recommends alternatives 2, awarding the contract to the lowest qualified bidder, Chard Tiling and Excavating Inc. including alternates 1, 3, 5 and 6. The Parks and Recreation Advisory Board has not made a recommendation on this bid as they have not yet seen the results. REQUESTED ACTION If Council concurs, 1. Offer Resolution No. 7103, a Resolution Accepting Bids for Greenfield East /Park Meadows Park, including alternates 1, 3, 5 and 6, and move its adoption. 2. Authorize a contract extension to WSB and Associates for Construction Staking, with the amount not to exceed $12,000.00. RESOLUTION NO. 7103 A Resolution Accepting Bids for Construction of Greenfield East/Park Meadows Park Project No. PR2011 -1 WHEREAS, pursuant to an advertisement for bids for Construction of Greenfield East /Park Meadows Park Project No. PR2011 -1, bids were received, opened and tabulated according to law, and the following bids were received complying with the advertisement: Chard Tiling and Excavating, Inc. $596,975.44 K.A. Witt Construction $626,365.40 Frattalone Co. $635,057.71 Quiring Trucking and Excavating LLC $638,286.77 Sunram Construction, Inc. $676,594.39 Minnesota Dirt Works, Inc. $699,765.35 AND WHEREAS, it appears that Chard Tiling and Excavating Inc., 26239 State Hwy 25, Belle Plaine, MN 56011 is the lowest responsible bidder. AND WHEREAS, the contract shall include the deduct alternates as listed; Deduct Alternate 1; Delete Basketball Court Paving - $9,422.53 Deduct Alternate 3; Delete Park Shelter (small shelter) - $27,870.00 Deduct Alternate 5; Delete 29 Parking Stalls - $34,23629 Deduct Alternate 6; Use Recycles Hockey Rink Lights - $19,000.00 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. The appropriate City officials are hereby authorized and directed to enter into a contract with Chard Tiling and Excavating Inc. in the name of the City of Shakopee for the Construction of Greenfield East /Park Meadows Park, Project No. PR2011 -1, according to the plans and specifications ordered by the City Council and on file in the office of the City Engineer. 2. The City Clerk is hereby authorized and directed to return forthwith to all bidders the deposits made with their bids, except that the deposits of the successful bidder and the next lowest bidder shall be retained until a contract has been signed. Transmitted herewith is a copy of the Bid Tabulation for your information and file. Copies will also be distributed to each Bidder once the Project has been awarded. There were a total of six Bids received. The low Bidder on the Project was Chard Tiling and Excavating, Inc. with a Total Base Bid Amount of $596,975.44. This compares to and Engineer's Estimate of 577,367.53. These Bids have been reviewed and found to be in order. Discussions with City Staff have identified Deduct Alternate Nos. 1, 3, 5, and 6 as being the recommended alternates. We have also made an adjustment to the bid quantity of bituminous paving under Alternate No. 5 to correct an error on the Bid Form in determining the recommended award amount. If the City Council wishes to award the Project to the low Bidder, then Chard Tiling and Excavating, Inc. should be awarded the Project on the Total Base Bid Amount of $596,975.44 less the value of the accepted Alternates and the above adjustment, totaling $90,528.82, for a total awarded contract amount of $506,446.62. The table on the following page summarizes the calculation of this award amount.
