ACTION SOUGHT
Offer and pass Ordinance No. 857, an ordinance rezoning property to Urban Residential (R -1B) from
Agricultural Preservation (AG). This action has no immediate budget impact.
INTRODUCTION
Trident Development LLC has made application for the rezoning of a 10 acre parcel located west of
Independence Drive and south of 17 Avenue. Please see Exhibit A for property location. The applicant is
requesting that the property be rezoned from Agricultural Preservation (AG) to Urban Residential (R -1B).
The request for rezoning to Urban Residential (R -1B) is consistent with the City's Comprehensive Plan. The
properties directly north, south, east and west of the subject site are zoned Urban Residential (R -1B). The
applicant (as discussed in their narrative) intends to construct an assisted living facility on the site. That
specific proposal will come forward for review and consideration under a separate application(s). Attached as
Exhibits B and C are copies of this subject site and surrounding areas depicted in the Comprehensive Plan
Map and Zoning Map.
PLANNING COMMISSION RECOMMENDATION
The Planning Commission reviewed this request at its July 12 meeting and recommended to the Council
that the rezoning request be approved. A copy of this report is attached for the Council's reference.
ALTERNATIVES
1. Offer and pass Ordinance No. 857, an ordinance rezoning property to Urban Residential (R -1B) from
Agricultural Preservation (AG).
2. Offer and pass a motion directing staff to prepare an alternative ordinance.
3. Table the request to seek additional information from the applicant and/or staff.

ORDINANCE NO. 857, FOURTH SERIES
AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA,
AMENDING THE ZONING MAP ADOPTED IN CITY CODE SEC. 11.03 BY REZONING
LAND TO URBAN RESIDENTIAL (R -1B) FROM AGRICULTURAL PRESERVATION (AG)
WHEREAS, Trident Development LLC, applicant, and the Church of St. Mary's, property
owner, have made application for the rezoning of property from Agricultural Preservation (AG)
Zone to Urban Residential (R -1 B) Zone; and
WHEREAS, the property is legally described as: The East Half of the South Half of the
Southwest Quarter of the Northeast Quarter of Section 17, Township] 15, Range 22, Scott County,
Minnesota; and
WHEREAS, notices were duly sent and posted, and a public hearing was held before the
Planning Commission on July 12, 2012, at which time all persons present were given an opportunity
to be heard; and
WHEREAS, the Planning Commission has recommended to the City Council that the
subject property rezoned as stated; and
WHEREAS, the City Council heard the matter at its meeting on August 6, 2012; and
NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Shakopee
hereby adopts the following findings of facts relative to the above -named request:
Finding #1 The original zoning ordinance is not in error. The property was zoned appropriately
prior to development occurring within its vicinity. The property owner has not had an
imminent need to request the rezoning until this point in time.
Finding #2 Significant changes in community goals and policies have not taken place. The
requested rezoning is in compliance with the City's adopted Comprehensive Plan which
supports development with urban services in this location.
Finding #3 Significant changes in development patterns have occurred in that development has
occurred within the vicinity of the subject property. Rezoning the property to the
requested designation would allow for connections and consistencies between
adjoining properties.
Finding #4 The Comprehensive Plan, as adopted, is consistent with the request on the subject
property.
BE IT FURTHER RESOLVED, that the request to rezone the property as stated in this
ordinance is hereby approved.

INTRODUCTION

Agricultural Preservation (AG) Zone to Urban Residential (R -1B) Zone. The property is located
south of SACS school, west of Independence Drive and north of Thrush Street and is 10 acres in
size. Please see Exhibit A for the proposed location.
DISCUSSION
The applicant submitted the attached narrative (Exhibit B) in connection with the application.
The request for rezoning to Urban Residential (R -1B) is consistent with the City's
Comprehensive Plan. The properties directly north, south, east and west of the subject site are
zoned Urban Residential (R -1B). The applicant (as discussed in their narrative) intends to
construct an assisted living facility on the site. That specific proposal will come forward for
review and consideration at a future meeting. This application, along with its review and
consideration is limited to the request for rezoning.
The City's Comprehensive Plan sets basic policies to guide the development of the City. The
purpose of designating different areas for residential, commercial, and industrial land uses is to
promote the location of compatible land uses, as well as to prevent incompatible land uses from
being located in close proximity to one another. The Zoning Ordinance is one of the legal means by
which the City implements the Comprehensive Plan. Under Minnesota statute, zoning is to
conform to a city's comprehensive plan. Copies of the land use plans and the Zoning Ordinance
are available for viewing at City Hall and will be made available at the July 12 meeting. The
City's Comprehensive Plan guides this property for single family residential development.
FINDINGS
The criteria required for the granting of a Zoning Ordinance Amendment are listed below with
proposed findings for the Commission's consideration.
Criteria #1 That the original Zoning Ordinance is in error;

Criteria #3 That significant changes in City -wide or neighborhood development patterns
have occurred; or
Finding #3 Significant changes in development patterns have occurred in that development has
occurred within the vicinity of the subject property. Rezoning the property to the
requested designation would allow for connections and consistencies between
adjoining properties.
Criteria #4 That the comprehensive plan requires a different provision.
Finding #4 The Comprehensive Plan, as adopted, is consistent with the request on the subject
property.
STAFF RECOMMENDATION
Staff recommends that the Planning Commission recommend to the City Council the approval of
the request to rezone the property to Urban Residential (R -1 B) (Alternative No. 1).
ALTERNATIVES
1. Offer a motion to recommend to the City Council the approval of the request to rezone the
property to Urban Residential (R -1 B) Zone.
2. Offer a motion to recommend to the City Council the denial of the request.
3. Offer a motion to continue the public hearing and request additional information from the
applicant and/or staff.

RE: REQUEST FOR RE-ZONING AND DETERMINATION BY BOA
ALL SAINTS SENIOR LIVING COMMUNITY
Dear Mr. Leek,
Trident Development, LLC is please to submit this application for re zoning and for a
determination by the Board of Adjustment and Appeals. We are requesting that the Board
determines that our intended use is similar to other uses, permitted by a Conditional Use Permit in
an R -1 B zoning district, due to the fact that it has similar land use impacts. We are also
requesting re- zoning of a 10 +/- acre parcel to an R -1B (Urban Residential) District, out of which
a 3 acres parcel will be platted. The subject development, All Saints Senior Living, will be
developed on the 3 acre lot. The land is currently zoned AG (Agricultural Preserve).
Trident proposes to develop and construct an 80 -unit assisted living community at the northeast
corner of Independence Drive and Thrush Street. The subject property is currently vacant and is
part of a larger, 10 -acre parcel now owned by The Church of St. Mary. The legal description of
the 10 -acre parcel is enclosed with this application.
On May 3rd, 2012, Trident Development conducted an informal neighborhood meeting at the
SACS elementary school, regarding the proposed All Saints Senior Living development. Direct
mail invitations were sent to 73 property owners within 350 feet of the subject property. There
were 6 neighbors in attendance. The neighbors were informed of the location of the development
in relation to their property, and provided considerable details of the intended site improvements.
Information regarding the developer, contractor and management company was provided, along
with an estimated project time line. The neighbors in attendance expressed no opposition to the
proposal and, in general, seemed supportive and inquisitive. Trident does not anticipate any great
opposition from the neighborhood in obtaining land use approvals.
Trident Development respectfully requests that the subject property (10 -acre parcel) be re -zoned
to R -1B Urban Residential. Provided the Board of Adjustment and Appeals determines that All
Saints Senior Living is a use similar to those permitted as Conditional Uses under the R -1B
zoning district, then the land use changes should allow the project as proposed.
