SUBJECT: Impose Penalties for Alcohol Violations

INTRODUCTION:
City Council has set June 7, 2011, to hear the alleged violation of eight liquor licensees who sold
alcohol to minors during compliance checks on May 27, 2010 and on June 17, 2010. No hearing
is necessary.
BACKGROUND:
On July 2, 2002, City council adopted penalties for the sale of alcohol to minors. The ordinance
adopted also allows the City Administrator to impose the penalties for a first or second incident
within a three -year period, upon an admission by the licensee that the licensee furnished or sold
an alcoholic beverage to a minor. Any licensee with a first or second violation within a three -
year period who admits to the violation will not need to appear before the City Council.
Valley Liquor, Inc., Top Star Market Inc., Canterbury Concessions, hie., Tokyo Sushi Grill &
Restaurant Inc., Snover BBQ LLC dba Dickey's Barbecue Pit, Fraternal Order of Eagles #4120,
Bretbecca hie. dba Pullman Club, and Magnum Management Corporation dba Valleyfair, have
admitted to their first violation and have signed the "Waiver and Admission of Violation ". No
hearing is required.
RECOMMENDED ACTION:
Acknowledge receipt of the "Waiver and Admission of Violation" from: Valley Liquor, Inc.,
1102 Shakopee Town Square; Top Star Market Inc., 615 South Marschall Road; Canterbury
Concessions, Inc., 1 100 Canterbury Road; Tokyo Sushi Grill & Restaurant Inc., 8080 Old Carriage
Court North; Snover BBQ LLC dba Dickey's Barbecue Pit, 8088 Old Carriage Court North;
Fraternal Order of Eagles #4120, 220 West 2 nd Avenue; Bretbecca Inc. dba Pullman Club, 124 West
I" Avenue; and Magnum Management Corporation dba Valleyfair, One Valleyfair Drive,
for the sale of alcohol to a minor and impose a penalty for the first violation in the amount of
$1,000 and a suspension of the license for one day, and suspend $500 of the fine and the one day
suspension for one year on the condition that the licensee has no further incidents of furnishing
or selling alcoholic beverages to a minor during that one -year period.
