CITY OF SHAKOPEE Memorandum ttx C 0 pe { ,. , TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Request of PCI Roads, Inc. for Extending Work Hours on Scott County Road 21 Project DATE: April 5, 2011 INTRODUCTION: PCI Roads, Inc., the paving contractor for the County Road 21 Improvement Project from CSAH 42 to CSAH 18, has requested that City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, be suspended for certain work hours. BACKGROUND: The above named section of the City Code restricts the hours of operation from 7:00 A.M. to 10:00 P.M. on weekdays, and from 9:00 A.M. to 9:00 P.M. on weekends and holidays. PCI Roads, Inc. is requesting a suspension on the hours to allow for work 24 hours a day, for approximately 35 days of concrete paving beginning May 1, 2011. The contractor needs to saw the joints in the concrete pavement within certain timelines which could be all night in some cases. If the joints are not sawed within a certain timeline after paving, mid paved cracks can develop and the pavement will not be acceptable. Staff would recommend that if the suspension of hours is granted from May 1, 2011 to October 1, 2011, that the approval is subject to the following conditions: 1. Approval is contingent upon minimizing noise exposure and this approval is for 35 days with 15 days adjacent to residential property and for concrete pavement sawing only. 2. If property owner complaints are received by the City, the suspension can be revoked or additional conditions can be imposed at the discretion of the City Engineer. 3. The County /contractor shall provide written notification to adjacent residents to C.R. 21 of this concrete sawing work during the night prior to the work commencing. If Council approves the suspension, a public notice to meet the City Code requirements and notice such as a news release would be placed in the Shakopee Valley News. ALTERNATIVES: 1. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, per this memo, and direct staff to publish notice of the suspension terms with the conditions as recommended by staff. 2. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, for some other period of time as determined appropriate by the City Council, and direct staff to publish notice of the suspension terms. 3. Do not approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D. RECOMMENDATION: Staff recommends Alternative No. 1, as the concrete pavement sawing must be done within certain timelines to produce a quality product. ACTION REQUESTED: 1. PCiRoads will be constructing the concrete pavement which, as you may know, requires the sawing of control joints at 15' intervals approximately 6 — 24 hours after placement. The time of sawing is largely dependent upon temperature which effects the rate at which the concrete pavement sets -up. We really have no way of knowing exactly when the concrete will be sawed except that it will include night work. The sawing has to be completed in a very small window relative to its strength gain. Any delay in this operation will cause random cracking. There are approximately 35 days of concrete paving beginning about May 1' with the majority of paving being completed in the first month. The northerly area of the project, which is in a residential area, could be expected to have approximately 15 paving days. Some days may include sawing all night while others may not have any sawing past 10:00 p.m., although you should expect most days will include sawing into the early morning hours. There are multiple phases to tie CSAH 21 into CSAH 18, therefore, there will be work continuing into mid- summer. However, those tie -in areas are generally small and should have little, if any night time sawing. PCiRoads will make every effort to minimize the disturbance to the local residents, however, I want to re- emphasize that the concrete must be sawed in that very small window to prevent damage to the new pavement. Therefore, we are requesting a variance to your noise ordinance that would allow concrete sawing operations during night time hours during concrete paving operations.
