CITY OF SHAKOPEE MEMORANDUM To: Mayor and City Council Mark McNeill, City Administrator From: Jamie Polley, Director of Parks, Recreation and Natural Resources Date: April 19, 2011 Subject: Designation of City Land as Extension of Memorial Park, Resolution No. 7092 INTRODUCTION The Shakopee Heritage Society (SHS), in partnership with several other organizations, is requesting the City's consideration for the dedication of park and located along Cavanaugh Drive. The City Council considered this request on March 15, 2011 and requested additional information prior to making a decision. DISCUSSION The SHS has asked the city to consider the dedication of a new park located south of Highway 101, West of Sarazin Street, and North of the Union Pacific Railroad tracks along Cavanaugh Drive (see attached site plan, Attachment A). The property in question is currently owned and maintained by the City and is approximately 3.9 acres in area. The site is currently listed as an historical site and has a historical monument displayed that identifies the Pond Mission site. It was identified that this property was conveyed to the City in 1947. Memorial Park, which is located north of Hwy. 101 adjacent to this site, was dedicated as a park in 1954. On March 15, 2011 staff presented a recommendation of the PRAB to dedicate the requested parcel as an extension of Memorial Park (memo Attached). The PRAB felt that since a trail will eventually connect the proposed parcel to Memorial Park via the 101 trail underpass, it made sense to extend Memorial Park rather than define the parcel as a separate park. During the consideration of this proposal the Council raised several questions. The main question being; what are the pros and cons of dedicating the parcel as a park versus designating it as park property and does it make a difference as to liability? Since the City currently owns the parcel, there is not a distinct benefit to dedicating it as a park versus designating it to be used as a park. According to the City Attorney, whether the City dedicates the land or designates it as a park, the parcel must still be vacated if it were to be used for a different purpose in the future. The area will fall under the recreational immunity laws whether it is dedicated or designated as a park. If it remains City property that is not used for park purposes, it does not fall under the recreational immunity laws. Other questions that were raised included; how will the City maintain and oversee the property and how will the park use impact the current historical marker in the Hwy. 101 right of way? The City will maintain and over see the park as part of Memorial Park. The Parks Department will add the area to their routine garbage pickup and maintenance schedule. Any improvements to the park will be required in written form as currently done with other parks. In addition, the City has the adopt -a -park program that would be available to the SHS. This program is a two year commitment that can be continually renewed and gives the adopting group a sense of ownership of the park. The group assists in cleaning the park throughout the year as well as proposing improvements to the park. The current historical marker will not be impacted and would remain in its current location and serve as a monument for the area. RELATIONSHIP TO VISION A. ACTION REQUESTED If the City Council concurs, Offer Resolution No. 7092, A Resolution of the City of Shakopee, Minnesota, Designating City Property as an Extension of Memorial Park, and move its adoption. Jamie Polley Director of Parks, Recreation & NR RESOLUTION NO. 7092 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA, DESIGNATING CITY PROPERTY AS AN EXTENSION OF MEMORIAL PARK WHEREAS, The City of Shakopee has a number of parks and recreational areas which reflect the history of the community; and WHEREAS, The City of Shakopee currently owns property located south of Highway 101, West of Sarazin Street, and North of the Union Pacific Railroad tracks along Cavanaugh Drive, and South of County Road 101, and East of the Faribault spring water site that contains the historical marker for the Pond Mission site, PID # 279060500; and WHEREAS, The property is that part of the East Half of the Northeast Quarter of Section 6, Township 115 North, Range 22 West, Scott County, Minnesota, described as follows: Beginning at a point on the northerly right of way line of the Chicago and North Western Transportation Company (formerly Chicago, St. Paul, Minneapolis, and Omaha Railway Company), which point is 48 rods due West from the east line of said Section 6; thence run due North 28 rods; thence run westerly parallel with said northerly right of way line about 32 rods to the west line of Government Lot 6 of said Section 6; thence south along said west government lot line 10 rods 3.5 feet; thence easterly parallel with said northerly right of way line 6 rods 7.5 feet; thence southerly 17 rods 13 feet to a point on said northerly right of way line, distant 8 rods easterly of the west line of said East Half of the Northeast Quarter; thence easterly about 24 rods along said northerly right of way line to the point of beginning; and WHEREAS, The Shakopee Historical Society has identified this property as having historical significance and would like to provide an educational opportunity for the citizens and visitors of Shakopee; and WHEREAS, The Park and Recreation Advisory Board recommends designating this property as an extension of Memorial Park. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, that said property is hereby designated to be used as park and and become an extension of Memorial Park. DISCUSSION The SHS has asked the city to consider the dedication of a new park located south of Highway 101, West of Sarazin Street, and North of the Union Pacific Railroad tracks along Cavanaugh Drive (see attached site plan, Attachment A). The site is currently listed as an historical site and has a monument displayed that identifies the Pond Mission site (Attachment B). The SHS is proposing that the City dedicate this parcel as park property. To enhance the park, they propose to construct kiosks and /or display boards (examples below) at this site, creating an interpretive center with the intent to inform the public of the historic significance of this area (specifically noting the establishments of Samuel Pond's Mission, Oliver Faribault's Trading Post, and the Dakota Village of Chief Shakpe). Picnic table and trash receptacle for visitors will also be included. Future improvements might include short walking paths and native plantings. Maintenance will include regular mowing and garbage pickup. The SHS has indicated that they will purchase the kiosks; however, maintenance and replacement of the kiosks if damaged would be the responsibility of the City. The Public Works Department has reviewed this plan and does not see any issues at this time. If kiosks need to be replaced they will be done so if funding allows or by contacting the SHS for assistance. The city currently mows the area and empties the trash receptacles located across the street at Memorial Park. The SHS presented their request to the Parks and Recreation Advisory Board (PRAB) on February 28, 2011. The PRAB reviewed the proposal and moved to recommend to the City Council that the parcel be dedicated as park land and that the park land become an extension of Memorial Park. The PRAB felt that since a trail will eventually connect the proposed parcel to Memorial Park via the 101 trail underpass, it made sense to extend Memorial Park rather than define the parcel as a separate park. A letter in support of the PRAB's recommendation from the Historic Preservation Advisory Commission is Attachment C. The SHS and other involved citizens / agencies are intending to attend the March 15 meeting and will be available to answer any questions that the City Council may have. • RELATIONSHIP TO VISION A.
