No. 7218 CITY OF SHAKOPEE Memorandum ENT CASE NO.: 12 -029 TO: Mayor and City Council Mark McNeill, City Administrator FROM: Mark Noble, Planner II SUBJECT: Final Plat of Shakopee Valley Marketplace 3 Addition MEETING DATE: August 8, 2012 REVIEW PERIOD: June 29 — October 26, 2012 ACTION SOUGHT: Kohl's Illinois, Inc. is requesting that the City Council approve their request to create two parcels in order to split their business from the adjacent businesses. INTRODUCTION: Kohl's Illinois, Inc. has submitted an application for final plat approval of Shakopee Valley Marketplace 3rd Addition. The plat proposes the split of one lot into two lots, one of which will be coterminous with the Kohl's store building. The subject property is located south of Highway 169, east of Marschall Road, and north of 17 Avenue (see Exhibit A for location). The subject property is approximately 11 acres in size. DISCUSSION: The applicant is proposing that these parcels be split in a manner that will result in Kohl's being situated on its own parcel, and the adjacent businesses (Party City, Office Max and Salon Avalon) will be located on the second parcel. This property was part of the Shakopee Valley Marketplace 2 Addition, which also was approved as part of the Shakopee Valley Marketplace Planned Unit Development, and has received approval of a Conditional Use Permit for a Retail Center. Staff distributed the application and plans to a number of city departments, Scott County, and utility companies, and other agencies. As of the drafting of this report, no specific comments have been received, nor suggested of approval. ALTERNATIVES 1. Approve Resolution No. 7218, approving the Final Plat for Shakopee Valley Marketplace 3rd Addition, as presented. 2. Approve Resolution No. 7218, approving the Final Plat for Shakopee Valley Marketplace 3rd Addition, subject to revised conditions. 3. Do not approve the final plat and direct staff to prepare a resolution consistent with the direction of the Council. 1 4. Table the matter and request additional information from staff and/or the applicant. BUDGET IMPACT: There would not be a direct budget impact based on this request. RECOMMENDATION: Staff recommends that the Council approve Resolution No. 7218, approving the Final Plat for Shakopee Valley Marketplace 3rd Addition, subject to the conditions presented. RELATIONSHIP TO VISIONING: This action supports Goal B: Positively manage the challenges and opportunities present by growth, development and changes. ACTION REQUESTED Offer a motion to approve Resolution No. 7218, a resolution approving the Final Plat of Shakopee Valley Marketplace 3rd Addition, and move its adoption. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Shakopee, Minnesota that the final plat of Shakopee Valley Marketplace 3rd Addition is hereby approved subject to the following conditions: 1) The following procedural actions must be completed prior to the recording of the Final Plat: a) Approval of title by the City Attorney. b) Execution of a Developer's Agreement, which shall include provisions for security for public improvements within the Final Plat and engineering review fees. c) Provide electronic files (Auto CAD and Adobe Acrobat formats of the Final Plat to be recorded with datum on the Scott County coordinate system. 2) Following approval and recording of the final plat, the following conditions shall apply: a) All conditions from Resolution No. 5340 (Shakopee Valley Marketplace PUD) and Resolution No. 5159 (Retail Center CUP) shall be complied with. b) Record plans need to be provided per the City of Shakopee Design Criteria, Section 2.5 and Section 11.2 (A -L). The record plans need to be submitted to the engineering department. Adopted in regular session of the City Council of the City of Shakopee, Minnesota, held the day of , 2012.
