Amendment to the Joint Powers Agreement of the Tri-City
Tactical Team

Council is asked to approve the attached Amendment to the Tri-City Tactical Team Joint
Powers Agreement. The Tri-City Tactical Team Joint Powers Agreement includes the
following Minnesota municipal corporations: City of Savage, City of Prior Lake, City of
Shakopee, and the Minnesota political subdivision Scott County. The Minnesota Political
subdivision, Carver County, is requesting to become a participating member of the Tri-
City Tactical Team.
BACKGROUND:
In March 2008, the Minnesota municipal corporations (cities of Savage, Prior Lake,
Shakopee, and the political subdivision of Scott County) signed the Tri-City Tactical
Team Joint Powers Agreement. The Tri-City Tactical Team Joint Powers Agreement
allows the municipal corporations and political subdivisions to establish, equip and
operate an organization to coordinate their efforts to develop and provide a joint response
to critical incidents or high risk situations in their jurisdictions where there is a risk of
criminal violence, through the use of negotiations and specialized tactics.
The Carver County Sheriff's Department has dissolved their Emergency Response Team
with the intent of merging into the Tri-City Tactical Team. The Tri-City Tactical Team
Governing Board has endorsed the addition of Carver County as a participating member.
Under this Amendment, Carver County would be added as a member and have all the
rights and duties of a member under said agreement. The result is improved collaboration
and sharing of resources, less strain on an individual agency to replace a member on the
team, as well as a reduction in costs to each participating department.
BUDGETIMPACT:
The addition of Carver County will allow the City of Shakopee to reduce its participation
dues in 2012 by $2,000.00 annually.

ALTERNATIVES:

RECOMMENDATION:
Staff recommends Alternative 1.
ACTION REQUESTED:
The City Council, if they concur, should by motion approve the attached Amendment to
the Tri-City Joint Powers Agreement.

AMENDMENT TO AGREEMENT
This Amendment to the Joint Powers Agreement of the Tri -City Tactical Team County and Cities Within
Scott County Minnesota, dated April 12, 2011, is made and entered into by and between the County of
Scott, a Minnesota political subdivision ( "Scott County "), the City of Prior Lake, a Minnesota municipal
corporation ( "Prior Lake "), the City of Savage, a Minnesota municipal corporation (' "Savage ") and the City
of Shakopee, a Minnesota municipal corporation ( "Shakopee "); the parties referred to collectively as the
"Members" of the Tri -City Tactical Team ( "TCTT ") and the County Of Carver,) a Minnesota political
subdivision ('Carver County").
WITNESSETH THAT:
WHEREAS, the Members entered into an agreement effective May 23, 2011 for jointly and
cooperatively coordinating efforts to develop and provide a response to critical incidents or high
risk situations where there is a risk of criminal violence occurring within the jurisdictions of the
Members; and
WHEREAS, the Members and Carver County wish to amend the original agreement to allow
Carver County to become a participating member.
NOW THEREFORE, in consideration of the mutual covenants contained herein, the parties
hereto agree that the aforementioned Agreement is amended pursuant to Clause 2.8 of the
Agreement as follows:
ADDITION OF MEMBER
Carver County shall be added to the Agreement as a Member and shall have all the rights and
duties of a Member under said Agreement.
2. OTHER CONTRACT PROVISIONS
All provisions of the aforementioned Agreement approved and not specifically amended hereto
shall continue with full force and effect.

be duly executed, the day and year first above written, intending to be bound thereby.
